MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: October 17, 1995 SUBJECT: Approve and Authorize the Chair to Execute Program Supplement No. 105 for the Byron Highway Bridge Deck Rehabilitation Project Project No.: 0662-6R4239-94, CDD-CP #94-58 SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION I. Recommended Action: APPROVE and AUTHORIZE the Chair of the Board of Supervisors to execute Program Supplement No. 105 which provides $381,120 in Highway Bridge Replacement and Rehabilitation (HBRR) Funds for the rehabilitation of the Byron Highway Bridge deck at the California Aqueduct. II. Financial Impact: The supplement provides Federal reimbursement for 80% of the County's costs for this project. The State of California Department of Water Resources will provide 16% of the County's costs for this project. Road funds will provide the remaining 4% of project funding. III. Reasons for Recommendations and Background: On June 21, 1977 the Board approved County/State Master Agreement No. 04-5928 for the funding of Federal Aid Projects. On August 23, 1994, Contra Costa County qualified for Federal funds to pay for the work specified. The Board reviewed and approved the project on November 8, 1994 and determined the project to be exempt from the California Environmental Quality Act as a Class 1 c Categorical Exemption. A Notice of Exemption was filed with the County Clerk on November 10, 1994. IV. All maintenance, involving the physical condition and the operation of the improvements, referred to in Article VI MAINTENANCE of the aforementioned Master Agreement will be performed by the Local Agency at regular intervals or as required for efficient operation of the completed improvements. 2 . The Local Agency agrees the payment of Federal funds will be limited to the amounts approved by the Federal Highway Administration in the Federal-Aid Project Agreement (PR-2) /Detail Estimate or its modification (PR-2A) or the FNM-76, and accepts any increases in Exchange .Funds, State Matching funds, and\or Local Agency Funds as shown on the Finance or Bid Letter or its modification as prepared by the Office of Local Programs. 3 . In executing this Program Supplemental Agreement, Local Agency hereby reaffirms the "Nondiscrimination Assurances" contained in the aforementioned Master Agreement for Federal-Aid Program. 4 . Whenever the local agency uses a consultant on a cost plus basis, the local agency is required to submit a post audit report cover- ing the allowability of cost payments for each individual consul- tant or sub-contractor incurring over $25, 000 on the project. The audit report must state the applicable cost principles utili- zed by the auditor in determining allowable costs as referenced in CFR 49, part 18, Subpart C - 22 , Allowable Costs. Page 2. of 2
