Approve the attached resolution which applies for a $750, 000 ISTEA grant to acquire land on Franklin Ridge in the Martinez area. 2 . Authorize the Community Development Director to sign all necessary grant application materials. 3 . Acknowledge that acquisition partners may include the Martinez Regional Land Trust and the East Bay Regional Park District and that the land may be acquired and owned in part by these agencies and that the County's interest may be transferred to either agency upon acquisition. 4 . Request the Director of Community Development to write a letter of support for the Martinez Regional Land Trust application for EEM funding for $250, 000 toward this acquisition. FISCAL IMPACT This grant application, if granted, will provide funds for the acquisition of this property, staff time to assist in the acquisition should be the only County cost. Public Works Martinez Land Trust (via CDD) BYE, , DEPUTY JWC:ss JWC 1995\ISTEA.BO ISTEA GRANT November 15, 1995 Page Two BACKGROUND/REASONS FOR RECOMMENDATIONS County staff has been approached by the Martinez Regional Land Trust staff requesting the County be the grant applicant for the potential acquisition of the 274 acre Mercury Marketing Corporation property on Franklin Ridge in the Martinez area. Only governmental agencies can apply for this fund; the Martinez Regional Land Trust is ineligible as a non-profit organization. The attached resolution is for $750,000 of ISTEA funds to assist in the acquisition and authorize the Director of Community Development to act as the County's agent in application and acquisition. If the site is acquired, the County's interest in the property will be transferred to the East Bay Regional Park District or possibly the Martinez Regional Land Trust. The site is designated Agricultural Lands on the County General Plan and is within the Briones Hills Agricultural Preserve, Additionally, the site is located on the County's Feeder Trail #1 and its acquisition would help in resolving this longstanding controversy. It commits a non-federal match of$162,000 from the Martinez Regional Land Trust. It certifies that this County will make adequate provisions for operation and maintenance of the project. It appoints Harvey E. Bragdon, Community Development Director as agent of Contra Costa County to conduct all negotiations, execute and submit all documents, including but not limited to application, agreements, amendments payment requests and so on, which may be necessary for the completions of this project. By way of background, the United States Congress has enacted the Intermodal Surface Transportation Efficiency Act of 1991, which is to make substantial Federal dollars over a six year period as funds to the California Department of Transportation for transportation enhancement activities. The Department of Transportation has established the procedures and criteria for reviewing proposals and along with the Regional Transportation Agencies, will submit to the California Transportation Commission a list of recommended projects from which the recipients will be selected. Procedures and criteria by the California Department of Transportation call for the approval of an application by the applicants governing body before submittal of said application to the California Transportation Commission. This application contains assurances that the applicant must comply with an agreement with the State of California to carry out transportation enhancement activities project.
