WESTMAN, COUNTY COUNSEL DATE: November 28, 1995 SUBJECT: Legal Representation - Miller, Starr& Regalia SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS Authorize County Counsel, or designee, to sign a letter allowing the Law Firm of Miller, Starr and Regalia to represent William H. Bailey in connection with his property located at 2 Deerfield Lane, Walnut Creek, concerning compliance with County Building Permit and zoning regulations. BACKGROUND/REASONS FOR RECOMMENDATIONS The law firm of Miller, Starr & Regalia (principally Ed Regalia) is presently representing Contra Costa County in connection with a lease purchase dispute with the City of Concord. That law firm's office has been approached by a Mr. William H. Bailey (owner of the above-noted property) concerning his current building permit and zoning relationships with Contra Costa County and an appeal taken by others concerning his application for a second unit land use permit on his Walnut Creek property. County Counsel agrees with the Miller, Starr & Regalia's statement that its representation of Mr. Bailey would not appear to involve any overlapping issues fact or law concerning Mr. Bailey's Walnut Creek application for a second unit. For this reason, the County Counsel recommends that the Board consider and approve Miller, Starr& Regalia's request that the County waive any potential conflict to allow their representation of Mr. William H. Bailey in connection with his current proposed second unit at 2 Deerfield Lane, Walnut Creek.
