District to access and make full use of computers and technology as well as to prepare students for the work-site of the 21st Century; and WHEREAS, the Board deems it necessary and advisable to submit a bond proposition to the electors which, if approved by two-thirds of the votes east, would permit the District to issue the bonds; and WHEREAS, it is desirable that the election to determine whether said bonds shall be issued and sold be consolidated with such other election or elections as may be held on the same day in the same territory or in territory that is in part the same; NOW, THEREFORE, be it resolved by the Governing Board of Education of the Acalanes Union High School District that the following order of election and specifications of the elections order is hereby adopted: 1. Pursuant to Education Code Sections 5304, 5322 and 15100 et seq, a special, election shall be held within the boundaries of the Acalanes Union High School District on June 6, 1995, submitting to the registered voters of the District the proposition as described in Exhibit A attached hereto. All of the purposes enumerated in the foregoing proposition shall be united and voted upon as one single proposition. Said bonds proposed to be issued and sold shall bear interest at a rate not exceeding the statutory maximum, payable at the time or times permitted by law, and the number of years the whole or any part of the bonds are to run shall not exceed 25 years, or the maximum term as may be permitted by law, from the date of the bonds or the date of any series thereof. RESOLUTION REQUESTING CONSOLIDATION WTIH OTHER ELECTIONS FOR THE WALNUT CREEK SCHOOL DISTRICT (1995 General Obligation Bonds) RESOLVED by the Board of Trustees (the "Board") of the Walnut Creek School District (the "District"), County of Contra Costa, State of California; WHEREAS, in the judgment of the Board, it is advisable to call an election to submit to the electors of the District the question whether bonds of the District shall be issued and sold for the purpose of raising money for certain capital school improvements; WHEREAS, pursuant to Resolution No. 94-07 adopted on January 23, 1995, this Board has heretofore ordered the Contra Costa County Superintendent of Schools to call an election on Tuesday, June 6, 1995, at which there shall be submitted to the electors of the District the following proposition: "Shall the Walnut Creek School District be authorized to finance the repair, renovation and upgrading of neighborhood elementary and intermediate schools, and district facilities, including safety upgrades, repair leaky roofs, upgrades to inadequate electrical, heating and plumbing systems, site improvements, construction of additional facilities, and the renovation of classrooms and libraries to prepare for technology, by issuing bonds in the maximum principal amount of$21,000,000 with an interest rate not to exceed the limit set by law?";and WHEREAS, it is desirable that the election to determine whether said bonds shall be issued and sold be consolidated with such other election or elections as may be held on the same day in the same territory or in territory that is in part the same; NOW, THEREFORE, BE IT RESOLVED as follows: 1. The Board of Supervisors of the County of Contra Costa is authorized to canvass the returns of the election pursuant to section 23306 of the California Elections Code. 3. Pursuant to section 22003 of the California Elections Code, the Board of Supervisors of the County of Contra Costa is requested to permit the County Clerk of the County of Contra Costa to render all services specified by section 23314 of the California Elections Code relating to the election, for which services the District agrees to reimburse the County of Contra Costa such services to include the publication of the Formal Notice (as defined in said Code) and a Tax Rate Statement containing the information required in section 5301 of the California Elections Code pursuant to the terms of section 23511 of the California Elections Code. Pursuant to Education Code Sections 5304, 5322 and 15100 et seq. a special election shall be held within the boundaries of the Martinez Unified School District on June 6, 1995, for the purpose of submitting to the registered voters of the District the following proposition: i r "Shall the Martinez Unified School District issue bonds in the amount of $23,000,000 to renovate Martinez Junior High School, modernize, construct, acquire or replace school facilities, improve school grounds, finance sewer and drainage projects for school property, and provide for long term capital improvements district-wide, which bonds shall bear interest at a rate not to exceed the legal limit, and shall mature no later than August 2014, the final maturity of the District's currently outstanding bonds?" All of the purposes enumerated in the foregoing proposition shall be united and voted upon as one single proposition. Said bonds proposed to be issued and sold shall bear interest at a rate per annum not exceeding the statutory maximum, payable at the time or times permitted by law, and the number of years the whole or any part of the bonds are to run shall not exceed 25 years from the date of the bonds or the date of any series thereof. Section 2. Pursuant to Section 15124 of the Education Code and Section 18 of Article XVI and Section 1 of Article XIIIIA of the Constitution of the State of California, the above proposition shall become effective only upon the affirmative vote of two-thirds of those electors voting on the measure. Section 3. The foregoing specifications of the Election Order are made pursuant to Education Code Section 5322, and the County Superintendent of Schools and the County Clerk of the County of Contra Costa(the "County") are hereby requested to take all steps to call and hold the election in accordance with law and these specifications. Section 4. Pursuant to Education Code Section 15121 and Part 3 (commencing with Section 10450) of Division 10 of the Elections Code, the County Superintendent of Schools and the Board of Supervisors of the County are requested to order consolidation of said school bond election with such other elections as may be held on the same day in the same territory or in territory that is in part the same. Section 5. The Board of Supervisors of the County is authorized to canvass the returns of the election pursuant to Section 10411 of the Elections Code. Section 6. The Clerk of this District is hereby directed to deliver, no later than February 3, 1995 (which date is not fewer than 123 days prior to the date set for the election), two certified copies of this resolution and order to the County Superintendent of Schools and one certified copy to the County Clerk, and shall file a certified copy of this resolution and order with the Clerk of the Board of Supervisors of the County. Section 7. The County Superintendent of Schools is hereby requested to prepare and execute a Formal Notice of School Bond Election and consolidation order in substantially the form attached hereto as Exhibit A (the "Formal Notice"), and to deliver the Formal Notice and a copy of this resolution and order no later than February 6, 1995 (which date is not fewer than 120 days prior to the date set for the election), to the County Clerk. Section 8. The County Superintendent of Schools is hereby requested to call the election by causing said Formal Notice to be posted in accordance with Section 5362 of the Education Code no later than March 8, 1995 (which date is not fewer than 90 days prior to the date set for the election), or to otherwise cause said notice to be published as permitted by law. District ("District") is determined to maintain quality library and other support services for its students; and WHEREAS, the Board is determined to maximize the ability of all classrooms .y, in the High School District to access and make full use of computers and technology as well as to prepare students for the work-site of the 21st Century; and ,6F2-39963.3 i FEE-06-1995 15: 10 C.C.C.OFFICE OF EDUCATION 510 942 3482 P:08.�'22- WHEREAS, funding from the state has not been adequate to meet these goals; and WHEREAS, declines in state funding during this decade have ziod"—` the ability of local funds to meet these goals; and WHEREAS, the District has engaged in a variety of efforts to generate _lnds for the District's educational program, including lobbying in the State Legislature, local fund-raising efforts, and cost-cutting measures, but these efforts have not prodij^ed suf5cient revenues; and WHEREAS, Section 4 of Article XIIIA of the California Constitutior and Government Code Section 50079 authorize a school district, upon approval of two-thirds of the electorate voting on the measure, to levy a qualified special tax for specaf ed purposes, following notice and public hearing; and WHEREAS, the District submitted to the voters on June 4, 1991 a proposition authorizing the levy and collection of a qualified special parcel tax in the amount of S42 per year for 10 years, which parcel tax was approved by the voters (the "Qualified Special Tax"); and SP1-39963.3 2 r FEE-OE-1995 15: 11 C.C.C.OFFICE OF EDUCATION 510 942 3482 P.09i22- WHEREAS, this Board believes that it is necessary to increase the Qualified Special Tax for the remaining six years of its life in order to continue meeting the students' basic educational needs; and WHEREAS, this Board has held a public hearing after due notice regarding this proposed increase to the Qualified Special Tax; NOW, THEREFORE, be it resolved by the Board of Education of the Acalanes Union High School District that: 1. This Board hereby determines to submit to the qualified electors of the District a proposal to increase the Qualified Special Tax for the following specific purposes: (a) to maintain and improve comprehensive educational and academic programs for students of the district, including retaining the 7-period class day; (b) to provide and upgrade additional library services, materials and equipment; (c) to provide funds to bring new technologies into the classrooms; and (d) to maintain small class size. 2. Upon approval of two-thirds of those voting on the measure, the increase in the Qualified Special Tax shall be in the amount of $20 per year for 6 years assessed against each parcel of taxable land in the District. A parcel shall be defined as any unit of land in the District which now receives a separate tax bill from the Contra Costa County Assessor's Office. All property which would otherwise be exempt from property taxes will also be exempt from the imposition of said special tax. In order to permit the District to expend the proceeds of the Qualified Special Tax under the constraints of the Appropriations Limit established by Article XMB of the State Constitution, this Board hereby further determines to submit to the qualified electors of the District a proposal to increase the District's appropriations limit for 4 fiscal years, in an amount equal to the Qualified Special Tax, as permitted by Article XIIIB, Section 4 of the California Constitution. The proposal to increase the appropriations limit and the proposal to increase the Qualified Special Tax shall be combined and voted on as a single measure. 4. This Board hereby requests the Contra Costa County Clerk ("County Clerk") to submit to the voters of this District on June 6, 1995 the ballot measure as described in Exhibit A attached hereto. S. That the authority for the specifications of this election order is contained in Section 5322 of the California Educational Code. 6. That the County Superintendent of Schools is hereby requested to prepare a Formal Notice of Parcel Tax Election in substantially the form attached hereto as Exhibit B (the "Formal Notice"). 7. That this Resolution shall stand as the order to the County Superintendent of Schools to call an election within the boundaries of the District on June 6, 1995. The Board of Supervisors of Contra Costa County is authorized to canvass the returns of the election pursuant to Section 10411 of the Elections Code. 11. Subject to two-thirds approval of the voters, the Qualified Special Tax shall be collected by the Contra Costa County Tax Collector at the same time as and along with, and shall be subject to the same penalties as general ad valorem taxes collected by said tax collector. The tax shall bear interest at the same rate as the rate for unpaid ad valorem property taxes until paid. 14. The collection of the Qualified Special Tax provided for herein shall not decrease the funds available from other sources of the District in any period from the effective date hereof.
