RECOMMENDATIONS:
1. APPOINT to the "Public Member" seat on the Hazardous Materials
Commission for the balance of an unexpired term ending December 31, 1998:

3. EXEMPT the "Public Member" seat on the Hazardous Materials Commission
from the policy of the Board of Supervisors relating to the appointment of
alternates on the basis that the Commission has had alternates for several
years.

4. REFER to the 1997 Internal Operations Committee the question of whether
the composition of the Hazardous Materials Commission should be adjusted
in order to reduce or eliminate a perceived bias toward industry which exists
with the current composition of the Commission.
BACKGROUND:
The Board of Supervisors has previously authorized advertising for applications for
the Public Member seat on the Hazardous Materials Commission. We initially
received 42 applications. Six individuals withdrew from consideration and advised
staff of that fact. Thirteen (13) applicants did not contact staff one way or the other.
They have been advised in writing that we assume they have disqualified
themselves. There were then 23 remaining applicants who were invited to be
interviewed for this seat.
On December 9, 1996, our Committee interviewed 18 of these 23 applicants. Five
applicants did not appear for the interview and were not considered further. One
applicant, the incumbent, Paul DeFalco, Jr., withdrew at the interview on the basis
that we had an adequate pool of qualified applicants. The remaining 17 applicants
represented a highly qualified and talented pool of individuals who are concerned
with the quality of the environment, recognize the right of industry to exist in the
County as long as it does so responsibly, and who are willing to serve on the
Commission.
Our Committee has selected Mr. Shoults as the Public Member and Mr. Duffy as his
alternate, in the event Mr. Shoults cannot attend a meeting. On the basis that the
Commission has historically had an alternate for this one position seat, we are
agreeing to fill the alternate seat, but are exempting this seat from the recently
adopted rules on the appointment of alternates. Mr. Duffy will not automatically
assume Mr. Shoults' seat in the event of his resignation, but will be able to serve in
Mr. Shoults' place in the event of Mr. Shoults' absence.
