DATE: November 8, 1993 TO: Val Alexeeff, Director, GMEDA FROM: Tom Torlakson, Supervisor, District V SUBJECT: ANIL SUKHRAM COMPLAINT I have received a copy of your October 20 letter to Mr. Sukhram responding to his June letter. I note in the first paragraph of your response that you indicated you received his letter on July 18, 1993. Our records indicate receipt of a copy of that letter on June 18, 1993 . In any event, there is an issue in Mr. Sukhram' s letter that is not answered in your response. Mr. Sukhram first raised the building permit question on several of these properties well over two years ago. It is clear from the information outlined in your letter, and from the pictures submitted in his original complaint, that in several cases building permits were either issued after the fact or were revised (i .e. from duplex to triplex) after his complaint was made. How did this occur? Did the owners pay all applicable fees and were they assessed a penalty at all? Mr. Sukhram has contacted me and indicated that he does not find this response to be satisfactory. I believe that there are still questions that need to be. resolved before we can close this file. :j :i Harvey E. Bragdon On June 16, 1993 at 1 : 00pm , I had a meeting with Mickie Perez in regards to the complaints I have made in the past two years . Although Ms. Perez ' s answer was that of which I ' ve heard from every department I was referred to, Ms . Perez assured me that she would attempt to solve the complaints, because it required an investigation from other departments . My meeting with . Ms . Perez was very informative . For instance ; I was told, "your home has not yet been finalized" ; there is an illegal trailer on your property" ; there ' s fees still owed on the pending subdivision" ; ett . . ett . . etc . I Felt very intimidated because I Faildd to see the significance nor the validity of her Findings. Was my arranged meeting with Ms. Perez to help me re- solve my complaints I ' ve made or to validate the integrity of her and other departments? Ms . Perez knew everything about my property yet she couldn ' t answer my questions regarding my complaints . Also , the reference in your office memos referring my name as ANAL , instead of Anil appears too infantile For a staff who is paid by the public to perform in a mature , educated and without prejudice manner . Mr . Bragdon , I would also like to take this opportunity to file a formal complaint against the planning department For allowing duplexes (atwo) that were turned into two triplexes without any necessary permits or fees or any penalties , after I brought it to the C.O. D attention. What if Everyone turned their duplexes into tri-plexes? What if I turned my sintle family house into a duplex? Wouldn' t a or the public be fined or made to destroy the extra units? The tri=plexes are located at 217 N. Broadway Ave . in west Pittsburg . Because of the extra units , there is more noise , traffic and need for more police protection . The whole basis For my complaints had been the Fact that my neighbors (the Trost family and relatives) have multi;-units and several houses on a lot size equal or less than mine , yet they have built and are building with the planning departments ' approval , yet I can ' t build one other single house without first having to subdivide . I feel the decision made by the planning department , i ,i,n regards to the two tri-plexes should be reviewed or an opportunity opened to everyone in the public . A Follow-up is requested. Mr . Bragdon, I apologize iF I appear to be minding other peoples' business, but we are talking about my neighborhood, and its' Future . I strongly Feel I should and the public should be treated equally as paying taxpayers and citizens of this County. (510) 646-1599 Ms. Perez also informed you that during her review of all the complaints, it was discovered that your property had some violations. You were informed, as part of the discussion that you have an outstanding building permit which has not been finaled and that you have not paid the Park Dedication Fee of $1350.00 due the Community Development Department. You were also informed that the Mobilehome located on your property is not allowed without a Land Use Permit. When you left her office on 6-16-93, it was Ms. Perez 's impression that you understood all the information given to you except for the approvals given at 143 Solano Ave. Ms. Perez told you she would find more information and get back to you. It was also explained to you that the West Pittsburg Redevelopment Plan was adopted on 12-29-87 and was not fully implemented until September 1991. A complete review of all land use requests has been started by the Redevelopment Agency. The West Pittsburg neighborhood that you are concerned about has a General Plan designation of Single Family Residential - High Density and a Zoning of Multiple Family Residential. The General Plan designation provides the primary development goal in the area. The Zoning designation provides additional guidance for development. Each project is reviewed for compliance with these two sets of criteria. Property which is zoned single family may have a second permanent living unit on the property if the second unit is approved with a Land Use Permit and if the second unit is under 1000 square feet. Because the General Plan designates this area as single family residential, this is a use that can be considered. Because the area is zoned Multiple Family Residential (M-17) a Development Plan approval is needed for any development of property. If the development proposed for a site is in compliance with the Redevelopment Plan for this area and with the requirements of single family zones it has been the policy of the County to allow construction of single family homes and second units which meet the second unit ordinance requirements. For your further information the approval of two units on 143 Solano was allowed because one of the units was proposed to be less than 1000 square feet. As indicated earlier, a second unit under 1000 square feet is one use allowed on this property. The other option would be to subdivide the property with a minor subdivision which would then allow for a house on each parcel with no special limitation to the size of the house. The property owner chose to request a second unit rather than a subdivision and agreed to have one house under 1000 square feet which is consistent with the single family high density designation in the General Plan for that area. The option was also given to you but your second unit was to be larger than 1000 square feet. Therefore an application for a minor subdivision was needed in order to allow construction of a second house. This approval has been given to you. Please note you have until January 1, 1996 to complete the requirements of your minor subdivision. The above information should satisfy all of your concerns. As a result of our discussion and an extensive amount of additional research and inspections I have identified nine (9) properties that have non-conformities to the zoning regulations on them. Each of these properties have been assigned zoning investigation case numbers and have been assigned a priority in accordance with our standard procedures. If you have any questions regarding the complaints you submitted you may inquire to them by their addresses. During my discussion with you, you had concerns with regards to your ability to develop your properties. I have discussed this matter with Dennis Barry, Deputy Planning Director. He has asked that I provide you with the attached information and let you know that whereas your properties (apn 096-041-001 and 096-041-013) are zoned M-17 Multiple Family Residential District, and subject to all of the regulations, uses, and limitations of that district consistent with the general plan requirements of the area. Please note that in accordance with first code section 84-28.402 and then code section 84-26. 1802 you may submit to the zoning administrator for approval a development plan for any of the uses permitted in the M-17 zoning district. Also please not that no development or uses may be made of you property until such time a the zoning administrator has approved a development plan submitted in the format required by this Department. As you know, Mr. Sukhram is alleging that code enforcement in the West Pittsburg area (at least in the area of North Broadway) is not being applied equally and consistently. Mr. Sukhram first contacted our office in October of 1991 after he had received a "Cease and Desist" order from the County related to his site at 195 North Broadway. Mr. Sukhram first contacted County Staff in February 1991 proposing to construct a duplex. He was told at that time that unless he provided a two-car garage for each unit his application would not be approved. ., He pointed out at this time that he was aware of other duplexes and even triplexes being constructed nearby which were not complying with this requirement, and provided the addresses of the sites in question. He revised his plans, from construction of a duplex to placement of a mobile home on the site. He then . proceeded to obtain the necessary building and sewer permits, which were duly signed and stamped by Chuck Coday in Planning, Franklin Lew, Bldg. Inspection and Delta Diablo Sanitation District. He was understandably upset at subsequently receiving the cease and desist order. It would appear from the documentation provided that Mr. Sukhram has attempted to comply with the County's requirements to the best of his ability. Mr. Sukhram states that he does not expect to receive "red carpet" treatment; however, he does feel that the same conditions and code enforcement actions should be applied fairly and equally. He states that he has filled out the complaints forms provided to him to initate code enforcement actions, but has not received any information on the status of those complaints . i Ms . Supervisor Torlakson would like to receive a list of the complaints Mr. Sukhram has filed for code enforcement investigation and their current status, as well as information on the violations alleged in his attached letter, if these are in addition to those already lodged. I am also enclosing pictures that have been provided to support Mr. Sukhram' s allegations (some in obvious state of construction; therefore, unlikely to be pre-existing or "grandfathered" ) .
