Adopted this Order on October 25, 1994, by the following vote:
AYES: Supervisors Smith, Bishop, DeSaulnier, Torlakson and Powers
NOES: None
ABSENT: None
ABSTAIN: None
SUBJECT: Notice of Intention to Consider a Resolution Establishing Weight Restriction
for McEwen Road (Road No. 2784, Port Costa)
WHEREAS the Board on July 19, 1983, having prohibited any vehicle, with or
without load, which exceeds a gross weight of 14,000 pounds from traveling on that portion
of McEWEN ROAD (Road #2784), Port Costa, beginning at the intersection of State
Highway 4 and extending northerly to the intersection of Carquinez Scenic Drive (Traffic
Resolution No. 2896), and having set October 25, 1994 at 11:00 a.m. as the date and time
for a public hearing to consider if such 7-ton load limit should be extended indefinitely,
pursuant to CVC-sec.35721; and
Notice of said hearing having been duly given pursuant to CVC 35721 and Gov. C.
6064; and
No objection, written or oral, having been submitted; and
Said hearing having been held at said date and time and interested parties having
been afforded an adequate opportunity to be heard with respect to any objections; and
The Board having found that, by accepted engineering standards, said portion of
McEwen Road cannot support which exceed a gross weight of 14,000 pounds; and
On the basis of a traffic and engineering survey and recommendations thereon by
the County Public Works Department's Traffic Engineering Section, and pursuant to
County Ordinance Code Sections 46-2.002 - 46-2.012, the following traffic regulation is
established (and other action taken as indicated):
Pursuant to Sections 35717-35721 of the California Vehicle Code, no commercial
vehicle with or without load, which exceeds a gross weight of 14,000 pounds shall travel
upon that portion of McEwen Road (#2784), beginning at the intersection of State Highway
4 and extending northerly to the intersection of Carquinez Scenic Drive.
Be it FURTHER RESOLVED THAT: This Traffic Resolution shall become effective:
1) When appropriate signs are erected, pursuant to CVC 35718 and Ord. C.
46-2.008.
