Martinez, CA 94553 RE: SB610 Dear Mr. DeSaulnier: I am writing to keep you informed about a new cable television consumer protection statute which becomes effective on January 1, 1997. This bill will more clearly define the timelines and schedules by which cable television companies may collect on delinquent accounts. The new statute also sets a maximum administrative fee that can 'be charged to process these delinquent payments. We are notifying our customers 30 days in advance with a bill insert. Effective January 1, 1997 the maximum administrative fee is $4.75 statewide. Also on this same date, the timelines for collection of payments is also standardized statewide, and the home collection fee for picking up equipment or collecting the delinquent payment is standardized at$10.00. Due Dates.- Effective Jan.l the due date is the W day of the biNing cycle. •. Administrative fee. Effective January ft the processing fee for late payment may not be applied to the customer account until27 days after the due date. • Delinquent accounts may not be disconnected without at /east lsAys written notice (This may be provided on the regular bill or on a separate notice). Also, while not related to the new statute, TO will be increasing our returned check charge to $25.00. This change reflects the increasing costs passed on by our banks to our company to handle these returned checks. Overall, these changes are being put in I place to insure consistency statewide with the way these transactions take place. The statute willi also provide the cable operator with the ability to recoup a portion of the costs associated with collecting delinquent payments without the risk of facing frivolous class action lawsuits that have been attempted in the past several years. This new statute will help customers to manage their bill paying process by eliminating any confusion over the dates and times when collection processes occur with our'company.
