Dear Supervisor Bishop:
The Hazardous Materials Commission would like to reiterate the concerns addressed in our
November 17, 1994 letter to the Board of Supervisors.
Land Use Ordinance 86-100 and its proposed revisions address new and expanded industrial
projects and their potential impact on adjacent land uses, including residences. However, the
ordinance does not address the reverse situation. The revisions to 86-100 encourage an industrial
business to consider the potential for accidental harm to nearby land zoned as residential.
Developers do not have to take that potential into account when planning residences near industrial
facilities, unless they are asked to do so in an Environmental Impact Report.
We ask that the Board of Supervisors consider the risk from hazardous materials releases in any
land use decision. State law requires that many industrial facilities in the county prepare a Risk
Management and Prevention Plan (RMPP). The RMPP could be used as a source of information
regarding the risk of hazardous material release.
There is a need for policy coordination regarding residential encroachment on industrial facilities.
We have received substantial comment on this issue from a variety of groups including industrial
associations, environmentalorganizations, members of the general public and the Public and

Environmental health Advisory Board (PEHAB). At least three commissions appointed by the
Board have some interest in this issue: our Commission, PEHAB, and the Planning Commission.
