SUBJECT: AMEND THE TOLLING REVIEW TIME FOR BAY CABLEVISION'S BASIC RATES
SPECIFIC REOUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
ISSUE order amending the tolling time for review of basic cable
television services and related equipment rates submitted by Bay
Cablevision for an addition of sixty ( 60) days for a total of one
hundred and fifty ( 150) days .
FINANCIAL IMPACT:
Costs will be between $2 ,000 and $4 ,000 because of the extensive
review required. Staff has contracted with Public Knowledge to
conduct the :review and will share costs with the Cities of Richmond
and Berkeley. Costs are currently reimbursed from the. Community
Access Trust Fund. However, pending final review of costs incurred
due to regulation during the last fiscal year, staff may need to
return to the Board with a request for additional funding.
BACKGROUND:
In December, 1992, the United States Congress passed the Cable
Television Consumer Protection and Competition Act of 1992 which
authorized local jurisdictions to regulate Cable Television rates
of the Basic Tier and associated equipment.
Due to revisions in the Federal Communications Commission' s (FCC)
rate regulations, cable operators were given until August 15, 1994
to revise rates and provide FCC Form 1200 or 1220 to the regulatory
authority. Bay Cablevision requested a delay in their submission
And agreed not to increase rates until such time as the FCC Form
was submitted. Bay Cablevision' s FCC Form 1220 was submitted on
November 21, 1994 ,

In order to conduct a thorough review of the rate submission,
additional time is needed and authorized by the FCC regulations in
Section 76 . 933, which states that the franchising authority may
toll the deadline for review by one hundred and fifty ( 150) days in
cases involving cost-of-service showings . Staff requested the
Board to toll the review period initially for ninety (90) days .
After further review, staff recognized that the full one hundred
and fifty ( 150) days authorized would be needed to complete the
review. Therefore, the Board is requested to toll the time for
review of Bay Cablevision's basic service rates for an additional
sixty ( 60) days for a total of one hundred and fifty ( 150) days .
