SUBJECT: Approval of Submission and Execution of Contract With the
State Office of Criminal Justice Planning For Funding of the
Contra Costa County Statutory Rape Vertical Prosecution Project For the Period of December 1,
1995 through November 30, 1996
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. RECOMMENDED ACTION
Authorize the District Attorney to submit an application and execute a grant award contract and any
extensions or amendments thereof with the State Office of Criminal Justice Planning for funding of the
Contra Costa County Statutory Rape Vertical Prosecution Project for the period of December 1, 1995
through November 30, 1996, in the amount of$150,000 (state funds).
II. FINANCIAL IMPACT 1
This grant application is in the amount of$150,000 to fund the salary and benefits for an attorney and
investigative staff for the project. The Budget Act of 1995 appropriated $12 million in state funds to the
Department of Health Services for a teen pregnancy prevention initiative. Of the$12 million, $2.4 million
was appropriated to the OCJP for assistance to the local district attorneys offices for the vertical
prosecution of individuals accused of statutory rape. Matching funds are not required. This is a one-year
pilot program which may be subject to renewal. Supplantation is prohibited.
Budget adjustments and P-300s, as appropriate, will be submitted when the grant award is approved by
the State.
III. REASONS FOR RECOMMENDATION/BACKGROUND
The growing problem of unwed teen pregnancy is a driving cause of fatherless families, and as many as
two-thirds of unwed teen mothers give birth to children fathered by adult men. A substantial number of
these mothers end up supported by AFDC funds, and the fathers frequently escape civil and criminal
responsibility for their irresponsible conduct. This vertical prosecution project will coordinate its efforts
in criminal cases for violations of Penal Code Section 261.5 with those of the District Attorney's Family
Support Division which brings civil actions for child support under the authority of Welfare and Institutions
Code Section 11350.
This OCJP program targets 16 counties having the highest rates of teen pregnancy; Contra Costa County
is designated as one of these counties.

IV. CONSEQUENCES OF NEGATIVE ACTION
Failure to approve this recommendation would result in the inability of the District Attorney to apply for
$150,000 in State funds available to assist in combating the problem and cost of teen pregnancy in
Contra Costa County.

RESOLUTION OF THE GOVERNING BOARD 95/ 577
WHEREAS the Board of Supervisors, Contra Costa County, desires to undertake a certain project
designated Statutory Rape Vertical Prosecution Project, to be funded in part from funds made
available through the Statutory Rape Vertical Prosecution Program administered by the State
Office of Criminal Justice Planning (hereinafter referred to as OCJP),
NOW, THEREFORE, BE IT RESOLVED that the District Attorney of the County of Contra Costa
is authorized, on its behalf, to submit the proposal to OCJP and are authorized to execute on
behalf of the Board of Supervisors the Grant Award Agreement, including any extensions or
amendments thereof.
BE IT FURTHER RESOLVED that the applicant agrees to provide all matching funds required for
said project (including any amendment thereof) under the Program and the funding terms and
conditions of OCJP and that the cash match will be appropriated as required.
IT IS AGREED that any liability arising out of the performance of the Grant Award Agreement,
including civil court actions or damages, shall be the responsibility of the grant recipient and the
authorized agency. The State of California and OCJP disclaim responsibility for any such liability.
BE IT FURTHER RESOLVED that grant funds received hereundershall not be used to supplant
expenditures controlled by this body.
