RE: MINIMUM ABATEMENT STANDARDS & ENFORCEMENT
Dear Board of Supervisors;
I appeal to you to intervene and force action to correct a threat
to person and property as described herein. I am including
copies of prior correspondence for your reference and background
establishment.
Even after our repeated requests since our first contact two
years ago, we have found neither the City of Lafayette nor the
Contra Costa Consolidated Fire District have used their authority
to force removal of the weeds, fallen trees, debris and standing
dead pines . This condition poses a real threat to persons ,
private property, public property and animals . Having again wit-
nessed a fire storm raging out of control, the Board of Directors
reaffirms it ' s commitment to force action to correct this
negligence of ownership and enforcement.
I am enclosing a partial copy of my file on this subject . I
would be able to meet with you or any individual or group that
would be able to force action by the agencies responsible or the
property owners themselves .

Dear Property Owner:
Our records indicate that dry grass or weeds and/or combustible rubbish have
been observed on the above subject property within the last three years. These
conditions create a fire hazard and constitute a public nuisance. Such hazard
shall be abated and maintained in accordance with the abatement standards on
reverse.
IT MAY BE NECESSARY TO CONDUCT A SECOND ABATEMENT OF WEEDS DURING THE SUMMER
DUE TO REGROWTH.
This notice is issued under authority of Part 2 .7 and Part 5, Division lZ of
the California State Health and Safety Code and Contra Costa County Ordinance
89/68.
Abatement of the hazard shall be completed by not later than May 22, 1995 . An
inspection will be conducted to insure compliance. If the abatement has not
been completed, or is not maintained in accordance with the Fire District' s
standards, the District may arrange for such abatement. Any costs incurred by
the Fire District for such abatement, including an administrative charge, will
be assessed against the property, collected like property taxes, and will be a
lien on the property until paid.
If you have already conducted the annual abatement on the property, please
disregard this notice.
If you no longer own the property, need a list of abatement contractors or have
any questions, please contact the Fire District's Division of Exterior Hazard
Control at (510) 930-5584 .

Dear Ron:
As you will recall, earlier this year we met at the Beacon Ridge townhome development to discuss the
concerns of this Association relative to a grove of old Blue Gum Eucalyptus trees situated along the
southerly property line of the Association's property. Beacon Ridge is a 112-unit P.U.D.located just south
of Pleasant Hill Road at Green Valley Drive in Walnut Creek. The southerly property line of the
development abuts to the City of Lafayette.
At our last meeting, we inspected the stand of eucalyptus and I expressed, on behalf of the Association,
our concern over the large amount of debris that has accumulated under these trees over a long period
of time and the fact that the lower branches of these trees extend down to ground level. You agreed that
these trees pose a possibly serious fire hazard in the event of a grass fire and that precautionary steps
should be taken. The question at the time of our meeting was on whose property these trees were
located.
Since our meeting, we have investigated the ownership of these trees, and I am happy to include the
information that we have gathered. In summary,the entire stand of trees are located within the property
lines of various single family homeowners situated within the City of Lafayette. When these residential lots,
known as Quandt Subdivision Tract#4871, received their approval for development,the City of Lafayette
required that a scenic easement be established to protect the grove of trees located along the northerly
portion of the property and that the fire protection requirements of the Consolidated Fire Protection District
be adhered to. These requirements appear as items#5 and#4,respectively, of the enclosed Conditions
For Approval Of Subdivision 4871. The terms of the easement require the property owners to maintain
the grove of eucalyptus trees located within the easement.
Also enclosed is a copy of a letter dated 3 December 1993, made in reference to the subject eucalyptus
grove, from Betsy Van Popering, Associate Planner for the City Of Lafayette, addressed to Adele and
Robert Bailey, homeowners in Beacon Ridge. In the last paragraph of this letter,Ms.Van Popering states
that it is the City's goal and policy to *protect mature tree growth, and, encourage fire safety practice_s.
When there is a conflict between those two issues, health and safety rules.'
The Beacon Ridge Association is concerned with the hazardous fire conditions presented by the grove
of eucalyptus and we herewith request that the Consolidated Fire Protection District (CFPD') compel the
property owners of these trees to take immediate corrective measures to reduce the hazards presented
by these trees. Enclosed is a petition signed by eleven homeowners of Beacon Ridge whose homes are
located immediately north of the eucalyptus grove.

Although many of Beacon Ridge's homeowners would prefer the removal of these trees,we understand
that a removal may require a lengthy process; so, at a minimum, we request that the CFPD require the
offending property owners to:
1. Limb up the trees
2. Remove debris from underneath and around the trees; and,
3. Remove any dead or fallen trees.
Several different copies of location maps, Tract Map #4871 and the property ownership records have
been included for your convenience. We have identified the following parcels and property owners as
those which are included in the eucalyptus grove:

Should these property owners fail to timely abate the fire hazards presented by the grove of trees, we
request CFPD to immediately engage a contractor to remove the hazards and to then bill the property
owners.
