RECOMMENDATION
Acknowledge receipt of report on Suspension of Competition and direct appointment.
BACKGROUND
Section 502, Suspension of Competition, provides that the Director of Human Resources may suspend
competition and authorize a direct appointment to merit system positions where use of competitive
examination procedures are impractical. It also requires that a report of these suspensions of competition
giving the reason(s) shall be reported to the Board of Supervisors.
In accordance with the above regulations, I am authorizing the following direct appointment:

SUBJECT: Agenda Item - Report of Suspension of Competition by
Director of Human Resources
The following suspensions of competition and direct appointments during 1995 were authorized
by the Director of Human Resources as provided for in the Personnel Management Regulations
Section 502, as part of the disability program:
Debbie K. Rubio from the class of Secretary-Journey Level to Account Clerk-
Experienced Level in the Health Services Department effective January 3, 1995.
Patricia Harris from the class of Eligibility Work Specialist to Clerk-Experienced Level
in the Social Service Department effective February 6, 1995. (Ms. Harris retired from
her position September 30, 1995.)
Amy Mitchell from the position of Clerk-Senior Level in the Human Resources
Department to Clerk-Senior Level in the Social Service Department effective February
24, 1995.
The requests from the Health Services Department and Social Service Department for these direct
appointments are attached.

Employee Rehabilitation Counselor
I. Will provide supportive assistance to the employee and
department.
2. Will monitor progress in the Rehabilitation program. The
Counselor will attempt to resolve any problems that occur in
the program.
3. Will provide follow-up services. If the job does not last for
one year, the Workers' Compensation system is responsible to
provide additional appropriate services.

2. Meets the performance, behavior, and attendance standards
established by the Social Services Department.
3. Cooperates with the Employee Rehabilitation Counselor. Will

REMILITATION PLAN AGR 'I'
Argy Mitchell and Contra Costa County through the Social. Services
Department enter into the following Rehabilitation Agreement:
I. Intent
it is the intent of the County's Rehabilitation program to
facilitate appropriate and early return to work of County employees
whenever possible. In order to achieve this, various vocational
rehabilitation services may be provided, including supportive
services to the employee and the receiving department.
Rehabilitation services for the employee may include vocational
evaluations, counseling, and transfer of job skills. A
rehabilitation plan is developed with the employee's consent which
considers the abilities and interests of the individual. If the
employee returns to productive County employment, the placement
should be to the satisfaction and benefit of the employee and
department.
II. laye,e's Background Information
Ms. Mitchell has been employed with the County since April
1990. She worked as a senior Clerk with the Personnel
Department. Due to an injury sustained to her back, a change
in work assignments was necessary. Ms. Mitchell will now work
as a Senior Clerk for social Services under the Rehabilitation
Program.
Social Services Department
1. The change in assignment becomes effective February 24, 1995.
2. The trial period commences Friday, February 24, 1995, and runs
through August 25, 1995. The trial period will, not extend
beyond that date. During this period of time, both Ms.
Mitchell and the department can assess the appropriateness of
the job.
3. Ms. Mitchell will receive normal supervision and training to
efficiently perform the essential functions of her job class.
4. An appropriate department representative will alert the.
Employee Rehabilitation Counselor of any problems that arise.
5. if Ms. Mitchell's job performance is acceptable at the
completion of the trial period, she will continue as an
employee of the Social Services Department.
6. if Ms. Mitchell's performance is not acceptable during the
trial period, she will revert back to the class of Senior
Clerk on a leave of absence status in the Personnel
Department.

SUBJ: Accommodations Under Rehabilitation for Debbie Rubio - Health
Services Employee #43655
Debbie Rubio was a journey level secretary for Health Services earning
$2,677/mo. She sustained an industrial injury to her hand on 12/4/92, and
is permanently precluded from working on the computer for more than 4/hrs.
per day. In order to accommodate her, Health Services is able to provide
her with an experienced level account clerk position in patient accounting.
The job will start on January 3, 1995. She will have to come in at the top
step. Per the new guidelines under workers' compensation, if the job does
not last a year rehabilitation must be offered again. Thus, although there
is not an official probationary period, rehabilitation will be offered
again if this position does not work out for all parties.
