SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
AUTHORIZE the Deputy Director - Redevelopment to enter into a First Amendment to Legal
Services contract by and among the Agency; Dan Helix, et al.; and Jaffe Trutanich Scatena
& Blum.
FISCAL IMPACT
No General Funds are involved. The Amended Agreement provides for the Agency to pay up
to $50,000 of the hazardous materials investigation, and to be reimbursed at the conclusion
of the litigation.
BACKGROUND/REASONS FOR RECOMMENDATIONS
In 1989 the Redevelopment Agency purchased a portion of the Hookston Station property
from a partnership consisting of Dan Helix, Sam Young, John Hook, and others. The property
was subsequently found to be contaminated. The Purchase Agreement provided for

indemnification to the County for the remediation work. The contamination is believed to
have been placed on the property during its ownership by Southern Pacific. The Agency
and the Helix interests jointly,,retained counsel to pursue Southern Pacific for necessary
cleanup.
This First Amendment provides for the Agency to pay up to $50,000 of additional studies
necessary to characterize the remediation responsibilities and to prepare an
implementation plan. The Agency would expect to be reimbursed from proceeds of the
final settlement or judgment.
