SUBJECT: Authority for Auditor-Controller to Reimburse the
Estate of Robert Miller, P89-00934
SPECIFIC REQUEST S) OR RECOMMENDATION(S) & BACKGROUPD APD JUSTIFICATION
Recommended Action:
Grant authority to the Contra Costa County Auditor-Controller to reimburse the Estate of
Robert Miller $185.65.
Reason for Recommendation:
The Health Services Department Conservatorship/Guardianship Program was appointed the
Conservator for the Person and Estate of Robert Miller on July 20, 1989. The Program
became the representative payee for Mr. Miller's ASARCO retirement benefits. Mr. Miller
died on November 6, 1994. The Estate was .not entitled to the pension check dated 11/30/94
for $185.65 which was inadvertently deposited into the Conservatorship Trust Account. The
proceeds of that check were distributed to the Contra Costa County Treasurer on December 20,
1994 as court ordered conservatorship fees. That money must be refunded to the Estate of
Robert Miller so that a refund of the 11/30/94 ASARCO check can be made to ASARCO Inc.
