Doty, Catherine Garza, Renee Beniot, and David Garrard from the Administrative Decision of the Community Development Department Relative to Building Plan and Permits for 16 Beverly Court, Kensington. This is the time noticed by the Clerk of the Board for hearing on the Administrative Appeal of Robert P. Doty, Catherine Garza, Renee Beniot, and David Garrard from the administrative decision of the Community Development Department relative to building plan and permits for 16 Beverly Court, Kensington. Dennis Barry, Community Development Department, presented the staff report on the appeal, commenting on the Small Lot Ordinance and the staff recommendations. The following persons presented testimony: Robert Doty, 97 Ardmore Road, Kensington, appellant; Renee Benoit, 99 Ardmore Road, Kensington, appellant; Cathy Garza, 97 Ardmore Road, Kensington, appellant; Patricia Curtin, Gagen, McCoy, McMahon and Armstrong, representing Mr. and Mrs. Sabetimani; Ray Darrah, 85 Ardmore Road, Kensington; Linda Darrah, 85 Ardmore Road, Kensington; Janet K. Anderson, 17 Beverly Court, Kensington; Marie Roth., 34 Lenox Road, Kensington; Kenneth Davis, 200 Las Lomas Way, Walnut Creek; Timothy Albert, 5550 Alhambra Avenue, Martinez; Zia Sabetimani, 9 Beverly Court, Kensington. Mr. Doty spoke in rebuttal. The hearing; was closed. Following Board discussion of the matter, IT IS BY THE BOARD ORDERED that the decision on the above appeal is DEFERRED to March 7, 1995 at 10:45 a.m. in the Board chambers and County Counsel is REQUESTED to provide the Board with a legal opinion on the issue of jurisdiction in an appeal, and the parties are REQUESTED to meet with conflict resolution to reach an acceptable alternative to deal with impacts.
