HomeMy WebLinkAboutMINUTES - 12121995 - C55 TO: BOARD OF SUPERVISORS FROM: PHIL BATCHELOR County Administrator DATE: December 12, 1995 SUBJECT: Responsibility for Prosecuting Sexually Violent Predators Specific Request(s) or Recommendations(s) & Background & Justification RECOMMENDATION: DESIGNATE, as recommended by the District Attorney and County Counsel, the District Attorney as the county attorney for Sexually Violent Predator proceedings. FINANCIAL IMPACT: No additional funding is provided for these services. REASONS FOR RECOMMENDATION/BACKGROUND: As of January 1, 1996, counties will assume the burden of conducting legal proceedings, including jury trials, to extend commitments of sexually violent predators. The State Department of Corrections will determine those individuals who, after requisite examinations and other criteria are met, will be recommended for the commitment proceedings. The petition for commitment will be filed in the Superior Court of the County in which the person was convicted of the offense for which he or she is under jurisdiction of the Department of Corrections. The legislation directs the County Board of Supervisors to designate either the District Attorney or County Counsel to be the County attorney for these proceedings. It is the recommendation of both the District Attorney and County Counsel that the District Attorney be designated for Contra Costa County.
