SUBJECT: Approve Agreement With Byron Bethany Irrigation District for Culvert Replacement and Authorize
Temporary Closure of Camino Diablo Road.

SPECIFIC REQUEST(S)OR RECOMMENDATIONS)&BACKGROUND AND JUSTIFICATION
I. Recommended Action:
APPROVE an agreement between the Byron Bethany Irrigation District (BBID) and Contra Costa County
(County)to equally share the cost of replacing a culvert crossing Camino Diablo Road, and AUTHORIZE
the temporary closure of Camino Diablo Road for a period of 16 calendar days.
H. Financial Impact:
The cost of the culvert replacement is estimated to be approximately $30,000. Road funds in the amount of
$15,000 are available for the County share of the project cost.
III. Reasons for Recommendations and Background:
By letter dated December 7, 1994, the BBID advised the County that the 72" metal pipe culvert, serving as
the conveyance for their canal lateral 45 facility under Camino Diablo Road approximately 0.6 miles west of
Holway in the Byron area, was corroded and in need of repair or replacement. The BBID requested that the
County affect repairs, citing County responsibility pursuant to California Water Code, Section 7034 and an
alleged informal acceptance of the culvert by the County. In subsequent discussions County and BBID staff
resolved to replace the culvert and equally share the costs and continuing responsibilities for maintenance of
the facility. The subject agreement provides for the sharing of replacement costs and establishes equal
responsibility for the safety, maintenance, and replacement of the culvert in the future.

The estimated cost of the culvert replacement is $30,000. Efficient pipe installation will require the
temporary closure of Camino Diablo Road. It is anticipated that five (5) consecutive work days will be
required to complete the installation. However, due to the time of year, a closure of sixteen (16) calendar
days is requested as a contingency for bad weather.
IV. Consequences of Negative Action:
Failure to approve the subject agreement will lose the opportunity to constructively resolve the issue of
culvert replacement. Without road closure, project costs will increase substantially.
