RESOLUTION NO.95/609
SUBJECT: Amending Subdivision Agreement, Subdivision MS 5-94, Martinez Area.
The following substitute security to guarantee the road and drainage improvements
as required by Title 9 of the County Ordinance Code was presented for Board approval
this date:
Security with Rochelle Frost as principal in the form of a corporate surety bond
(Bond No. 7583) dated November 20, 1995, and issued by American Contractors
Indemnity in the amount of $29,100 for faithful performance and $15,050 for labor and
materials.
NOW THEREFORE BE IT RESOLVED that the Subdivision Agreement approved
by the Board on September 19, 1995, is hereby AMENDED to allow substitution of the
above-mentioned corporate surety bond in place of the cash security;
BE IT FURTHER RESOLVED that the Public Works Director is AUTHORIZED to
refund $44,150 of the cash deposit (Auditor's Deposit Permit No. 266170, dated August
30, 1995, in the amount of$45,225), plus interest in accordance with Government Code
Section 53079, if appropriate, to Rochelle Frost. One thousand dollars of the same
Auditor's Deposit Permit shall be retained as required minimum cash deposit.
All deposit permits are on file with the Public Works Department.
