MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: October 17, 1995 SUBJECT: Approve and Authorize the Chair to Execute Program Supplement No. 95 Rev 1 for the Emergency Restoration of Alhambra Valley Road Project No.: 0672-6R6529 SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION I. Recommended Action: APPROVE and AUTHORIZE the Chair of the Board of Supervisors to execute Program Supplement No. 95 Rev 1 which provides $128,369 in Federal Transportation Improvement Funds for the emergency restoration of Alhambra Valley Road just west of Castro Ranch Road. II. Financial Impact: The supplement provides Federal reimbursement for 88.53% of the County's costs for this project. Local funds will provide the remaining 11.47% of funding for this project. III. Reasons for Recommendations and Background: On June 21, 1977 the Board approved County/State Master Agreement No. 04-5928 for the funding of Federal Aid Projects. Due to the damage from storms in January 1993, Contra Costa County was eligible for Federal Highway Administration disaster relief funds. On August 27, 1993, Contra Costa County qualified for Federal funds to pay for the work specified. IV. Consequences of Negative Action: If this program supplement is not approved the County will have to absorb the entire cost of the preliminary engineering, construction engineering, and construction of this project. Number: 04-927352 FOR FEDERAL-AID PROJECTS NO. ,04-5928 This Program Supplement is hereby incorporated into the Local Agency-State Agreement for Federal Aid which was entered into between the Local Agency and the State on 06/21/77 and is subject to all the terms and conditions thereof. This Revised Program Supplement supersedes Program Supplement approved by the Local Agency' s Governing Body on 02/16/94 2 . The effective date of this agreement is 01/05/93 3 . All maintenance, involving the physical condition and the operation of the improvements, referred to in Article VI MAINTENANCE of the aforementioned Master Agreement will be performed by the Local Agency at regular intervals or as required for efficient operation of the completed improvements. 4 . The Local Agency. agrees the payment of Federal funds .will be limited to the amounts approved by the Federal Highway Administration in the Federal-Aid Project Agreement (PR-2) /Detail Estimate or its modification (PR-2A) or the FNM-76, and accepts , any increases in Exchange Funds, State Matching funds, and\or Local Agency Funds as shown on the Finance or Bid Letter or its modification as prepared by the Office of Local Programs. 5. All emergency relief work reimbursed at 100% must be completed within 180 days following the storm period from January 5, 1993 thru March 20, 1993 . Local Agency records must clearly identify those costs incurred before and after January 5, 1993 . Incurred costs are defined as disbursements made or in process for goods and services delivered. Emergency relief work completed after September 16, 1993 will be funded at the federal aid reimbursement ratio of 88 . 53%. The Local Agency will be responsible for the matching requirement. 6. The Local Agency will advertise, award and administer this project in accordance with the current Local Program Procedures or the new Local Programs Manual, when issued. 7 . In executing this Program Supplemental Agreement, Local Agency hereby reaffirms the "Nondiscrimination Assurances" contained in the aforementioned Master Agreement for Federal-Aid Program. 8 . Whenever the local agency uses a consultant on a cost plus basis, the local agency is required to submit a post audit report cover- ing the allowability of cost payments for each individual consul- tant or sub-contractor incurring over $25, 000 on the project. The audit report must state the applicable cost principles utili- zed by the auditor in determining allowable costs as referenced in CFR 49 , part 18 , Subpart C - 22 , Allowable Costs. Page 2 of 2
