SUBJECT: LEGISLATION: SB 36 (Killea) - REPEALING THE SUNSET ON THE $1
VEHICLE REGISTRATION SURCHARGE WHICH FUNDS THE VEHICLE THEFT
PREVENTION AND PROSECUTION PROGRAM
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Adopt a position in SUPPORT of SB 36 by Senator Lucy Killea, which
would repeal the January 1, 1996 sunset date on the collection of
the $1 vehicle registration fee surcharge, the proceeds of which
are used to fund the vehicle theft prevention and prosecution
program.
BACKGROUND:
Existing law allows a board of supervisors to impose a $1 surcharge
on the existing vehicle registration fee, with the proceeds to be
used to fund local vehicle theft prevention and prosecution
programs . The existing legislation includes a January 1, 1996
expiration date for this authority.
This County' s 1995 Legislative Program includes, on the
recommendation of the Sheriff- Coroner, the sponsorship of
legislation which would repeal this January 1, 1996 sunset date,
thereby allowing the program to continue indefinitely. CSAC has
sponsored SB 36 by Senator Killea, which would repeal this sunset
date. This bill also makes changes relating to the types of
programs which can be conducted by counties with a population under
200,000 . These provisions do not, of course, affect this County
and the Board of Supervisors should not take a position on these
other changes .
In view of the fact that the Board of Supervisors' has agreed to
sponsor legislation which would repeal this sunset date, it appears
to be appropriate to support SB 36 which accomplishes the Board' s
position on this issue.

An act to amend Section 9250.14 of the Vehicle Code,
relating to vehicles, and making an appropriation therefor.
LEGISLATIVE COUNSEL'S DIGEST
SB 36, as introduced, Killea. Vehicles: registration fees:
vehicle-theft crimes.
Existing law authorizes a county board of supervisors to
impose a $1 vehicle registration fee, to be paid to the
Department of Motor Vehicles at the time of registration or
renewal of registration of vehicles in the county. The proceeds
of that fee, after deducting the department's administrative
costs, are required to be paid to the Controller, and are
continuously appropriated to the Controller for
administrative costs and for allocation to the counties for
which the fee was collected, to be expended for eligible
programs, as specified, that enhance the capacity of local
police and prosecutors to deter, investigate, and prosecute
tE vehicle theft crimes. In a county with a population of 200,000
or less revenue from the fee may also be allocated for the
prosecution of,crimes involving driving under the influence
of alcohol or drugs or vehicular manslaughter, as specified, or
any combination of those crimes. .This law will terminate
January 1, 1996.
This bill would delete from existing law the special
expenditure authorization for counties with a population of
200,000 or less, and would delete the January 1, 1996,
termination date of that law.
