HomeMy WebLinkAboutMINUTES - 10031995 - SD13 •ro: BOARD OF SUPERVISORS FROM: Jim Rogers, District 1 Supervisor DATE: October 3, 1995 SUB LCT: ESTABLISHING DRUG-FREE ZONES FOR PUBLIC PARKS IN CONTRA COSTA COUNTY SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS Introduce, waive reading, and set Noveraber 71995, for adoption of the attached ordinance, which would establish drug-free zones-for each public park in the unincorporated area of Contra Costa County in order to provide for enhanced penalties for those who are convicted of specified controlled substance offenses on such parks. BACKGROUND: The Board of Supervisors previously resolved to designate a "drug-free zone" around each public and private school in the unincorporated area of the County so that the Contra Costa County District Attorney and United States Attorney General would be encouraged to seek the enhanced penalties which are provided under state and federal law for certain specified controlled substance offenses when they occur on or within 1000 feet of such a school. The attached ordinance expands the existing resolution by designating public parks, in the unincorporated area of the County as "drug-free zones" and requiring their posting as such so that enhanced penalties can be sought by the District Attorney for specified controlled substances offenses on such parks. SECTION I_ SUMMARY. -This ordinance adds Article 1110-2.7,section 1110-2:702.to the County Ordinance Code designating "drug-free zones" in all parks in the unincorporated area of Contra Costa County and requiring their posting as such zones. SECTION II. Article 1110-2.7 section.1110-2.702 is added to the County Ordinance Code to read: Article 1110-2.7 Drug Free Zones Section 111.0-2.702. Drug Free Zones. All public parks in the unincorporated area of Contra Costa County.are. designated as "drug-free zones" pursuant to Health and Safety Code section 11380.5(e)(1.) and shall be posted pursuant to Health and Safety Code section 11380.5(e)(2). (Ord. 95- §2.) SECTION III. Effective Date. .This ordinance becomes effective 30 days after passage, and within 15 days after passage shall be published once with the names of supervisors voting for and against it in the , a newspaper published in this County.
