Acknowledge receipt of Monthly Report No. 5, dated August, prepared by Davillier-Sloan, Inc. , on Contract Compliance Services. BACKGROUND The contract for construction management with O'Brien-Krietzberg & Associates for the Merrithew Memorial Hospital Replacement Project requires a monthly status report to be filed with the Project Director in the Office of the County Administrator. In addition, the monthly report, prepared by the consultant, Davillier-Sloan, Inc. , on the contractors ' compliance with the MBE/WBE and affirmative action contract requirements, is attached. A copy of the monthly report is provided to the Clerk of the Board and the Board of Supervisors for information purposes . O'Brien-Kreitzberg EXECUTIVE REPORT Project Status : Progress continued in September with foundation and retaining wall work, which involved the placement of nearly 3,000 yards of concrete. Other activities included the continuation of waterproofing and rebar installation; anchor bolts for the structural steel and sleeves for the mechanical, electrical, and plumbing utilities. Structural steel fabrication has begun at the steel mill. Formwork for the structural walls also began this report period and concrete for the first of two "lifts" was placed. The equipment planning consultant, FDI, is continuing its efforts towards matching the existing inventory against user requirements and refining the equipment budget. Meeting are to be held the first week in October with user groups to confirm their requirements. Proposals for a telecommunications consultant are due October 6th and interviews are scheduled for October 24th. Once a firm has been selected and contract negotiations are complete, preparation of the telecommunications specification will begin. Budget: The total project budget is $81,841,000. As of the end of September, approximately $4.5 million of construction has been completed on the current contract with Centex Golden. Schedule: The overall program schedule has been simplified into a 1 page bar chart (see following page) which reflects a hospital construction completion date of July 31, 1997. While it is understood that subcontractors have the life of their contract to meet the goals of 25.7% minority and 6.9% female employment participation, please note the following highlights on a week by week basis: Week#1: Laborers exceeded minority participation(50%)but had no female participation Week#2: Laborers exceeded minority participation(55.2%)but had no female participation; Operating Engineers had no minority or female participation • • 6 • Week#3: Laborers exceeded minority participation (73.2%), but had no female participation; Operating Engineers had no minority or female participation • Week#4: Laborers and Iron Workers exceeded minority participation (62% and 50% respectively) but had no female participation; Operating Engineers had no minority or female participation CGCC will be reminded to utilize the unions' namecall request for laborers and operating engineers. They will also be notified to follow-through on the specific • affirmative action steps outlined'in Division E to help increase minority and female employment among all listed trades. DSI will begin to formally notice CGCC when trades and subcontractors appear to be in danger of being in non-compliance. The absence of women is an important issue that needs to be addressed. • C. New Activities/Accomplishments This Period: 1. Developed a questionnaire for Site Visit Verifications for workforce goals. 2. Began receiving certified weekly payrolls from Centex Golden Construction Company's (CGCC) subcontractors. 3. Began receiving walk-in referral logs from CGCC. These logs are completed when a person comes to the jobsite seeking work. • 4. CGCC forwarded executed Project Labor Agreements for Washington Iron Works, Surveyor's Group, Schnabel Foundation Co., Joe Carone, Inc., The Herrick Corporation, Mid-State Steel, Intelligent Technologies, R&R Maher, Architectural Glass, The'Ellis Company and AMSCO. Copies are on file at DSI and are available upon request. • 5. Attended CGCC's discussion on Discrimination and Sexual Harassment during the end-of-the-month tailgate/safety meeting. 6. Received projections of subcontractor and trades to work on the project • from August 1995 to February 1996. D. Piro*ected Activities for the Neat Reporting Period: 1. Confirm how Trucker Owner/Operators will be counted. The choice is between counting as businesses or workers. • * Z. The parties further agree that the provisions of this Agreement shall apply to the construction of the new hospital at 2500 Alhambra Avenue, Martinez, California, for Merrithew Memorial Hospital identified and described in a construction contract entered into by and between the Contractor and the Board of Supervisors of Contra Costa County, California dated February 7, 1995 including any additions and modifications thereto(hereinafter referred to as"Project"). e ARTICLE 1 * PURPOSE 1.1 The purpose of this Agreement is to promote efficiency of construction operations on the Project and provide for peaceful, efficient and binding settlement of labor disputes. In so doing, the parties to this Agreement establish the foundation to promote the public interest, provide a safe work place, assure high quality construction, and secure optimum productivity, on-schedule performance and Owner satisfaction. 1.2 It is the intent of the parties to set out uniform and fair working conditions for the efficient completion of the Project, maintain harmonious labor/management relations and eliminate strikes, lockouts and other delays. 1.3 Contactor agrees that neither the Contractor nor any of its Subcontractor(s)will subcontract any work to be done on the Project except to a person, firm or corporation who is or becomes party to this Agreement. Any Contractor or Subcontractor(s)working on the Project shall, as a condition to working on the Project, become signatory to and perform all work under the terns of this Agreement. The furnishing of materials,-supplies, or equipment and the delivery thereof shall in no case be considered subcontracting. _ 1.4 The Unions assure Contractor that there will be a sufficient number of qualified craftsmen available to perform the work. Should a shortage of qualified manpower occur, or in the event referral facilities maintained by the Union(s) are unable to fill the requisition of Contractor or Subcontractor(s)for employees within a forty-eight(48) hour period atter such requisition is made by the Contractor(Saturday, Sunday, and holidays excepted), the Contractor-or Subcontractor(s)shall be free to obtain c raftspersons from any source. These c a#tspersons shall be recognized as temporary employees. These temporary employees shall be replaced by qualified journeymen when available. 1 • Attachment H 1.5 The Union recognizes that-Contractor is required by contract to meet certain goals established by the Owner regarding employment of minorities and women, and to this end the Union covenants and agrees to cooperate fully with Contractor and to take such * affirmative action as may be necessary to assist Contractor in meeting these goals. The Owner has adopted affirmative action and equal employment opportunity goals for project work force composition of 25.7% minority and 6.9% women. 0 ARTICLE 2 SCOPE OF AGREEMENT 2.1 This Agreement shall apply only to that new construction work awarded to and 0 performed by the Contractor during the tern of this Agreementat the project site. The Scope of the Agreement includes all new construction on the Project. 2.2 This Agreement shall apply only to construction/craft employees represented by the Unions signatory hereto, and shall not apply to Contractor or Subcontractor(s) supervisors, * technical, or non-manual employees, including, but not limited to; executives, engineers, office and clerical employees, drafters, supervisors, timekeepers, messengers, guards, inspectors, or any other employees above the classification of general foreman. 2.3 There shall be no limitation or restriction upon the choice of materials or upon the full use and installation of equipment; machinery; package units; factory pre-cast, prefabricated, or preassembled materials; tools; or other labor-saving devices. Fabrication provisions of the appropriate national or local agreements shall be applicable. 2.4 After installation is completed by the Contractor or Subcontractor(s), it is understood that Owner, Contractor and Subcontractor(s) reserve the right to perform start-up, operation, repair, maintenance, or revision of equipment or systems with persons of the Owner's, Contractor and Subcontractor(s) choice. If required,the service representative may make a final check to protect the terms of a manufacturer's guarantee or warranty prior to start-up of a piece of equipment. it 2.5 It is further recognized that the signatory Subcontractor(s) are acting only on behalf of said Contractor, and said Contractor and Subcontractor(s) have no authority, either expressed, implied, actual, apparent, or ostensible, to speak for or bind the Owner. 2.6 It is expressly agreed to and understood by the Parties hereto that the Owner j shall retain the right at all times to perform and/or subcontract any portions of the construction and related work on the Project not contracted to the signatory Contractor. 2.7 It is expressly agreed to and understood by the Parties hereto that the Owner, Contractor and Subcontractor(s) shall have the right to purchase material and equipment from any source and the craftsmen will handle and install such material and equipment 2.8 This Agreement shall not apply to any work performed on or near, or leading to or into the Project site by state, county, city or other governmental bodies, or their contractor(s); 2 * An=tunent H or by utilities or their contractor(s); and/or by the Owner or its contractor(s) for work which is not part of the Project nor the fabrication or manufacture of any component, equipment or materials offsite, for use or installation at the project site. ARTICLE 3 APPLICATION OF APPENDIX,A il► 3.1 Appendix A refers to the current Local and District Councils Collective Bargaining Agreements and any amendments to such agreements negotiated by Contractors, Subcontractors and/or Contractor Associations with Local Unions and District Councils having jurisdiction over the work to be performed. r 3.2 It is further agreed that Appendix A refers to the Boilermakers Western States Storage Tank Erection and Repair Agreement and the United Association's California Shortline (Pipeline)Agreement. 3.3 All Contractors performing work within the Scope of this Agreement shall be signatory to the applicable Appendix A Collective Bargaining Agreement(s) and this Agreement. 3.4 Such Local Area Agreements indicated herein as Appendix A are adopted and incorporated by reference as though set forth herein verbatim. 3.5 All work within the Scope of this Agreement shall be performed pursuant to the provisions of this Agreement ('including Appendix A). 3.6 If there is any conflict between any current Local Area Agreement incorporated herein as Appendix A and this Agreement, then the provisions of this Agreement shall control. N ARTICLE 4 CONTRACTOR 4.1 The Contractor has been engaged by the Owner, and is responsible for the administration and application of this Agreement for and on behalf of all Subcontractors. 4.2 The Contractor shall endeavor to facilitate harmonious relations between the Subcontractors and Unions signatory hereto and will schedule a Pre-Job Conference and/or Mark-Up Meeting upon request of any Union(s) or Subcontractor(s). 3 * Attachment H ARTICLE 5 RELATIONSHIP BE'T'WEEN PARTIE 5.1 This Agreement shall only be binding on the signatory Parties hereto, and shall not apply to parents, affiliates, subsidiaries, or other divisions of a signatory company unless signed by such parent, affiliate, subsidiary, or other division of such company. 5.2 Contractor shall alone be liable and responsible for its own individual acts and conduct and for any breach or alleged breach of this Agreement. Any alleged breach of this Agreement by Subcontractor(s) or any dispute between the signatory Union(s) and the Subcontractor(s) respecting compliance with the terms of this Agreement, shall not affect the rights, liabilities, obligations, and duties between the signatory Union(s) and Contractor and Subcontractor(s) party to this Agreement. 5.3 It is mutually agreed by the Parties that any liability by a signatory Union(s) to this Agreement shall be several and not joint. Any alleged breach of this Agreement by a signatory Union(s) shall not affect the rights, liabilities, obligations, and duties between the N signatory Contractor and Subcontractor(s) and other Union(s) party to this Agreement. 5.4 The Council and/or its affiliates are the exclusive bargaining agent(s) for all workers on the job so that the Contractor (mows who to deal with regarding any labor matters that may arise during the course of construction. Welcome and Introductions Self introductions of all attendees. 2. MBE gnd WBE Participation Status Official start date of the project was July 3, 1995. The project goals are 14% MBE and 6% WBE. The current status of the project is 4.49% MBE and 1.70% WBE participation (see attachment A). 3. Project Change Orders In August two change orders were executed by the County; both totaled approximately $5,000 with no subcontractor involvement. The change orders only involve Centex Golden. 4. AA/EEO Status 0 Project hiring goals are 25.7% MBE and 6.9% WBE. According to the July Workforce Utilization Reports there was 36% MBE and 22% WBE participation. 5. Certified Payroll Reports 0 All subcontractors were commended for turning in their Certified Payroll Reports for the month of July.= They were encouraged to continue turning in their reports in a timely manner. 6. Workforce Utilization Reports Subcontractors were asked to continue submitting their Workforce Utilization Reports on a monthly basis. They were also commended for turning in their reports in a timely manner. Jake Sloan of Davillier-Sloan, question where the minority or female owner/operators for trucking were being reported in the MBE/WBE Participation or in the AA/EEO hiring goals. Centex Golden did not have an answer immediately, but will check and advise Mr. Sloan. Attachment L 7.
