DISCLOSURE STATEMENT,
The undersigned, as owner of the property described as follows:
Parcels A and B, inclusive, as shown on Parcel Map MS 492, filed , in Parcel
Map Book , Page , Contra Costa County Records,
notifies all persons and/or entities acquiring an interest in said property that the following conditions and/or
restrictions may exist on said property. Compliance with said restrictions and/or conditions are the responsibility
of all future owners, successors and heirs, hereinafter referred to as "owner":
1. If archaeologic materials are uncovered during grading, trenching or other excavation, earthwork within
30 yards of these materials shall be stopped until a professional archaeologist who is certified by the
Society of California Archaeology(SCA), and/or the Society of Professional Archaeology(SOPA) has
had an opportunity to evaluate the significance of the find and suggest appropriate mitigation measures,
if they are deemed necessary.
2. The subject property is located near a high voltage electric transmission line. Purchasers should be
aware that there is ongoing research on possible potential adverse health effects caused by the
exposure to a magnetic field generated by high voltage lines. Although much more research is needed
before the question of whether magnetic fields actually cause adverse health effects can be resolved,
the basis for such an hypothesis is established. At this time no risk assessment has been made.
3. That you have purchased land in an agricultural area where you may regularly find farm equipment using
local roads, farm equipment causing dust, crop dusting and spraying occurring regularly, burning
associated with agricultural activity, noise associated with farm equipment and aerial crop dusting, and
certain animals and flies may exist on surrounding properties. This is, again, notification that this is part
of the agricultural way of life in East Contra Costa County and you should be fully aware of this at the
time of purchase.
4. Prior to the issuance of building permits, adequate fencing of an inconspicuous design shall be installed
to contain domestic animals with all gates being closeable by nearby rancher/farmers when necessary.
5. Prior to issuance of building permits, the owner shall apply to the Fire District for any permits which may
be necessary to comply with Fire Code requirements.
This Disclosure Statement shall be attached to and run with the deeds to each lot of the herein described real
property.

ROAD MAINTENANCE AGREEMENT
The party(ies) hereto is/are owners of lots or portions of Parcels A and B as designated on the map
entitled "Subdivision MS 4-92, Contra Costa County, California"which was filed in the office of the
County Recorder on , in Book of Parcel Maps, Page
The method of ingress to and egress from said parcels is by way of a private roadway constructed
within a private access and utility easement as delineated on said Parcel Map. It is the desire of the
party(ies) hereto to enter into an agreement for the preservation and maintenance of said roadway.
NOW THEREFORE, THE PARTY(IES) HERETO AGREE AS FOLLOWS:
1. The cost of maintaining the private roadway serving the property hereinabove referred
to shall be shared by the owners of each of said properties in proportion to the use
made of the roadway by each owner.
2. For the purposes of this agreement, the use made of the roadway shall be in direct
proportion to the distance between the intersection of Eagle Lane to a line drawn
perpendicular across said roadway from the upper limit of the driveway serving each of
said parcels.
3. In the event that any of the property subject to this agreement is divided into two or
more parcels, each parcel shall be treated for the purpose of this agreement as if it
were a separate lot and it in turn shall be responsible for its proportionate share of the
cost of maintaining said roadway.
• 4. The question of whether the road is in need of repair and the person or persons who
shall make the repair shall be decided by a majority vote of the parcels affected. In the
event of a tie vote, those holding the maximum proportionate interest shall prevail.
5. In the event any person owning one or more of the lots subject to this agreement shall
refuse to pay his proportionate share of any cost of repair or maintenance, then one or
more of the remaining owners may pay said cost, which cost shall become a lien on the
lot of the defaulting owner by the filing with the County Recorder of a notice of lien
within sixty days after payment of said cost. The defaulting owner shall be responsible
for all costs of collection including reasonable attorneys'fees.
This agreement is intended to run with the land, and shall be binding on the successors in interest to
the parcels involved.
