Adopted this Order on _October 3, 1995,_ by the following vote:

SUBJECT: Exoneration of Subdivision Agreement, MS 63-82, Danville Area
The Board considered the recommendation of the Public Works Director to
exeronerate the substitute Subdivision Agreement approved by the Board on July
11, 1989, pursuant to modified Condition of Approval 6.H for MS 63-82 that
would allow for the developers to contribute $14,000 to the County Drainage
Deficiency Trust (Fund No. 812100-0800) in lieu of constructing drainage
improvements as the developer was originally conditioned to do.
The following persons spoke on this matter:

Norman Hueckel, 5900 Old School Road, Pleasanton;
Richard Doran, 5900 Old School Road, Pleasanton;
Robert Zupetz, 5525 Old School Road, Pleasanton;
Darrow Crowe, 232 Joseph Lane, Pleasanton;
Norman Hale, 5901 Old School Road, Pleasanton; and
Paul Speroni, 245 Joseph Lane, Pleasanton.
All persons desiring to speak were heard. Board members commented on
the need for further review of the drainage issue and the liability associated
with the construction of drainage improvements. .
Therefore, IT IS BY THE BOARD ORDERED that decision on the recommen-
dation of the Public Works Director is DEFERRED to October 24, 1995, with the
Public Works Director instructed to review the drainage issue for report on
that date.
IT IS FURTHER ORDERED that County Counsel is DIRECTED to review the
legal issues relative to the responsibility of the subdivider for the
construction of drainage improvements.

Exoneration of Subdivision Agreement, Subdivision MS 63-82, Danville Area
The Public Works Director having notified this Board that the improvements in Subdivision
MS 63-82 have been provided for pursuant to modified Condition of Approval 6.H. Modified
condition of approval 6.H of MS 63-82, as recommended by the Public Works Director and
approved by Harvey E. Bragdon (referenced in his June 14, 1995 letter to Mark Pringle), County
Zoning Administrator, allowed for the developers to contribute $14,000 to the County Drainage
Deficiency Trust (Fund No. 812100-0800) in lieu of constructing drainage improvements, as he
was ordinally conditioned to do.
NOW THEREFORE BE IT RESOLVED that the substitute Subdivision Agreement
approved by the Board on July 11, 1989, with Mark Pringle, subdivider, is hereby exonerated
pursuant to modified condition of approval 6.H and the receipt of$14,000 Drainage Deficiency
Trust cash contribution (Auditor's Deposit.Permit No. 265780, dated August 22, 1995) made by
the developers.
BE IT FURTHER RESOLVED that the Public Works Director is AUTHORIZED to
relinquish letter of credit #93-225, dated February 10, 1989 to Burlingame Bank and Trust.
BE IT FURTHER RESOLVED that the Public Works Director is AUTHORIZED to
refund the cash deposit (Auditor's Permit No.158684 dated June 28, 1989, in the amount of
$1000), plus interest in accordance with Government Code Section 53079, if appropriate to The
Simba Group.
