STATUS REPORT ONTHE ABILITY OF THE COUNTY TO TRACK THE
RACE AND GFNDFR OF INDEPENDENT CONTRACTORS
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
1. ACCEPT the attached report from the Director of Human Resources regarding the
status of the County's ability to track the race and gender of independent
contractors.
2. DIRECT the Director of Human Resources to provide an additional status report to
the 1996 Internal Operations Committee in February, 1996 on the extent to which
the records are complete in terms of identifying the race and gender of independent
contractors and for this purpose refer this subject to the 1996 Internal Operations
Committee.
3. REMOVE this subject as a referral to the 1995 Internal Operations Committee.
BACKGROUND:
On July 25, 1995, the Board of Supervisors approved a report from our Committee on this
subject which included the following recommendations, among others:

report, if possible, so that all budget units for a single
department are shown in sequence, rather than alphabetically, as
is now the case.

4. DIRECT the Director of Human Resources to provide a further
status report to our Committee in three months.
On October 16, 1995 our Committee met with Leslie Knight, Director of Human Resources
and Lloyd Madden, Personnel Services Supervisor. Ms. Knight reviewed the attached
report with our Committee and particularly outlined the efforts which have been made to
encourage department heads to submit complete information on the race and gender of
independent contractors. We would like the Internal Operations Committee to review the
status and completeness of this report one more time before we relinquish oversight of the
report and for this purpose we are recommending that the report be referred to the 1996
Internal Operations Committee to receive an additional status report in February, 1996.
We are pleased with the remarkable progress which has been made in compiling this
information over the past year and making it available in an organized manner and want
to insure that it is complete and available as a source of information before we terminate
oversight of the report.

At the Internal Operations Committee meeting held on July 17, 1995 the Director of Human
Resources was committed to the following:
1. Encourage all department heads to review the report and submit all missing data as
quickly as possible so that the report is complete and accurate as possible. ��~
* At the department heads meeting held on July 27, 1995 the Director of Human
Resources presented a status report on the Independent Contractors - Subject To
Withholding monitoring project and requested their assistance and cooperation in
submitting complete and accurate information.
* Director of Human Resources and the Affirmative.Action Officer, drafted a
memorandum (attached) to department heads clarifying their authority to visually
identify employees by race and ethnicity.
* Director of Human Resources presented a status on Independent Contractors - Subject
To Withholding monitoring project at the Policy Advisory Committee (PAC) meeting
held on September 6, 1995, encouraged them to read the report, and submit comments
or additional information that would contribute to the completeness and accuracy of
the report.
* Human Resources staff reviewed the subject report in detail with the Departmental
Affirmative Action Coordinators at the quarterly meeting held on September 20, 1995.
Staff also reviewed report with the Departmental Personnel Services and Administrative
Services Officers at their quarterly meeting held on September 27, 1995.

request of the Internal Operations Committee.
- All budget units are now reported under a single department and in sequence.
- Budget unit Subtotals and Group/Grandtotals are also provided.
3. Provide a status report to the Committee in three months.
- Attached you will find Independent Contractors - Subject To Withholding Status
Report as of September 30, 1995.

SUBJECT: Visual Identification of Temporary Employees and Contractors
Subject to Withholding
Based on concerns raised at our last Department Head meeting, we further researched the
authority which requires the visual identification of ethnicity for temporary employees and
contractors subject to withholding who have not self-identified.
Public Law 85-352, Title VII of the Civil Rights Act of 1964, as amended by the Equal
Employment Opportunity Act of 1972, as applicable to the County of Contra Costa(EEO-4) states
that:
2. RACE/ETHNIC IDENTIFICATION
An employer may acquire the race/ethnic information necessary for this section
either by visual surveys of the work force, or from post-employment records as
to the identity of employees. Since visual surveys are permitted, and the fact
that race/ethnic identifications are not present on agency records is not an
excuse for failure to provide the data called for.
