SUBJECT: Adjustment to Scenic Easement Area affecting the Blackhills Project
to Reflect Lot Line Adjustment (SUB 7115)
SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1 . Authorize the Chairman to execute a Quitclaim Deed of
Development Rights affecting Parcel M of Subdivision 7115 as
recorded on August 11, 1992 constituting 2 .4 acres upon the
receipt of the grant deed in Item #2 .
2 . Accept a new Grant Deed of Development Rights to the County
from Blackhills Developers for the area of a reconfigured
Parcel M constituting 2 . O acres .
3 . Direct the Clerk of the Board to simultaneously record the
aforementioned Quitclaim Deed and Grant Deed of Development
Rights .

None .
BACKGROUND/REASONS FOR RECOMMENDATIONS
In September 1990, the County approved the Blackhills project
located between the Blackhawk project and Mt . Diablo State Park at
the north end of Deer Meadow Drive (Final .Development Plan #3018-90
and Vesting Tentative Map 7115) . The project provides for a
clustered residential development . on a valley floor with the
hillside areas .to remain ' in open space .
The project is being developed in two phases . The first phase
subdivision has been recorded. In the processof rec rding the
map, the developer, the DeSilva Group, grant deeded evelopment
rights (so-called scenic easements) for the common o Isa
parcels to the County.

Lot Line Adjustment
In 1994, the Developer proposed a slight expansion of graded pads
on three of the lots (each approximately an acre in size) , and
corresponding adjustments to the lot lines of the parcels (County
File #LL 24-94, 25-94 & 26-94) . To expand the residential lots,
the Developer proposed an adjustment involving a net reduction in
area of one of the Common Open Space Parcels (Parcel M) by one-half
acre (to 2 . 02 acres) .
Staff reviewed the proposed grading and lot line adjustments and
found them consistent with the original project approval .
The Zoning Administrator approved the proposal after finding the
project would not result in any new potential environmental
impacts, and that the adjustment would constitute a nonsubstantial
change to the project .
DISCUSSION
The approved lot line adjustments were recorded and the lots
regraded. However, the adjustments did not alter the existing
scenic easement over the original area of Parcel M (2 .4 acres) .
The Developer who owns all the affected property has applied to
eliminate the residual scenic easement restrictions affecting the
three reconfigured residential lots, and has filed an application
to amend the Final Development Plan (File #DP 95-3001) for this
purpose .
Staff has determined that the proposed change would not
substantially alter the project; therefore, no public hearing has
been conducted.
To accomplish this change, staff is recommending that a quitclaim
be executed for the entirety of the original area of Parcel M (2 .4
acres) and that a new grant deed be executed for the reduced area
of Parcel M (2 . 02 acres) .

GRANT DEED OF DEVELOPMENT RIGHTS
To meet condition number 13 and 31.A.5 of Subdivision 7115, We, Blackhills
Developers, A General Partnership, (owners) hereby grant to the County of Contra Costa,
a governmental subdivision of the State of California, Grantee, and its governmental
successor or successors, the future "development rights"' as defined hereinbelow over a
portion of the real property described in Exhibits "A" and "E" attached hereto and made a
part hereof.
"Development Rights" are defined to mean and refer to the right to approve or disapprove
of any proposed construction,development or improvement within the areas marked
"restricted development area". The "development rights are and shall be a form of negative
easement which shall run with the said property and shall bind the current owner and any
future owners of all or any portion of said property. In the event of a disapproval of
postponed construction by the Grantee or its successor, said proposed construction shall
not be performed. Grantee or its successor may condition its approval of any proposed
construction upon prior subsequent performance of such conditions as Grantee may deem
appropriate.
Any owner or owners of all or any portion of said property desiring to develop any
improvement requiring the approval of grantee or its successor herein shall submit to such
entity a written proposal describing the nature,extent, and location of such improvement.
Grantee or his successor shall have sixty (60)days from receipt of such proposal in which
to grant its approval or disapproval. Failure by Grantee or its successor to respond in such
time period shall be equivalent to the approval of such proposal.
