SUBJECT: USE OF LAKE AND VERDE SCHOOLS FOR CHILDREN'S CHRISTMAS AND GRADUATION
CEREMONIES TO BE HELD BY THE COMMUNITY SERVICES DEPARTMENT
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. RECOMMENDED ACTION
AUTHORIZE the Director of Community Services, or designee, to
execute a permit with the West Contra Costa Unif ied School District
for use of the Lake School premises at 2700 lith Street, San Pablo,
for children's ceremonies on December 15, 1995, and on June 21,
1996; and for use of the Verde School premises at 2000 Giaramita
Street, Richmond, for children's ceremonies on December 22 , 1995,
and June 28, 1996; and AUTHORIZE the Chair, Board of Supervisors to
sign a letter holding harmless and indemnifying the West Contra
Costa Unified School District and its employees and agents during
use of its premises on the aforementioned dates.
II. FINANCIAL IMPACT
Costs for use of the premises will not exceed $500 for all events
and will come from the Community Services Department Child
Development budget.
III. BACKGROUND
The premises are owned by the West Contra Costa Unified School
District and they require a permit to be executed and the County to
hold harmless and indemnify the District for the County's use of
the premises.

The County of Contra Costa has been self-insured for all liability
risks including medical malpractice and workers' compensation
arising from its operations, owned property, equipment and leased
property and equipment since 1976. The County's self-insurance
program provides for the legal defense of officials and employees
pursuant to Government Code Sec. 825 and payment of all sums which
it is obligated to pay by reason of liability imposed by law and
arising from their acts or failure to act, excepting exemplary or
punitive damages. This protection covers services performed by
officers or employees within the scope of their official duties in
accordance with the conditions of their employment or services.
With respect to workers' compensation benefits, the County provides
workers' compensation to all of its employees as required by
California State Compensation laws.
The self-insurance ,programs are prefunded to provide funds for
payment of claims.
Indemnification. The County shall defend, indemnify, save and hold
harmless West Contra Costa Unified School District and its officers
and employees from any and all claims, costs and liability for any
damages, sickness, death, or injury to person(s) or property
arising directly or indirectly from or connected with the
operations or services of the County or its officers and employees,
save and except claims or litigation arising through the sole
negligence or sole willful misconduct of West Contra Costa Unified
School District or its officers or employees.
County will make good to an reimburse West Contra Costa Unified
School District for any expenditures, including reasonable
attorneys' fees the District may make by reason of such matters
and, if requested by the West Contra Costa Unified School District
will defend any such suits at the sole cost and expense of the
County.
