Classrooms will have to be staffed with teachers prior to January 2 , 1996, so that a smooth transition can take place. We have prepared a draft Board Resolution to address the hiring of certain employees currently working for United Council of Spanish Speaking Organizations (UCSSO) . It is attached. Additionally, we have prepared a P-300 to establish the requisite number of positions to operate the Head Start Program. REASONS FOR RECOMMENDATIONS/BACKGROUND: On October 10, 1995 the Board adopted an Order acknowledging receipt of an appeal from United Council of Spanish Speaking Organizations, Inc. regarding the Board's September 12, 1995 decision to not renew UCSSO's contract for 1996 to act as a delegate agency for the Head Start Program and fixed October 17, 1995 as the date for a decision. On October 17, 1995 the Board subsequently denied UCSSO's appeal. On October 31, 1995, UCSSO submitted an appeal to the Administration for Children and Families in accordance with sections 1303.21 and 1303.22 of the Code of Federal Regulations. A final administrative decision regarding the UCSSO appeal has not been received from the Administration for Children and Families. If no decision is reached on the delegate agency's appeal before January 1, 1996, the Grantee must "furnish sufficient funds for the maintenance of the delegate agency's current level of operations until a final administrative decision has been reached" pursuant to 45 CFR 1303.23 (d). Approval of contract amendment agreements will allow UCSSO to continue providing services until a decision is reached. Instead, Head Start is operating under its third Iiscal year 1996 government-wide interim funding aot, known as a ",continuing resolution". This continuing resolution will be in effect until December i5, 1595. This Letter explains how your Head start program will continue to receive funding during this Continuing resolution period, �i'tS ��iatian... .�. �•,��omR' � �' The House of Representatives has passed a Labor/Health and Human Servides/Educattion appropriations bill that includes Head Start funding, but at a reduced level from fiscal year 1993 funding. , The full senate has not yet passed an appropriation bill. We cannot predict at this point how long the process will take and what the final appropriation level will be. 2n fiscal year Logs, Head Start's appropriation was $3.534 billion. For fiscal year 1996, the President requested an j incrpkse of $400 million to continue to expand and improve Read Start However, the Mouse of Representatives has passed an appro#riation bill that would reduce Hsad start funding by' approximately $137 million, or 3.9 peroent, below the fiscal. year � 1995 level. While! the appropriation process is taking place, the continuing resolution provides interim funding for Head start and other Feder:al' programs, 'but at a rate that •is lase than the funding level' appropriated for fiscal. year 1993. We dust await passage of another continuing resolution, or a final appropriation to be able to award the January programs enough funds to operate for a full 12 months. However, we do have the Funds to award the January grantees, a partial. grant that will allow 'them to operate until February - by which time we expect that additional funds will be available. Therefdre, we are acting now to provide your program with the first iiortion of its fiscal year 1996. funds. To determine the amaunt ;of this initial award, we first computed as we did for j grantees tended in October, November and December - a funding level that is 3.9 percent less than the on-going amount Previously planned for fiscal. year 1996. We have sufficient ! funds to provide all January programs a grant that is approximately one tenth of that radwed level. if necessary, future adjustments may be made to your grant Ia on-going funding level. i We hope that the final budget picture vill be 'cl.ear within the next several, weeks. During this interim period, grantees should follow several principles in managing their programs. First, we know that you share our continuing commitment to quality and will ensure :that compliance with Performance standards and other Head start regulations is maintained. Secondly, steps should be taken to cl.o�ely manage and control discretionary costs 8o that, it the 3 .9 percent reduction or a similar reduction becomes final, it can be, absorbed with minimal disruption to the program. ! We do not expect that, at this time, grantees will take actions that riduca the Scope or quality of services provided to children and families.
