On May 2, 1989, the Board authorized the Public Works Director to execute a Deferred Improvement Agreement with Northern California Development Company for the Oakley Road/Empire Avenue signal improvements as required by the conditions of approval for Subdivision 7045. The aforesaid Deferred Improvement Agreement was recorded on May 11, 1995 in Volume 15060 of Official Records at page 428 and became an encumbrance against Assessor's Parcel No.(s) 035-011-022, 025, 026, 029. The Public Works Director now informs this Board that the requirements outlined in said agreement have been satisfied as of October 3, 1995. The Board hereby FINDS that the conditions of the above-mentioned Deferred Improvement Agreement are satisfied. NOW THEREFORE BE IT RESOLVED that the aforesaid Deferred Improvement Agreement is EXONERATED.
