SUBJECT: ESTABLISHMENT OF DISADVANTAGED BUSINESS ENTERPRISE (DBE) GOALS IN
COMPLIANCE WITH THE "FEDERAL HIGHWAY ACT OF 1 987."
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. Recommended Action:
1. REAFFIRM its action of March 21, 1989, modifying Contra Costa County's MBE/WBE
Program, as it applies to federally-financed highway projects, to comply with the "Surface
Transportation and Uniform Relocation Assistance Act of 1987" (a.k.a. "Federal Highway Act
of 1987"), which presumes that women are socially and economically disadvantaged
individuals whose participation may be counted in attaining disadvantaged business enterprise
(DBE) goals. As such, separate MBE and WBE goals will no longer be used and the terms
"MBE and WBE" in the current adopted program shall be understood to mean DBE.
2. APPLY this modification only to projects funded and controlled under the authority of the
aforementioned Act.
3. CONFIRM its action of December 8, 1992, establishing 20% of the contract costs as the
minimum annual goal for DBE participation.
II. Financial Impact:
None. Prerequisite for federally-funded highway construction work.

III. Reasons for Recommendations and Background:
On September 15, 1987, the Board adopted a policy for the utilization of minority and women
business enterprises for construction contracts. The policy made a distinction and set separate
goals for the employment of"MBEs" and "WBEs." The "Federal Highway Act of 1987" requires
the combination of these categories as a single "DBE" (Disadvantaged Business Enterprise).
Section A.3 of the Board's policy provides for compliance with federal/state requirements.
On February 9, 1988, the Board modified its policy to conform to federal requirements for
federally financed projects. This action is in response to the requirements of the Federal
Highway Act of 1987 for annual updates.
On November 17, 1992, by a separate Order, the Board raised the goals for combined MBE
and WBE participation to 20%, necessitating a change in the DBE goals.
IV. Consequences of Negative Action:
By not complying with the requirements of the "Federal Highway Act of 1987", the County could
lose federal road project funds.
