HomeMy WebLinkAboutMINUTES - 11141995 - SD11 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on November 14, 1995 , by the following vote: AYES: Supervisors Rogers, DeSaulnier, Torlakson, Smith NOES: None ABSENT: Supervisor Bishop ABSTAIN: None SUBJECT: Establish Fee for Processing Drivers' License Restrictions WHEREAS, pursuant to California Vehicle Code Section 40508 .6 , which provides that upon the adoption of a resolution, the County Board of Supervisors may establish an administrative assessment, not to exceed $10, for the clerical and administrative cost incurred for all defendants whose drivers' licenses are attached or restricted, and WHEREAS court clerical and administrative time involved in noticing the Department of Motor Vehicles of a restricted or attached driver's license has been determined to exceed $10 per case, NOW, THEREFORE, BE IT BY THE BOARD RESOLVED, that the fee of $10 be . established pursuant to the authority contained in California Vehicle Code Section 40508.6 for the administrative and clerical costs incurred for processing drivers' license attachments or restrictions. FINANCIAL IMPACT: It is anticipated that revenues for the 1995/96 fiscal year will increase by $20,000. . . and that subsequent annual revenue from collection of this fee will be $80,000. REASONS FOR RECOMMENDATION/BACKGROUND: California Vehicle Code Section 40508.6(b) provides that the Municipal Courts, with Board of Supervisors' approval, may establish an administrative assessment/fee, not to exceed $10, for clerical and administrative costs incurred for the attachment or restriction of a defendant's driver's license. The Municipal Courts have determined that administrative and clerical costs exceed $10, and request that the fee be set at the maximum amount authorized under the law. CONSEQUENCES OF NEGATIVE ACTION: The revenue generated by assessing an administrative fee for placing a restriction or attachment on a defendant's driver's licence will not be realized. The costs currently incurred by the court, however, will continue. Salary figures include 30% for benefits and 15% departmental overhead. Notification sent to a defendant that he/she has failed to comply with a written promise to appear or a court order to pay a fine. Cost of automated system processing, forms and mailing ($1 x 2000) $2,000 month Automated update to DMV database $1,500 month After failure to appear (FTA) holds are sent to DMV, a list of drivers' licenses rejected by DMV is generated and sent to the court. About 10-15% reject. These lists must be reviewed and corrected, which usually involves pulling the original citation. Work is done by a lead or division supervisor at an average wage of $27. 30 per hour. Clerks access the automated case record and explain how the case can be cleared.
