SUBJECT: Establish Fee for Processing Drivers' License Restrictions
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Fix November 14, 1995 at 10 a.m. for a public hearing on the proposed establishment of an
administrative fee, as authorized by Section 40508.6 of the California Vehicle Code, to
cover the cost incurred by the courts when a driver's license is attached or restricted.
FINANCIAL IMPACT:
It is anticipated that revenues for the 1995/96 fiscal year will increase by $20,000. . .
and that subsequent annual revenue from collection of this fee will be $80,000.
REASONS FOR RECOMMENDATION/BACKGROUND:
California Vehicle Code Section 40508.6(b) provides that the Municipal Courts, with Board
of Supervisors' approval, may establish an administrative assessment/fee, not to exceed
$10, for clerical and administrative costs incurred for the attachment or restriction of a
defendant's driver's license.
The Municipal Courts have determined that administrative and clerical costs exceed $10,
and request that the fee be set at the maximum amount authorized under the law.
CONSEQUENCES OF NEGATIVE ACTION:
The revenue generated by assessing an administrative fee for placing a restriction or
attachment on a defendant's driver's licence will not be realized. The costs currently
incurred by the court, however, will continue.

Based on an average 2000 DMV holds placed each month. Salary
figures include 30% for benefits and 15% departmental overhead.
Notification sent to a defendant that he/she has failed to comply
with a written promise to appear or a court order to pay a fine.
Cost of automated system processing,
forms and mailing ($1 x 2000) $2,000 month
Automated update to DMV database $1,500 month
After failure to appear (FTA) holds are sent to DMV, a list of
drivers' licenses rejected by DMV is generated and sent to the
court. About 10-15% reject. These lists must be reviewed and
corrected, which usually involves pulling the original citation.
Work is done by a lead or division supervisor at an average
wage of $27. 30 per hour. About 750 of DMV holds issued by the
courts are for failure to appear.
150-200 rejects each month. . .
estimated 5 minutes to review/correct,
. . . estimated $2.25 x 175 holds $ 400 month
Failure to pay (FTP) holds require review at lead or supervisory
level to determine which cases should have holds, including time
to initiate DMV request. 250 of monthly holds are due to FTP.
estimated 5-10 min. to review ea case
. . . estimated $3.38 x 500 holds $1, 700 month
working DMV rejects, avg. 5-10% of holds
placed by court, 10-15 min. each to resolve
. . . estimated $5.60 x 40 holds $ 220 month
DMV notifies individuals that holds have been placed on their
drivers' license, that their license will be suspended in 40
days. It is estimated that a majority of the calls to the
Traffic Division relate to DMV actions of this nature. Callers
want to know how to clear the hold. Clerks access the automated
case record and explain how the case can be cleared. Usually
handled by a Deputy Clerk at the Experienced or Senior Level at
an average wage of $18. 90 per hour.
about 1500 calls countywide ea month,
average 5 min. each to resolve
. . . estimated $1.60 x 1500 calls $2, 400 month
walk-in inquiries
. . . estimated $1.60 x 350 $ 550 month
Each court experiences unique and often complex DMV hold problems
each month. Resolution usually involves contact with DP staff
and/or DMV staff and may require two to three hours work by a
lead or supervisor. Estimate is 10 per day countywide.
(Example: DMV has posted hold to wrong driver's license. )
. . . estimate 10 x $65 x 21 days $13 ,650 month
ESTIMATED MONTHLY PROCESSING COSTS: $22,420
Avg per hold $11. 21
