SUBJECT: Proposed Fees for GMEDA Departments
The Board considered the report and recommendations of Val Alexeeff,
. Director, Growth Management and Economic Development Agency (GMEDA) , on the
need to add, increase, and adjust fees for various services provided in the
departments of Building Inspection, Community Development, and Public Works.
The Chair opened the hearing and Dick Korr, 1790 Ellis Street, Suite 22,
Concord, spoke in opposition to the proposed fee increases.
Board members discussed the proposal and were in agreement to have the
fees reviewed by the Finance Committee.
Therefore, IT IS BY THE BOARD ORDERED that the hearing on the proposed
fees for GMEDA Departments is CONTINUED to December 19, 1995, at 3 p.m.
IT IS FURTHER ORDERED that the Finance Committee is REQUESTED to review
the proposed fees and report to the Board on December 19, 1995.

1. Recommended Action:
INTRODUCE AND WAIVE READING of ordinance containing revisions to Ordinance 92-96 to
recover costs reasonably borne for development services. Set December.,19, 1995 for second
reading and adoption of ordinance.
ADOPT resolution adding, increasing and adjusting fees for various services in the departments
of Building Inspection, Community Development and Public Works.
11. Financial Iml2act:
Development fees are meant to support non-General Fund dependent processes. Therefore,
accepting the staff fee adjustment recommendations will have no affect on the General Fund.
Adoption of these ordinance revisions will result in user fees which are more closely aligned with
the actual cost of service provision.
111. Reasons for Recommendations and Background:
Adoptionof these ordinance revisions is being requested in conjunction with adoption of the fee
adjustment Resolution for the Departments of Building Inspection, Community Development and
Public Works. The recommended revisions allow recovery of costs reasonably borne from fees
in the provision of development related services.

III. Reasons for Recommendations and Background (contd.):
In accordance with Ordinance 92-96, staff have conducted an annual review of fees charged for
development services. The last review was conducted in January, 1994. Due to the limited and
sporadic nature of the applications received prior to that review, no adjustments were
recommended at that time.
Staff of the Growth Management and Economic Development Agency have reviewed the 110
service categories for which Agency departments are authorized to charge fees. In most cases,
the fees which were established by Ordinance 92-96 were found adequate to recover the costs
of the service.
However, 11 services are performed without the benefit of sufficient fees for provision of those
services. Prior to determining the inadequacy of these fees, staff conducted a study of the time
and materials costs associated with the provision of each service. Through this process, staff also
identified 13 services for which no fee had been established. Further, staff have determined that
the level of fees for two services cannot be justified. Staff has recommended lowering fees in
these categories.
In regard to fees associated with the Building Inspection Department Permit Processing and
Inspection Program, the fees which staff recommend are those recommended by the Uniform
Building Code (Table 3-A together with Building Valuation Data from the May/June 1991 issue of
Building Standards Magazine), with modifications by staff.
In regard to changes in the Community Development and Public Works fees, the adjustments
continue toward charging entirely on a time and materials basis. In those service categories
where the implementation of time and materials charges is not yet practical, fees have been set
at the average cost of service, based on the County's fully burdened hourly rates. The service
requestor is required to pay the fee and all County costs in excess of 120% of the fee collected.
On September 14, 1995, Building Inspection, Community Development, Public Works and
GMEDA staff met with members of the building, development and engineering community and
reviewed and discussed the proposed fee adjustments. The concerns expressed were that the
time staff spends on a project are legitimate charges and, in regard to mitigation monitoring, that
the applicant is informed of the level of service to be provided by staff and the cost of that service.
The proposed mitigation monitoring fee now includes a provision for discussing level of service
and cost estimates with the applicant.
Staff has mailed notices to 147 building, developer, engineering and surveying firms advising
them of the proposed fee adjustments and of this Board meeting.
On November 6 and December 4, 1995 the Finance Committee reviewed the proposed fee
adjustments. Testimony was heard from staff and cost recovery for appeals and for
reconsiderations were discussed at length.
The Finance Committee has endorsed the proposed fee adjustments, but has asked staff to
prepare a fee structure for reconsiderations and appeals which will reflect 100% cost recovery and
will assign to project applicants, those costs beyond that which is necessary for basic processing.
Staff has assessed the appeal and reconsideration charges for the previous twelve month period
and has recommended a fee recovery structure reflective of average processing costs.

SUBJECT: Revisions to the Agency's Fees for Services
On December 4, 1995, the Finance Committee reviewed and discussed the cost of appeals and the cost
for reconsideration of development projects. The Committee asked staff to prepare a plan for recovering
costs from both the applicant and the appellant.
I. RECONSIDERATION COST RECOVERY:
The Finance Committee approved staffs recommendation to revise to 100%, the cost recovery
allowance for reconsideration. A reconsideration involves work associated with perfecting initial
project decisions, and therefore should be borne by the applicant.
II. APPEAL COST RECOVERY:
The following is staff's recommendation for structuring appeal fees:
When an applicant files an appeal:
All costs associated with the appeal are charged to the applicant. The applicant is responsible
for the appeal filing fee, for the processing fee, and for all costs beyond the processing fee.
When an non-applicant files an appeal.
The non-applicant is responsible for filing and processing fees. The applicant is responsible for
any costs beyond the processing fee.
[1] Appeal filing fee will remain $125. This fee is a filing fee which covers only the cost to place
the appeal on the agenda.
[2] The appellant will pay$875 appeal processing fee for land use permit projects, $1375 appeal
processing fee for minor subdivisions, and $1875 appeal processing fee for major
subdivisions.
[3] The applicant will pay all charges beyond the processing fee which are necessary to cover
staff costs for providing additional information and analysis on the project.
[4] If a procedural error is demonstrated, then the appellant will be refunded the appeal
processing fee.

Discussion:
Staffs recommendations are based upon the following premises or tenants:
• The appellant has the opportunity to participate in the decision making process, to present .
and to discuss the issues pertaining to the project. If the appellant is not satisfied with the
decision of the hearing body, the appellant should pay the processing cost of appealing the
decision to another body.
• If the decision was dependent on a procedural flaw caused by staff, the fault lies with the
County and the County should absorb the cost of the appeal processing.
• The appeal processing fee is based on an average cost to process a routine appeal. If new
information is brought forward or additional information is needed, or additional analysis is
required of staff, then the costs to process the appeal will probably exceed the appeal
processing fee. At that point, the applicant will be charged for the associated costs.
• In filing for the appeal, the appellant must identify the basis for requesting and filing the
appeal.
• Prior to hearing the appeal, all fee payments should be current.
III. BOARD MEMBER BUDGETS:
At the Finance Committee meeting, the Committee also requested staff to review ways to identify
a budget to pay for Board Member initiatives. Staff will prepare some alternatives and bring
before the Finance Committee at a later date.

(Adding Certain Development Fees and Renumbering Fee
and Service Charge Revenue/Cost Comparison System)
The Board of Supervisors of Contra Costa County ordains as follows (omitting the
parenthetical footnotes from the official text of the enacted or amended provisions of the
County Ordinance Code):
SECTION I. SUMMARY. This ordinance revises and adds fees to the Fee and Service
Charge Revenue/Cost Comparison System, as last ammended by Ordinance 92-96.
SECTION II. Division 620 of the County Ordinance Code is amended to read:

COMPARISON SYSTEM
620-2.002 Findings and Intent. (a) Pursuant to Article XIIIB of the California
Constitution, it is the intent of the board of supervisors to require the ascertainment and
recovery of costs reasonably borne from fees, charges and regulatory license fees levied
therefor in providing the regulation, products or services hereinafter enumerated in this
chapter.
(b) The fee and service charge revenue/cost comparison system set forth in this
chapter provides a mechanism for ensuring that fees adopted by the county for services
rendered do not exceed the reasonable estimated cost for providing the services for which
the fees are charged.
(c) The adoption of this chapter is exempt from the California Environmental Quality
Act (Public Resources Code, §21000 et seq.), because it approves and sets forth a
procedure for determining fees for the purpose of meeting the operating expenses of
County departments, as set forth in Public Resources Code Section 21080(b)(8)(1).

620-2.004 Delegation of Authority and Direction to Administrator.
(a) The county administrator is hereby delegated the authority and directed to
provide documents to the board to implement its herein enumerated policy to adjust fees
and charges to recover the percentage of costs reasonably borne as established hereby,
in providing the regulation, product or service enumerated in this chapter in the percentage
of costs reasonably borne and on the schedule of rate review and revision as hereinafter
established in this chapter.

(b) The county administrator is hereby delegated authority to issue executive orders
(including administrative bulletins) defining terms, setting out administrative, fee collection,
and financial procedures, definitions, and establishing effective dates of all fees set by the
board by resolution. All executive orders shall be originated and signed by the affected
department head, signed by the auditor-controller certifying that the financial requirements
of this chapter are complied with, and signed by the county administrator connoting the
effective date of the executive order and new or revised rate structure, procedure or
definition.
(c) "Costs reasonably borne"shall be as defined in Section 620-2.006. In adjusting
fees and charges, the county administrator shall act in an administrative and ministerial
capacity and shall consider only the standards and criteria established by this chapter, and
the procedures set hereby and by applicable state law. All executive orders issued
hereunder shall comply in all respects with this chapter, and the several schedules of fees
and rates as set by the board by resolution.

620-2.006 "Costs Reasonably Borne" Defined. "Costs reasonably borne," as used
and ordered to be applied in this chapter, are to consist of the following elements:
(a) All applicable direct costs including, but not limited to salaries, wages, overtime,
employee fringe benefits, services and supplies, maintenance and operation expenses,
contracted services, special supplies, and any other direct expense incurred.
(b) All applicable indirect costs including, but not restricted to, building maintenance
and operations, equipment maintenance and operations, communications expenses,
computer costs, printing and reproduction, vehicle expenses, insurance, debt service, and
like expenses when distributed on an accounted and documented rational proration
system.
(c) Fixed asset recovery expenses, consisting of depreciation of fixed assets, and
additional fixed asset expense recovery charges calculated on.the current estimated cost
of replacement, divided by the approximate life expectancy of the fixed asset. A further
additional charge to make up the difference between book value depreciation not
previously recovered and reserved in cash and the full cost of replacement, shall also be
calculated and considered a cost so as to recover such unrecovered costs between book
value and cost of replacement over the remaining life of the asset.
(d) General overhead, expressed as a percentage, distributing and charging and
expenses of the board, county counsel, county administrator, clerk of the board, county
treasurer, auditor-controller, personel director, and all other staff and support services
provided to the entire county organization. Overhead shall be prorated between tax-
financed services and fee-financed services on the basis of said percentage so that each
of taxes and fees and charges shall proportionately defray such overhead costs.

(e) Departmental overhead, expressed as a percentage, distributing and charging
the cost of each department head and his or her supporting expenses as enumerated in
subsections (a), (b), (c), and (f) of this section.
(f) Debt service costs, consisting of repayment of principal, payment of interest, and
trustee fees and administrative expenses for all applicable bond, certificate, or securities
issues or loans of whatever nature or kind. Any required coverage factors or required or
established reserves beyond basic debt service costs also shall be considered a cost if
required by covenant within any securities ordinance, resolution, indenture or general law
applicable to the county.

620-2.008 Schedule of Fees and Service Charges. (a) The county administrator,
auditor-controller and each county department head, under the direction of the county
administrator, shall review annually the fees and service charges listed following, and
provide an adjusted fee or charge schedule to the board for its consideration and approval
so as to recover the listed percentage of costs reasonably borne necessary to provide the
listed regulation, product or service. . Unless the board determines otherwise at the time
it fixes specific fees and charges pursuant to Section 620-2.010, the percentages set forth
herein should be utilized.

(b) A minimum fee of$10.00 shall be charged in all instances except where noted.
(c) All fees and charges set pursuant to this Chapter and section shall take effect ten
(10) days after the County administrator signs an executive order stipulating that all provisions
of this Chapter have been met.
(d) The schedule of frequency of rate adjustments may be varied by the County
administrator to adjust revenues sufficient to meet debt service coverage requirements of any

(e) The County administrator may vary the review schedule listed in this section if, in
the judgement of the county administrator and a directly affected and requesting department
head, a gross inequity would be perpetrated by not considering the revision of the percentage
rate schedule. Any such proposed rate revision which deviates from the review schedule as set
herein shall be reported to the Board at its next succeeding meeting or at the time consideration
is being undertaken pursuant to Section 70-2.010 to modify established fees and charges.

620-2.010 Statutory Public Meeting. Pursuant to Government Code Sections 66016
and 66018, for fees subject thereto, the Clerk of the Board shall cause notice to be provided as
set out in Government Code Sections 66016, 66018 and 6062a, and the Board periodically, at
least annually, shall receive at a regularly scheduled meeting oral and written presentations
concerning fees and charges proposed to be increased or added. Such notice, oral and written
presentation, and public meeting shall be provided prior to the Board of Supervisors taking any
action on any new or increased fees or charges. At least one such public hearing shall be held
annually, in conjunction with the County annual budget process and hearing.

SECTION IV. SEVERABILITY. If any portion of this Ordinance or Chapter 620-2 of the County
Ordinance Code is found to be unconstitutional or invalid, the Board hereby declares that it
would have enacted the remainder of this ordinance and/or Chapter 70-2 regardless of the
absence of any such invalid part.
SECTION V. PRIORITY. In the case of any conflicts, the provisions of this ordinance shall
prevail over all prior ordinances, resolutions, Board orders, and all actions of all County boards
and commissions concerning fees and charges. Any fees and charges established pursuant to
this Chapter shall supersede all previously established fees or charges for the same regulation,
product or service, and all such previous fees and charges are hereby repealed on the effective
date of the fees and charges established pursuant hereto. Obligations existing under any
resolution or other Board action repealed by this Section shall not be affected and shall remain
in full force and effect.
SECTION VII. EFFECTIVE DATE. This ordinance becomes effective 30 days after passage,
and within 15 days after passage shall be published once with the name of the Supervisors
voting for and against it in the , a newspaper published in this county.

S-002 Construction Inspection Program
A. Building Inspection Fees
1 . Building Permit The Building Permit Fee shall be as set forth in the
Fee Schedule (Table No. 3-A) of the 1991 Uniform
Building Code, or $45 dollars, whichever is greater.
2. CA Energy Compliance 25% of Building Permit and Plan Review or Permit
Surcharge Review fees. Applicable on all
structures with heated or air-conditioned space.
3. CA Access Compliance 25% of Building Permit and Plan Review or Permit
Surcharge Review fees. Applicable on all buildings
except residential use buildings with fewer than 4
dwelling units. Additions and alterations to an
exempt building, and accessory structures on the
same parcel with an exempt building, also are
exempt from this surcharge.
Valuation. The determination of value or valuation under any provisions of the County
Building Code shall be made by the Director of Building Inspection. The total valuation to
be used with the Fee Schedule shall be determined using the Building Valuation Data
contained in the Building Standards Magazine, published by the International Conference
of Building Officials, Whittier, California. The data in the June issue of each year shall be
used for the ensuing fiscal year. Work not listed in the Building Valuation Data shall be
valued per the Building Valuation Data Supplement below, which may be expanded
administratively by the Director of Building Inspection to clarify or cover additional types
of work and situations.
The valuation to.be used in computing the building permit fee shall be the total valuation
of all construction work for which the permit is issued; as well as all finish work, painting,
roofing, mechanical; electrical, plumbing, heating, air conditioning, elevators, fire
extinguishing systems, and any other permanently installed equipment. For industrial
facilities, the value of process equipment and heavy machinery supported by the structure
or by its own foundation shall be included. Contractor overhead and profit shall be
included.

The valuation of grading, retaining walls, paving and other site work, and any demolition
work, shall be included unless such work was included in other permits issued by the
Building Inspection Department.
The valuation data is used to establish consistent criteria for calculating permit fees, and
the calculated total valuation does not necessarily reflect actual costs. The County
Assessor does not rely on this cost, but performs independent assessments of the
permitted work.

E. Miscellaneous Fees
1 . Reinspections. When return trips to the site by inspector are necessary as specified
below, a reinspection fee shall be charged as follows:
a. For building permits with total valuations not exceeding $5,000, $25 per trip.
b. For building permits with total valuations of more than $5,000, $60 per trip.
c. For electrical, mechanical and plumbing permits on residential buildings, $25 per trip.
d. For electrical, mechanical and plumbing permits on non-residential buildings, $60 per
trip.
Situations where reinspection fees shall be applicable include the following:
a. When the work for a called inspection was not ready or not accessible to the
inspector.
b. When extra inspections are necessary due to deficient or defective work through fault
or error of the owner or contractor. One such extra inspection will be made for each
phase of work that requires inspection (i.e. foundation, rough electric, etc.) under the
regular fees prescribed in this section. A reinspection fee shall be charged for each
additional visit or inspection thereafter.
c. When more than one inspection is made on a phase of work (i.e. "partial inspections")
that normally is inspected in one trip. The fee may be waived when partial inspections
are necessary due to the large size of the project, or when they do not adversely affect
the efficiency of the inspector.
2. Owner-requested inspection of an existing building. The fee shall be based on an hourly
rate @ $60 per hour, with 1 hour minimum.
3. Inspection for Change of Occupancy. The fee shall be based on an hourly rate @ $60 per
hour, with 1 hour minimum.
4. Investigation of work without permit. When a Stop Work Notice is issued for work being
performed without permits or performed beyond the scope of existing permits, a special
investigation and inspection shall be made before permits may be issued for such work.
An investigation fee shall be charged equal to two times the amount of all permit fees
required by this ordinance, with a minimum of $100. The fee is additive to the permit
fees. This provision shall not apply to emergency work when it can be proven .to the
satisfaction of the Director of Building Inspection that such work was urgently necessary,
that it was not practical to obtain a permit before the work was commenced, and that a
permit was applied for as soon as practical.
5. Abatement of code violations. When a Notice to Comply is issued as a result an
inspection of an existing structure, and permits are required to correct violations found,
or to legalize work previously performed without permits, a code enforcement fee shall
be charged equal to two times the amount of all permit fees required by this ordinance,
with a minimum of $100. Where repeat site visits were required before the ,owner
obtained the required permits, a reinspection fee of $25 per trip shall be charged after the
second trip. Where repeat visits are necessary after permit issuance to enforce the
abatement work, a reinspection fee of $25 per trip shall be charged after the second trip.
The fees in this section are additive to the permit fees.

The Board of Supervisors of Contra Costa County resolves as follows:
A. BACKGROUND, FINDINGS:
1. The County of Contra Costa has conducted an analysis of its services, the costs
reasonably borne of providing those services, the beneficiaries of those services, and the
revenues produced by those paying fees and charges for special services.
2. The County wishes to comply with both the letter and the spirit of Article XIIIB of the
California Constitution and limit the growth of taxes.
3. The County's policy is to recover the full costs reasonably borne of providing special
services of a voluntary and limited nature, so that general taxes are not diverted from
general services of a broad nature and used to unfairly and inequitably subsidize special
services.
4. Heretofore, the Board of Supervisors has, by ordinance, established its policy on the
recovery of costs, particularly, the percentage of costs reasonably borne from users of
County services and directing staff as to the methodology for implementing said ordinance.
5. It is the intention of the Board of Supervisors to develop, as necessary, a revised
schedule of fees and charges based on the County's budgeted and projected costs
reasonably borne, for each fiscal year.
6. Pursuant to Government Code section 66016, the specific fees to be charged for
services may be adopted by the Board of Supervisors by Resolution, after providing notice
of and holding a public hearing at which oral and written presentations may be made, and
providing an opportunity to review the supporting data upon which the fees are based at
least ten days before the hearing. This Board finds that all of the requirements of
Government Code section 66016 have been met.
7. Pursuant to Government Code section 66018 other fees for services may be charged
after providing notice pursuant to Government Code section 6062a of and holding a public
hearing at which oral and written representations may be made. This Board finds that all
of the requirements of Government Code section 66018 have been met.
B. ADOPTION OF FEES:
1. Fee Schedule Adoption. The fees set forth in Exhibit A, attached hereto and
incorporated herein by this reference, are hereby adopted and shall be charged and
collected for the services enumerated therein.
2. Separate Fee for Each Process All fees set by this resolution are for each identified
process. Additional fees shall be required for each additional process or service that is
requested or required. Where fees are indicated on a per unit of measurement basis, the
fee is for each identified unit or portion thereof within the indicated ranges.of such units.

3. .Added Fees and Refunds. Where additional fees must be charged and collected for
completed staff work, or where a refund of excess deposited monies is due, and where

pursuant to and provided the requirements of Government Code sections 29373.1 and
29375.1 and amendments thereto are met.
4. Defining and Timing of Fee Schedule Definitions regarding and the timing of the
implementation of the herein enumerated fee schedule shall be as set forth herein and in
Ordinance No. 92-96, as said ordinance is amended from time to time.
5. Interpretation. This Resolution may be interpreted by the several County department
heads in consultation with the County Administrator. If there is a conflict between two fees,
the lower in dollar mount of the two shall be applied.
6. Severability: If any portion of this resolution is declared invalid or unenforceable by a
court of competent jurisdiction, the Board of Supervisors hereby declares that it would have
adopted the remainder of this Resolution regardless of the absence of the invalid part(s).
7. Repealer. All resolutions and other actions of the Board of Supervisors in conflict with
the contents of this Resolution, including Resolution No.92-831, are repealed to the extent
of any conflict, on the operative date of the conflicting provisions hereof. Obligations
existing under any resolution or other Board action repealed by this section shall not be
` affected and shall remain in full force and effect.
8. Effective Date. This Resolution is effective immediately upon adoption subject to any
applicable terms and conditions of Ordinance No. 92-96, as amended, except that fees
imposed herein on development projects (Gov. Code, §66000) become effective 60 days
after adoption.

SUBJECT: Revisions to the Agency's Fees for Services
On December 4, 1995, the Finance Committee reviewed and discussed the cost of appeals and the cost
for reconsideration of development projects. The Committee asked staff to prepare a plan for recovering
costs from both the applicant and the appellant.
I. RECONSIDERATION COST RECOVERY:
The Finance Committee approved staffs recommendation to revise to 100%, the cost recovery'
allowance for reconsideration. A reconsideration involves work associated with perfecting initial
project decisions, and therefore should be borne by the applicant.
II. APPEAL COST RECOVERY:
The following is staffs recommendation for structuring appeal fees:
When an applicant files an appeal:
All costs associated with the appeal are charged to the applicant. The applicant is responsible
for the appeal filing fee, for the processing fee, and for all costs beyond the processing fee.
When an non-applicant files an appeal.
The non-applicant is responsible for filing and processing fees. The applicant is responsible for
any costs beyond the processing fee.
[1] Appeal filing fee will remain $125. This fee is a filing fee which covers only the cost to place
the appeal on the agenda.
[2] The appellant will pay$875 appeal processing fee for land use permit projects, $1375 appeal
processing fee for minor subdivisions, and $1875 appeal processing fee for major
subdivisions.
[3] The applicant will pay all charges beyond the processing fee which are necessary to cover
staff costs for providing additional information and analysis on the project.
[4] If a procedural error is demonstrated, then the appellant will be refunded the appeal
processing fee.

Discussion:
Staffs recommendations are based upon the following premises or tenants:
• The appellant has the opportunity to participate in the decision making process, to present
and to discuss the issues pertaining to the project. If the appellant is not satisfied with the
decision of the hearing body, the appellant should pay the processing cost of appealing the
decision to another body.
• If the decision was dependent on a procedural flaw caused by staff, the fault lies with the
County and the County should absorb the cost of the appeal processing.
• The appeal processing fee is based on an average cost to process a routine appeal. If new
information is brought forward or additional information is needed, or additional analysis is
required of staff, then the costs to process the appeal will probably exceed the appeal
processing fee. At that point, the applicant will be charged for the associated costs.
• In filing for the appeal, the appellant must identify the basis for requesting and filing the
appeal.
• Prior to hearing the appeal, all fee payments should be current.
III. BOARD MEMBER BUDGETS:
At the Finance Committee meeting, the Committee also requested staff to review ways to identify
a budget to pay for Board Member initiatives. Staff will prepare some alternatives and bring
before the Finance Committee at a later date.
