Staff had recommended denial of the proposed 25' McDonald' s pylon sign and installation of a 6'-8 ' high monument sign instead of the pylon sign. At its October 2, 1995, meeting, the East County Regional Planning Commission recommended approval of the pylon sign with a condition that the sign be setback as far away from Bailey Road as possible with landscaping at the base of the sign. t ADDENDUM TO ITEM D.5 NOVEMBER 14, 1995 This is the time noticed by the Clerk of the Board of Supervisors for hearing on the recommendation of the East County Regional Planning Commission on the request by McDonald's Corporation(applicant) and the Customer Company(owners) (3030-95RZ)to rezone land in the Bay Point area from Multiple Family Residential (M-29) and Two-Family(D-1) District to Planned Unit District(P-1), and for approval of Preliminary and Final Development Plan application(DP 3056-95)to construct an approximately 3,000 square foot McDonald's restaurant with drive-thru facility. Dennis Barry, Community Development Department, presented the staff report on the applications, and responded to a request for clarification on the position of the Oakley Municipal Advisory Commission on the sign, advising that they had recommended approval of a pylon sign. The public hearing was opened and the following person presented testimony: Robin Blackman, 2480 N. 1 st Street Suite 220, San Jose, representing McDonald's Corporation spoke in support of the staff position. After further discussion the Board took the following actions: 1. APPROVED Rezoning application 3030-95 for McDonald Restaurant's drive-through facility in Bay Point; 2. INTRODUCED the Ordinance giving effect to the rezoning,waived reading, and set November 28, 1995 for adoption of same; 3. CONTINUED to November 28, 1995, at 2 p.m.,the hearing on the Final Development Plan Application(DP 3056-95) z RESOLUTION NO.3019-1995 RESOLUTION OF THE EAST COUNTY REGIONAL PLANNING COMMISSION OF THE COUNTY OF CONTRA COSTA, STATE OF CALIFORNIA, INCORPORATING FINDINGS AND RECOMMENDATIONS ON THE REQUESTED CHANGE BY MCDONALD'S CORPORATION (APPLICANT) AND THE CUSTOMER COMPANY (OWNERS) , (RZ953030) , ' IN THE ORDINANCE CODE SECTION PERTAINING TO THE PRECISE ZONING FOR THE BAY POINT AREA OF SAID COUNTY ALONG WITH COMPANION APPLICATION PRELIMINARY AND FINAL DEVELOPMENT PLAN (DP953056) . WHEREAS, a request by McDonald's Corporation (Applicant) and The Customer Company (Owners) (RZ953030) to rezone land in the Bay Point area from Multiple Family Residential (M-29) and Two-Family (D-1) District to Planned Unit District (P-1) was received on July 14, 1995, along with companion Preliminary and Final Development Plan application (# DP953056) to construct an approximately 3, 000 square feet McDonald' s restaurant. WHEREAS, in connection with the applicant' s requests, an Initial Study of Environmental Significance was prepared by the Community Development Department which determined that the requested entitlements would not have any significant adverse environmental impacts; and WHEREAS, for purposes of compliance with provisions of the California Environmental Quality Act and State and County CEQA guidelines, a Negative Declaration of Environmental Significance was prepared, posted and circulated; and WHEREAS, after notice was lawfully given, a public hearing was scheduled before the East County Regional Planning Commission on Monday, October 2, 1995; whereat all persons interested might appear and be heard; and WHEREAS, on Monday, October 2, 1995, the East County Regional Planning Commission having fully reviewed, considered and evaluated all the testimony and evidence submitted in this matter; and NOW, THEREFORE, BE IT RESOLVED that East County Regional Planning Commission recommends to the Board of Supervisors of the County of Contra Costa, State of California, that the rezoning request of McDonald' s Corporation (Applicant) and The Customer Company (Owners) (#RZ953030) be approved for change from Multiple Family Residential District (M-29) and Two Family (D-1) District to Planned Unit District (P-1) , and that this zoning change be made as indicated on the findings map entitled: Page F-18 of the County' s 1978 Zoning Map and that Preliminary and Final Development Plan (#DP953056) be approved. f • ' Page two RESOLUTION NO.3019-1995 BE IT FURTHER RESOLVED that the reasons for this recommendation are as follows : 1 . Prior to issuance of a building permit, the applicant shall enter into a Reciprocal Option Agreement with the Contra Costa County Redevelopment Agency. 6. Prior to issuance of a building permit, the applicant shall enter into a First Source Hiring Agreement with the Contra Costa County Redevelopment Agency. 7. The exterior colors and materials shall be subject to the review and approval of the Zoning Administrator prior to the issuance of a building permit for the proposed restaurant. 8. The maximum indoor seating capacity allowed is 75 patrons. Seating for those waiting to pick-up take-out food shall not be included in this total. 9. The sound system for the take-out, drive-up window shall be designed to not project off-site. 10. No outdoor sales or storage of materials is permitted. 2 11. Should archaeological materials be uncovered during grading, trenching or other on-site excavation(s), earthwork within 30 yards of these materials shall be stopped until a professional archaeologist who is certified by the Society for California Archaeology (SCA) and/or the Society of Professional Archaeology(SOPA) has had an opportunity to evaluate the significance of the find and suggest appropriate mitigation(s), if deemed necessary. 12. Comply with the following construction, noise, dust and litter control requirements: A. Noise generating construction activities, including such things as power generators, shall be limited to the hours of 7:30 A.M. to 5:00 P.M., Monday through Friday, and shall be prohibited on State and Federal holidays. The restrictions on allowed working days may be modified on prior written approval by the Zoning Administrator. B. The project sponsor shall require their contractors and subcontractors to fit all internal combustion engines with mufflers which are in good condition and shall locate stationary noise-generating equipment such as air compressors and concrete pumpers as far away from existing residences as possible. C. At least one week prior to commencement of grading, the applicant shall post the site and mail to the owners of property within 300 feet of the exterior boundary of the project site notice that construction work will commence. The notice shall include a list of contact persons with name,title, phone number and area of responsibility. The person responsible for maintaining the list shall be included. The list shall be kept current at all times and shall consist of persons with authority to indicate and implement corrective action in their area of responsibility. The names of the individual responsible for noise and litter control shall be expressly identified in the notice. The notice shall be reissued with each phase of major grading activity. A copy of the notice shall be concurrently transmitted to the community Development Department. The notice shall be accompanied by a list of the names and addresses of the property owners noticed, and a map identifying the area noticed. D. A dust and litter control program shall be submitted for the review and approval of the Zoning Administrator. Any violation of the approved program or applicable ordinances shall require an immediate work stoppage. Construction work shall not be allowed to resume until, if necessary, an appropriate construction bond has been posted. E. The applicant shall make a good-faith effort to avoid interference with existing neighborhood traffic flows. Prior to issuance of building permits, the proposed roads serving this development shall be constructed to provide access to each lot. This shall include provision for an on-site area in which to park earth moving equipment. r r 13. Parking spaces shall be marked or maintained on the pavement and any other directional marking or signs shall be installed as permitted to insure the maximum utilization of space, sufficient traffic flow and general safety. 14. Lighting shall be directed downward and away from residential areas and public streets so as not to produce a glare. Lighting intensity shall be no greater than reasonably required to light the parking area. 15. A barrier curb or wheel stop at least 6" in height shall be provided adjacent to landscaping and buildings to prevent damage to these facilities by the vehicles utilizing the parking areas. 16. At least three times a week, pick up and properly dispose of trash, litter and garbage originating from the take-out establishment deposited on public property within 400 feet of any boundary of the subject property. 17. Upon the request of any owner of private property located within 400 feet of any boundary of the premises on which the take-out food establishment is located, the operator of the take- out food establishment shall pick-up properly dispose of trash, litter and garbage originating from the premises within 24 hours of the request. 18. Prior to issuance of a building permit, the applicant shall demonstrate compliance with the take-out food ordinance (#88-16) relative to assurance of trash abatement in the vicinity of the site. A cash deposit, letter of credit or corporate surety bond equivalent to $1,125 shall be deposited with Community Development Department prior to obtaining building permit for the restaurant. 19. All proposed landscaping shall conform to the County Water Conservation Landscape Ordinance #82-2. The plan shall be prepared by a licensed landscape architect and shall be certified to be in compliance with the County Water Conservation Ordinance. The plan shall be reviewed and approved by the Zoning Administrator prior to obtaining permit for the restaurant. 20 Conditions of Approval from the Public Works Department. A. General Requirements: 1) This development shall conform to the requirements of Division 914 (Drainage) and the remainder of Title 9 and Title 10 of the Subdivision Ordinance. Any exceptions there from must be specifically listed in the conditional approval statement. Drainage, road and utility requirements are based on the plan submitted on August 1995 and shall be subject to the review of the Public Works Department. 4 2) Improvement plans prepared by a registered civil engineer shall be submitted to the Public Works Department, Engineering Services Division, along with review and inspection fees, and security for all improvements required by the Ordinance Code or the conditions of approval for this project. 3) All public pedestrian facilities and access ways shall be designed in accordance with Title 24 (Handicap access)and the Americans with Disabilities Act: This shall include all sidewalks, paths, trails, driveway depressions as well as handicap ramps. B. Roadway Improvements (Frontage/On-Site/Off-Site): Applicant shall remove the existing driveway depression on the south/east side of Canal Road between the proposed driveway entrance to the site off Canal Road and the Bailey Road/Canal Road intersection and install conforming curb and sidewalks. C. Access to Adjoining Property: Proof of Access/Acquisition 1) Applicant shall furnish proof to the Public Works Department, Engineering Services Division, of the acquisition of all necessary rights of way, rights of entry, permits and/or easements for the construction of off-site, temporary or permanent, road or drainage improvements. Rncronchmeut Permit 2) Obtain an encroachment permit from the Application and Permit Center for construction of driveways, or other improvements within the right of way of Bailey Road and Canal Road. 3) If necessary, an encroachment permit for construction within the State right of way shall be obtained from Caltrans through the Public Works Department, Engineering Services Division. D. Parking: "No Parking" signs shall be installed to restrict parking along Canal Road on the south/east side. E. Sight Distance: 1) Placement of store signs and other potential sight distance obstructions shall be subject to the review of the Public Works Department, and review and approval of the Zoning Administrator. 2) To provide for adequate sight distance at the Canal Road driveway entrance, landscaping along the frontage of Canal Road shall be restricted to a height of 0.8 meters (2.5 feet) or less, measured from the top of curb. F. Utilities/Undergrounding: All utility distribution facilities shall be installed underground, including the existing overhead distribution facilities along the frontage of Bailey Road. The applicant is granted an exception from undergrounding utility distribution facilities along the frontage of Canal Road. G. Drainage Improvements: Collect and Convey 1) Division 914 of the Ordinance Code requires that all storm waters entering or originating within the subject property shall be conveyed, without diversion and within an adequate storm drainage facility, to a natural watercourse having definable bed and banks, or to an existing adequate public storm drainage facility which conveys the storm waters to a natural watercourse. 2) Discharging storm waters into the Contra Costa Canal or any other water conveyance or impounding facility for domestic water consumption is prohibited by the Ordinance Code. 3) Storm drainage facilities required by Division 914 shall be designed and constricted in accordance with specifications outlined in Division 914 and in compliance with design standards of the Public Works Department. H. B. The applicant shall be required to comply with the drainage fee requirements for Drainage Area 48D as adopted by the Board of Supervisors. C. The applicant shall be required to comply with all rules, regulations, and procedures of the National Pollutant Discharge Elimination Systems (NPDES) for municipal, construction and industrial activities as promulgated by the California State Water Resources Control Board, or any of its Regional Water Quality Control Boards (San Francisco Bay - Region II or Central Valley - Region V). D. Comply with the requirements of the Delta Diablo Sanitation District. E. Comply with the requirements of the Contra Costa County Fire Protection District. F. Comply with the requirements of the Health Services Department, Environmental Health Division. _ ..G. Comply with the requirements of the Building Inspection Department. Building permits are required prior to the construction of most structures. H. General Plan: The General Plan for the block bounded by Canal Road and Bailey Road in the Bay Point area was clhanged to Commercial on July 11, 1995. B. Zonin<c,: Present zoning - D-1 and M-29. Proposed zoning - Planned Unit District (P'1). i 2 C. CEQA Status: A Negative Declaration of Environmental Significance was posted on September 7, 1995. D. Prior Applications: 1. County File #3009 RZ: Rezoning request to change the zoning from Neighborhood Business(N-B),Multiple Family Residential (M-29), and Two Family District (D-1) to Planned Unit District (P-1). 2. County File#3012-93: Development plan request to construct a new 8,000 square foot grocery store. 3. County File #2045-93: Land Use Permit request for a take -out food establishment. All the above mentioned applications included properties to the south of the subject property. However, all the above mentioned applications were withdrawn by the applicant. IV. SITE DESCRIPTION The site is currently vacant and is bounded by Canal Road on the north and west, and Bailey Road on the east side. A paved access driveway runs through the subject property from Canal Road to the Cheaper store, located on the south side of the subject property. V. AREA DESCRIPTION To the east of the subject property, across from Bailey Road, is a mobile home park. To the north is a church and an apartment building. To the immediate south is a 4,000 square foot Cheaper store with gas islands and related parking. The area is rapidly changing due to the extension of BART to Pittsburg. VII. AGENCY COMMENTS A. Bay Point Municipal Advisory Council: Project was recommended for approval by the BPMAC on July 19, 1995. B. City of Pittsburg: The proposed site is located in the City of Pittsburg's sphere of influence. The City's General Plan designation is `'Residential Medium Density (5.1 -14.0 du/ac.)." Therefore the proposed zone change will be inconsistent with the City's General Plan. The City has had problems with drive-thrus, specifically the lack of queuing space for, at least, five cars (maybe 80-100 feet). 3 Staffs response: Under the County's General Plan, the property is designated for Commercial use. The proposed rezoning is consistent with the General Plan and will bring zoning in compliance with the General Plan. McDonald's has proposed 140' of queuing space. This will provide queuing space for 7-8 cars. C. Health Services Department, Environmental Health Division: See attached. D. Delta Diablo Sanitation District: Prior to issuing a building permit, Delta Diablo Sanitation District fees must be paid. E. Building Inspection Department: No comments. F. Contra Costa County Fire Protection District: See attached. G. Southern California Water Company:: Water service is available (see attached). H. California Archaeological Inventory: There is a low possibility of archaeological sites. Further study for archaeological resources is not recommended. VI. PROJECT DESCRIPTION The applicant is proposing to rezone the property from Multiple Family Residential District (M-29) and Two Family District(D-1) to a Planned Unit District (P-1). The General Plan for the property is Commercial. The current zoning for the property is not consistent with the General Plan designation for the property. Staff is recommending approval of the rezoning to P-1 since this will bring the zoning in compliance with the General Plan. The applicant is proposing to construct a 3,000 sq.ft. McDonald's restaurant with drive-thru facility. It consists of a dining area, kitchen, storage/utility area and restrooms with a future play area. The restaurant is proposed to be open between 6 a.m -11 p.m, 7 days a week. The applicant expects a total of 45 positions to be created at the restaurant with 10-15 of these positions being part-time. 11) Parking/Access Forty-nine (49) parking spaces are provided on site. The building is proposed to be located on the south side of the property with parking area to the north. Drive thru facility is proposed at the southern side of the building. Sixty -five seats are proposed to be located indoors and 20 seats are proposed to be located outdoors. The County Zoning Ordinance requires a minimum of one parking space/3 seats for restaurants. The parking required for an 85 seat restaurant would be 29. The applicant has provided 20 parking spaces in excess of the required minimum. 4 Access to the restaurant is proposed from Canal Road and Bailey Road. The access from Bailey Road would be limited to inbound right and outbound right turn only. Upon entering from Canal or Bailey Road, the customers can access the drive-thru area or park the vehicle in the parking lot and enter the restaurant from the main entrance on the north side of the building. Staff feels that sufficient queuing space (7-8 cars) has been provided for the drive- thru window. The northernmost driveway aisle proposed by the applicant is 30' wide. The parking spaces located to the immediate north of the building (front of building) and the parking spaces at the north end of the property are 9'x18'. The zoning ordinance requires parking spaces to be 9'x19'for standard spaces. Staff is recommending that this space be increased to 9'x19'. This will reduce the northernmost driveway aisle to 28', but still be consistent with the zoning provisions. Architecture and Landscaping The proposed building consists of stucco exterior with the roofing.The highest point of the building is 22'-6" from grade. The architecture is compatible with some of the recently constructed buildings in the area. Staff is recommending that the final colors be reviewed and approved by the Zoning Administrator prior to issuance of a building permit. The applicant is proposing mounded lawn along Canal Road and at the rear of the proposed building (between the drive-thru and the building). The parking area landscaping and the landscape along the Bailey Road frontage consist mainly of drought tolerant trees, shrubs and - ground covers. Staff is recommending that the proposed landscape conform with the County's water conservation ordinance. Staff is recommending that at least 30 days prior to issuance of a building permit, the applicant submit a final landscape plan for review and approval of the Zoning Administrator. Assemblage of Parcels/Consistency with the General Plan: The applicant has assembled 6 lots located at the south east intersection of Bailey and Canal Road. The property to the immediate south of the subject property is owned by the Customer Company and is occupied by a Cheaper store with associated gas station and parking. All these properties have frontage on Bailey Road. Four remaining parcels in this block with frontage on Canal Road are owned or currently beim purchased by the County Redevelopment Agency.. When the General Plan for this block was changed to Commercial by the Board of Supervisors on July 11, 1995, a new policy was adopted statim that all feasible access (including parking) alternatives which emphasize Bailey Road access shall be considered when reviewing development plans for this area. The applicant has stated a willingness to enter into 5 a Reciprocal Option Agreement with the County Redevelopment Agency providing each party to purchase portions of their respective holdings for further development consistent with the General Plan . Access easements are also provided for. This is consistent with the Bay Point Redevelopment program and will assist in achieving build out of the block. McDonald's restaurant is also proposing a cross access easement to the Cheaper store on the south western side of the property. Four parking spaces eliminated due to this easement will be replaced by McDonald's. Staff is recommending that the exact location of the parking spaces for the Cheaper store be determined by the applicant with consultation with the Cheaper representatives and be reviewed and approved by the Zoning Administrator prior to issuance of the building permit for the McDonald's restaurant. Variance for Lot Size: Section 84-66.602 of the County Zoning Ordinance requires a minimum lot size of 10 acres for a P-1 non-residential development. The applicant is requesting a variance from this minimum lot size requirement. Staff has made the following findings per Section 26-2.2006 of the County Zoning Ordinance. A. Special circumstances are applicable to the subject property's location and surroundings. It is bounded by streets on all four sides. It is close to Highway 4 and Pittsburg BART Station, which is under construction now. B. The variance authorized meets the intent and purpose of the Commercial land use district in which the property is located. C. The variance authorized will not constitute a grant of special privilege. IX. ROAD AND DRAINAGE CONSIDERATIONS The attached conditions of approval based on the revised site plan date received August, 1995 include road and drainage requirements. The applicant should be fully aware of the County Subdivision Ordinance Code requirements as they pertain to this development. X. SIGNAGE The applicant is proposing a 25 foot pylon sign at the south west corner of Bailey and Canal Road. The sign itself is proposed to be approximately S'x8' with the logo against a red background with an 8" "drive-thru"copy. The applicant is also proposing the "m" logo on all 4 sides of the building, in addition to a"McDonalds" sign on the south side of the building facing the freeway. In addition, other directional, order board and promotional sign boards would be located in the facility. 3 6 The sign program under the P-1 rezoning should achieve a higher design objective than conventional zoning and improve the attractiveness of the area. The proposed signs on the face of all 4 sides of the building total approximately 90 sq.ft. Staff is recommending approval of the signs since it will provide sufficient identification of the business without detracting from the character of the community. The proposed 25' pylon sign is approximately 65 sq.ft and is higher than the highest point of the building (i.e., 22'-6"). Staff feels that the pylon sign will detract from the efforts to enhance the visual quality of the Bay Point community. It contributes to the overhead visual clutter. While the sign is intended to provide freeway visibility, staff does not see the need for.a 25' tall sign since the signs on the south side of the building (facing the freeway) are located at approximately 17' from grade. Staff recommends that a monument sign be installed instead of the pylon sign. The monument sign and all other proposed signs shall be reviewed and approved by the Zoning Administrator prior to obtaining the building permit for the restaurant. XI. FINDINGS A. Findings for Approval of the Rezoning: 1. The change proposed will substantially comply with the recommended General Plan for the property. 2. The proposed store with gas pumps and take-out food is compatible within the P-1 district. 3. There is a community need for the use proposed. B. Findings for Approval of the Final Development Plan: 1. The applicant intends to start construction xvithin two and one-half years from effective date of zoning change and plan approval. (See attached) 2. The proposed P-1 development is consistent with the Commercial General Plan designation for the property. 3. The proposed development is needed at the proposed location to provide adequate facilities. C. Findings for Land Use Permit: 1. The proposed LUP for take-out food establishment will not be detrimental to the health, safety and general welfare of the County. f 2. It does not adversely affect the orderly development of property within the County. 3. It does not adversely affect the preservation of property values and the protection of the tax base within the County. 4. It does not affect the policies and goals as set by the General Plan. 5. It will not create nuisance and/or enforcement problem within the community. Conditions of Approval on the permit address trash, litter and garbage originating with a take-out food establishment. 6. It does not encourage marginal development within the neighborhood. In fact, the proposed store will be a benefit to the entire community. 7. The unique characteristics of the subject property (Le., location) justify granting LUP. XII. CONCLUSION Staff is recommending approval to rezone approximately 1.13± acres from Multiple Family Residential(M-29) and two family (D-1) district to Planned Unit District (P-1).
