SUBJECT: ADOPT THE RESOLUTION OF APPLICATION TO THE LOCAL AGENCY FORMATION

I. Recommended Action:
ADOPT Resolution of Application to the Local Agency Formation Commission (LAFCO) to establish a
County Service Area for Dougherty Valley in the San Ramon area; and
ESTABLISH a sphere of influence for the County Service Area.
II. Financial Impact:
The creation of the County Service Area for Dougherty Valley will enable the County to finance extended
public services without extra cost to the County General Fund and taxpayers outside Dougherty Valley.
III. Reasons for Recommendations and Background:
The formation of the Dougherty Valley Service Area-will implement certain subdivision conditions of
approval and implement the principles for appropriate development as described in the settlement
agreement in Town of Danville, et al. v. County of Contra Costa, et al., dated May 11, 1994. The
boundaries of the service area will be in the unincorporated area of the County. A map of the proposed
service area and legal description are included as Attachments A and B of the attached resolution. The
services to be provided are police services, park operation and maintenance, trails, open space, right of
way landscaping, storm drain, roads, libraries, community center, and other extended County facilities and
services.

RESOLUTION OF APPLICATION TO THE LOCAL AGENCY FORMATION
COMMISSION OF CONTRA COSTA COUNTY FOR APPROVAL TO INITIATE
PROCEEDINGS FOR FORMATION OF COUNTY SERVICE AREA NO. M-29 AND
FOR ESTABLISHMENT OF SPHERE OF INFLUENCE FOR COUNTY SERVICE AREA
NO. M-29
RECITALS:
1. After certification of the Dougherty Valley EIR(Resolution No. 92-864),
the County in 1992 approved a General Plan Amendment(Resolution No. 92-866) and Specific
Plan(Resolution No. 92-867) for the development of Dougherty Valley.
2. The County,together with Shapell and Windemere,the developers of
Dougherty Valley, has entered into various agreements to settle litigation brought by certain
parties against the County as respondent, and against Shapell and Windemere as real parties in
interest, relating to County's approval of the General Plan Amendment and Specific Plan and its
certification of the Dougherty Valley EIR(collectively,the"Settlement Agreements"). The
Settlement Agreements establish, among other things, certain procedures and standards that will
be applied to County's consideration and approval of the future approvals , including the
formation of a County Service Area.
3. The formation of a County Service Area will implement the principles for
appropriate development of Dougherty Valley especially described in Article III of the
Settlement Agreement in Town of Danville, et al. v. County of Contra Costa, et al., dated May
11, 1994,to implement Section 3.2(b) of the Development Agreement between County and
Shapell for Country Club at Gale Ranch and Conditions 9, 37 and 39 of County's Conditions of
Approval for Subdivision 7796 and Development Plan 3010-92 as modified by the Board of
Supervisors on December 13, 1994, Country Club at Gale Ranch.
4. The formation of a County Service Area will enable the County,without
extra cost to the County General Fund and the taxpayers outside of the Dougherty Valley,to
provide and finance extended public services to the Dougherty Valley residents and property
owners.
The Board of Supervisors of Contra Costa County Resolves that:
I. Proposal
(a) This proposal is made pursuant to the Cortese-Knox Local
Government Reorganization Act of 1985 ("Cortese-Knox Act") (Government Code
section 56000, et seq.) and the County Service Area Law(Government Code section 25210.1, et
seq.).
(b) The nature of this proposal is a change of organization for the
formation of a new County Service Area No. M-29 and the current establishment of a
sphere of influence boundary for said County Service Area; said formation is to be initiated by
this Application to the Local Agency Formation Commission of Contra Costa County'
("LAFCO")for approval of the new County Service Area.
(c) The exterior boundaries of the area to be formed into County
Service Area No. m-29 are all part of the unincorporated territory of Contra Costa
County. A map showing such boundaries for the proposed service area is set forth in
Attachment"A"; a legal description of the territory to be included in the proposed County
Service Area is set forth in Attachment"B".
(d) Terms and conditions proposed for the change of organization are
as follows:
1. The services to be provided by County Service Area
No. M-29 are as follows: provide police services and construct, operate and maintain parks,
trails,recreation areas, open space, special landscape areas, library, community center, senior
center, corporation yard, flood control and storm drainage facilities, internal road network
(including bicycle paths and park-and-ride lots), and other extended County facilities and
services as prescribed in Government Code section 25210.4, et seq. These services.in particular
are set forth in the "Plan for Providing Services" set forth in (e) below.
2. As territory of County Service Area No. M-29 is
annexed into the City of San Ramon upon request of the County,the City of San Ramon and the
affected property owners,pursuant to Government Code section 56375(p), LAFCO is to waive
the application of Government Code section 25210.90 so that the property being annexed can
stay within the County Service Area.
3. The extension or construction of any previously authorized
charge, fee, assessment or tax by the County in the affected territory.
(e) The reason for this proposal is to form a County Service Area to
provide extended public facilities and services in the territory described in Attachments"A"
and"B". This provision of extended services is more fully presented in the "Plan for Providing
Services"to be filed after the adoption of this Resolution of Application by the County of Contra
Costa with the LAFCO Executive Officer pursuant to Government Code section ,56653.
(f) The Board of Supervisors hereby requests that the Local Agency
Formation Commission take action to accomplish the aforestated formation and hereinafter
mentioned sphere of influence establishment,by proceeding under the Cortese-Knox Act.
(g) This proposal is consistent with the sphere of influence of any
affected city or district.
11. Sphere of Influence. It is hereby requested that a sphere of influence for
the new County Service Area be established co-terminus with the boundaries of the new County
Service Area.
111. Miscellaneous.
(a) The funding for the County Service Area is to be from a yet to be
approved and established benefit assessment charges obtained from those benefiting from the
facilities and services, from user fees or charges in accordance with the County Service Area
Law, or from special taxes authorized pursuant to Government Code sections 25210.6a,23027
and/or 50075, et seq.
