WESTMAN, COUNTY COUNSEL DATE: October , 1995 SUBJECT: Local Rule H for the Assessment Appeals Board SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS: Adopt the Assessment Appeals Board' s proposal that its attached Local Rule H "Time for Hearing and Presentation of Stipulations " become applicable to Assessment Appeals Board proceedings . BACKGROUND/REASONS FOR RECOMMENDATIONS : The Assessment Appeals Board has approved Local Rule H. For the convenience of the Assessment Appeals Board, County Counsel has filed this proposed rule with the Board of Supervisors for its consideration and possible adoption pursuant to Ordinance Code section 26-10 . 404 (b) . The rule is intended to ensure that decisions on applications for reduction in property tax assessments are made within two years of the date that an application is filed as required by Revenue and Taxation Code section 1604 (c ) . Time for Hearings and Presentation of Stipulations Except in cases where there is controlling litigation pending or where the Assessment Appeals Board and the applicant mutually agree in writing or on the record to extend the time to hear the appeal pursuant to Revenue and Taxation Code section 1604 (c ) and Property Tax Rule 30 (c) , the clerk shall schedule each application for a hearing to occur no later than twenty-two ( 22 ) months after the date on which the application was filed. Any request to continue a hearing to a date more than twenty-two ( 22 ) months after the filing date shall be granted only for good cause with the approval of the Board. Any stipulation regarding resolution of an application shall be presented to the Board prior to the day of the scheduled hearing. We sent copies of the proposed Board order and Local Rule to the Assessor. He should be advised of the date on which this matter will appear on the Board's agenda.
