Accept 1st Choice Transfer of Funds for Health Fair Activities

RECOMMENDATION
Authorize the Director of Personnel to execute the attached agreement between Contra Costa County and the
Contra Costa County 1st Choice Employee Benefits Trust relative to the transfer and use of remaining Trust
assets to fund Health Fair activities for former 1st Choice Health Plan members.
Accept the transfer of funds by the Trust to the County and authorize the Auditor-Controller to establish and
place these funds in an interest-bearing account.
BACKGROUND
• The Contra Costa County 1st Choice Employee Benefits Trust is being terminated. In preparation for
this termination, the Joint Board of Trustees has determined that the appropriate expenditure of the
Trust's. remaining assets would be to fund Health Fair activities for those individuals who were
participants in the 1st Choice Health Plan as of its termination on January 31, 1994.
• The Joint Board of Trustees has agreed to transfer to the County assets remaining as of November 30,
1994, which the Joint Board of Trustees believes will be approximately $35,000.
FINANCIAL IMPACT
The transfer of approximately $35,000 will provide additional funding to be used to offset annual Health Fair
costs until the year 2002.

AGREEMENT BETWEEN
THE CONTRA COSTA COUNTY IST CHOICE
EMPLOYEE BENEFITS TRUST AND
THE COUNTY OF CONTRA COSTA
WHEREAS, the Contra Costa County 1st Choice Employee
Benefits Trust is in the process of winding down its activities
in preparation for termination;
WHEREAS, in the course of the winding down its activities,
it has come to the attention of the Joint Board of Trustees that
there may continue to be some amount of Trust assets in existence
after satisfaction of all of the Trust's liabilities;
WHEREAS, the trust agreement of the Trust at Article VIII,
Section C requires the Trustees to continue to provide benefits
for so long as Trust assets permit;
WHEREAS, the Joint Board of Trustees has determined that the
appropriate expenditure of the Trust's remaining assets would be
to fund Health Fair activities for those individuals who were
participants in the 1st Choice Health Plan as of its termination
on January 31, 1994;
ACCORDINGLY, the Contra Costa County 1st Choice Employee
Benefits Trust and the County of Contra Costa agree as follows:
1. The Trust hereby agrees to transfer to the County on or
before January 31, 1995 such assets as remain to it as of
November 30, 1994, which the Joint Board of Trustees believes
will be in the amount of approximately $35,000.
2. The County agrees to expend the funds distributed to it
by the Trust for Health Fair benefits for individuals who were
1st Choice members as of January 31, 1994.
3. The parties agree that the funds to be used for former
1st Choice Plan members will be expended for Health Fair
activities, including, but not limited to, the following:
a. Health assessments, such as blood pressure,
cholesterol, body composition assessments; fitness
assessments, including cardiovascular step tests,
strength/flexibility/endurance tests; computerized
health profiles; skin cancer/glaucoma screenings;
nutritional/dietary analysis; massage therapy;
back care education/posture screenings;
podiatrist/foot evaluations; hearing screenings;

b. Professional/staff services, including temporary
services;
C. Health Fair services and supplies, including, but
not limited to, marketing/promotional materials,
such as flyers, brochures, posters, printing and
mailing costs, declarations; rental of facilities
to conduct Health Fairs; rental of Health Fair
equipment, such as canopies, tents, tables,
chairs, generators, extension cords; incentive and.
other prizes; educational and informational
brochures and pamphlets and miscellaneous
supplies.
4. Subject to paragraph 9 hereof, the County agrees to
provide until the year 2002 an annual Health Fair at more than a
single site.
5. It is agreed that each Health Fair site may include any
combination of the above examples of Health Fair activities. All
costs associated with these activities may be subsidized by the
County as to non-1st Choice Health Fair participants but will be
paid partially or in full for former 1st Choice Health Plan
members.
6. The parties agree that the funds shall be expended over
a period not to exceed January 31, 2002 .
7. It is agreed that the funds transferred by the Trust
will be placed in an interest-bearing fund established by the
Auditor-Controller. The County personnel department will submit
invoices to the Auditor-Controller for final approval and payment
from this fund. Invoices will be approved for payment only if
they are permissible under this agreement. The Auditor-
Controller will be responsible for reviewing that all charges
from the funds transferred by the Trust are appropriate. The
Auditor-Controller will be responsible for authorizing the use of
monies from the fund to pay for eligible Health Fair expenses.
The Auditor-Controller will also be responsible for all
overseeing and auditing of the fund as necessary.
8. The Trust will provide the County with a list of former
1st Choice Plan members, i.e. , those individuals who were
participating in the 1st Choice Health Plan as of the date of its
termination on January 31, 1994 .
9. In the event the County is unable to comply with its
obligations under this agreement, the sole and exclusive remedy
will be that the County will distribute any unexpended funds to
former 1st Choice Plan members for benefits.
