SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
1. Recommended Action:
A. APPROVE Right of Way Contract and ACCEPT Grant Deed dated October 13,1995, from
George Curtis, et. al.
B. AUTHORIZE the Chief Engineer to execute said Right of Way Contract on behalf of the
District.
C. APPROVE payment for said property rights and AUTHORIZE the Auditor-Controller to
issue a check for$87,350 payable to Chicago Title Company, 590 Ygnacio Valley Road,
Suite 300, Walnut Creek, CA 94596, Escrow Number 76064, to be forwarded to the Real
Property division for delivery.

in the Office of the County Recorder.
ll. Financiallmaact:
Payment of$87,350 from Drainage Area 56 funds.
111. Reasons for Recommendations and Background:
These property rights are required for the East Antioch Creek project, part of the East Antioch
Creek Watershed Area Drainage Improvement Plan. The marsh between Wilbur Avenue and
Cavallo Road will be cleaned up and opened to increased tidal water flow preserving and
enhancing the riparian habitat. Over time, the project will result in the reversion of the existing
freshwater marsh to a more natural saline marsh.
IV. Consequences of Negative Action:
The District will be unable to protect and preserve this valuable environmentally sensitive habitat.

A portion of the northwest quarter of Section 19, Township 2 North, Range 2 East, Mount Diablo
Meridian, being all of that parcel of land described in the deed to George Curtis et al. recorded July 15,
1982 in Volume 10853 of Official Records at page 533, more particularly described as follows:
Commencing at the north quarter comer of Section 19 (T2N, R2E); thence along the north line of Section
19, north 8929'35" west 175.00 feet, to the northeast corner of said Curtis parcel (10853 O.R. 533);
thence from the Point of Beginning, south 00026'52" west 330.00 feet, to the southeast corner of said
Curtis parcel on the north line of Block 4, River View Terrace filed February 25, 1907 in Book B of Maps
at page 43; thence along said north line, north 89029'35" west 430.00 feet, to the southeast corner of
that parcel of land described in the deed to Robert Joseph Schwab recorded March 26, 1976 in Volume
7805 of Official Records at page 57; thence along the boundary of said Schwab parcel (7805 O.R. 57),
north 0030'25" east 60.00 feet and north 8929'35" west 115.00 feet, to the east right of way line of
Maria Avenue as said east line is shown on the map of River View Terrace (B M 43); thence along said
east line, north 00030'25" east 231.00 feet, to the most southern corner of that parcel of land described
in the deed to Contra Costa County recorded January 3, 1958 in Volume 3099 of Official Records at
page 1; thence along the boundary of said County parcel as follows: 1) along the arc of a tangent curve
concave to the southeast having a radius of 20.00 feet, northerly, northeasterly and easterly 31.42 feet,
through a central angle of 9000'00", and 2) non-tangent, north 6306'40" east 41.29 feet, to the east
corner thereof on the south line of said Section 19, also being the south right of way line of Wilbur
Avenue; thence along said south line, south 8929'35" east 488.00 feet, to the Point of Beginning.
Containing an area of 172,080 square feet (3.95 acres) of land, more or less.

Bearings are based on the California Coordinate System Zone III (CCS27) with south 8929'35" east
being taken as the bearing of Wilbur Avenue centerline as shown on the map entitled "A Precise Section

of Official Records at page 401.
