ADDING EXEMPT POSITION FOR SHERIFF'S DEPARTMENT
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
1. APPROVE the introduction of the ordinance excluding the class of Secretary to the
Undersheriff from the Merit system, included as Attachment A.
2. APPROVE the position adjustment request establishing the class, adding one position and
canceling a Secretary Advanced Level position, included as Attachment B.
BACKGROUND:
Finance Committee
On December 5, the Board of Supervisors referred this issue to the Finance Committee. On
December 18,the Finance Committee discussed this item and identified that the proposal would add
an increased cost of$12 per year. Also,the Health Services Department has two exempt position.
The Committee suggested that the largest Departments have more latitude on such matters.

Findings
Each Department Head in Contra Costa County is authorized one Exempt Executive Secretary to
handle the most confidential, sensitive material which emanates from the Appointing Authority in
recognition of the principle that the top executive in a department needs to have the flexibility to
select a confidential secretary with which they can establish an effective working relationship. Often
exempt secretaries are privy to confidential, controversial information about issues involving such
areas as labor-management relations, litigation, staffing and disciplinary actions and must represent
the Department Head's position and interests when interacting with others. In the largest department
(Health Services), there are two Exempt Executive Secretary positions. The Contra Costa Fire
District has three Exempt Executive Secretaries as a result of the Fire District consolidation which
is currently being reviewed by administrative staff in the Fire District.
The Office of the Sheriff is the third largest County department. With the cuts in Sheriffs
management personnel over the past several years, the Sheriff has reorganized his top command
staff. The Sheriff previously had three Assistant Sheriff positions. Secretarial duties for these
Assistant Sheriffs were accomplished through the Merit System class of Secretary-Advanced Level.
Within the previous organization, these three Assistant Sheriffs were at a level below the Sheriff,
and Secretary-Advanced Level was an appropriate class to accomplish the secretarial duties for the
Assistant Sheriff.
In 1995, the Sheriff canceled his three Assistant Sheriff positions and created the Undersheriff
position. The Sheriff has delegated the day-to-day operation of the department to the Undersheriff
who is now responsible for the entire department. As a result of the reorganization,the Sheriff and
Undersheriff are in the same "box" of the organizational chart. They work on the same issues
together; one acts when the other is absent; and they "run" the department as a two person "team".
Consequently,they have the same needs for handling confidential, sensitive material and having a
secretary with whom they have that same discreet relationship. The establishment of this class
allows the Sheriff and Undersheriff needed flexibility in filling this position.
FISCAL IMPACT
This position would be created by canceling a vacant Secretary-Advanced Level position(incumbent
retired); establishing an Exempt Secretary to the Undersheriff classification and adding a position.
There is no layoff list for Secretary-Advanced Level. Consequently,the establishment of the exempt
class of Secretary to the Undersheriff will have no impact on any laid-off Secretary-Advanced Level
employees.
Exempt positions are allocated the management benefits package which is absorbable within the
Sheriff s Department budget. There are no increased salary costs.
ORDINANCE NO. 95 -
(Excluding the Secretary to the Undersheriff from the Merit System)
The Contra Costa County Board of Supervisors ordains as follows (omitting the parenthetical
footnotes from the official text of the enacted or amended provisions of the County Ordinance
Code):
SECTION I: Section 33-5.311 of the County Ordinance Code is amended to exclude the
secretary to the undersheriff from the merit system to read:
33-5.311. District Attorney and sheriff. (a)Investigators, detectives and others,
paid from the special funds furnished to the district attorney and sheriff under
Government Code Sections 29400 f£ and 29430 ff., are excluded.
(b) In the district attorney's office, the district attorney program
assistant-exempt class, senior deputy district attorneys-exempt, district attorney
chief of inspectors-exempt, special counsel, and special detectives, are excluded
and are appointed by the district attorney.
(c) In the sheriff s department, the undersheriff and three commanders
are excluded and are appointed by the sheriff-coroner.
(d) The secretary to the undersheriff is excluded and is appointed by the
sheriff-coroner. (Ords. 95- § 1, 95-34, § 1, 87-16, 85-55 §2, 85-29 § 2,

SECTION 11: EFFECTIVE DATE. This ordinance becomes effective 30 days after passage and
within 15 days of passage shall be published once with the names of the supervisors voting for
and against it in the ,a newspaper published in this
County.

The Finance Committee reviewed the above referenced issue and deferred action until it's December
18 meeting. Therefore, a report will not be prepared until Monday afternoon or Tuesday morning.
A four-fifths vote will be required to take this issue up on December 19 pursuant to the Better
Government ordinance.
