A copy was furnished to Daniel Guerra, Les Littman and Dennis Graves. Trident Environmental and Engineering would like to express its concern that a conflict of interest exists. The conflict arises with Golder Associates very actively working as a consultant for BFI, directly working with Keller Canyon Contractors, and doing the review work for Contra Costa County. We sent the attached letter on December 6, and have not been informed about what action was taken on this issue. We would appreciate hearing from you concerning this matter. We have been informed that Golder Associates won the bid. They are a very capable technical company. However, I would like to point out that a conflict of interest exists with Golder Associates doing the review work for Contra Costa County. Golder Associates would be reviewing BFI Keller Canyon reports. However BFI is one of Golder's large clients. Golder Associates is very actively working as a consultant for BFI in numerous areas around the United States including: 1. City of Missoula, Montana (BFI representative Jim Leiter, Landfill Manager) 2. Foot Hills Landfill, Denver (BFI representative Rick Kinshella, Assistant District Manager) 3. Canadian Valley, Oklahoma (BFI representative Janet Liner, Compliance Officer) They also have worked on BFI projects in California and are currently in contact with Mr. Curt Stovall the BFI Division Landfill Manager in San Jose who supervises Keller Canyon activities. All BFI landfill operations are connected. Many facets of the Keller Canyon Landfill operations are run from BFI's Houston headquarters. The same is true for the above referenced BFI landfills Golder is currently working on. Working for out of state BFI landfills is thus connected to Keller Canyon since all these sites are run through BFI Houston headquarters. Most importantly, Golder's bills, as well as Keller Canyon contractor's bills, are both paid by BFI Houston. . L4 3 Mr. Powers December 29, 1994 Page 2 Therefore, it would be a blatant conflict of interest for them to review work at the Keller Canyon Landfill since BFI is a large client of their firm. The RFP stated that firms proposing on the contract should not be currently working for the owners of the landfills that they are reviewing. What I would suggest is that Golder Associates choose to either work for BFI or work for Contra Costa County LEA as this would eliminate the conflict of interest problem.
