SUBJECT: REVIEW OF COUNTY CODE REGULATIONS ON CARDROOMS (CHAPTER 52-3)
SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
Consider whether to direct Community Development Department, County
Counsel and the Sheriff's Office to review and make recommendations
on the provisions of the County Cardroom Ordinance (Chapter 52-3) .

BACKGROUND/REASONS FOR RECOMMENDATIONS
Staff has recently been contacted by parties interested in
modifying the provisions of the cardroom ordinance related to
residential requirements, number of players per table and removing
restrictions to specified games. Staff suggests reviewing the
revenue provisions as they related to any new cardrooms which may
be proposed in the next three years. In discussions with staff,
the Sheriff's Department representative indicated some concerns
related to operational issues. These can be addressed if the Board
directs staff to proceed with the review.
Under , the provisions of the State of California Business and
Professions Code Section 19819.5 (b) a moratorium on expanding
cardroom regulations will commence on January 1, 1996 and continue
for 3 years thereafter. Accordingly, any changes to the existing
cardroom ordinance which .the Board may consider must be adopted by
November 30, 1995 to be effective December 30, 1995. The City of
Pittsburg has recently amended its code (Chapter 5.24) in order to
position itself to consider cardroom proposals during the 3 year
moratorium. Areas of the ordinance which could be reviewed include
revenue generation, gaming restrictions and other related
provisions..

If the Board wishes to review or modify the provisions of the
cardroom ordinance, staff should be directed to conduct a review
and forward recommendations for change or alternatives, if any, to
the Board for consideration by November 7, 1995.
Since the issues related to cardrooms include land use, legal
issues and enforcement such a review could include the Community
Development Department, County Counsel the Sheriff's Office.
