SUBJECT: EMPIRE AVENUE BRIDGE REPLACEMENT

SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
I. Recommended Action:
A. APPROVE Right of Way Contract and ACCEPT Grant Deed dated January 10, 1994 from
Roy W. and Erica L. Pantle.
B. AUTHORIZE Public Works Director to execute said Right of Way Contract on behalf of
the County.
C. APPROVE payment of $2,750.00 for said property rights and AUTHORIZE the Auditor-
Controller to issue a check in said amount payable to Chicago Title Insurance Company,
Escrow No. 75488 to be forwarded to the Real Property Division for delivery.
D. I DIRECT the Real Property Division to have the above referenced Grant Deed recorded
in the office of the County Recorder.
II. Financial Impact:
Payment of $2750.00 from Oakley Area of Benefit funds.
III. Reasons for Recommendations and Background:
These property rights are required for the Empire Avenue Bridge Replacement project in
accordance with the approved plans and specifications.
IV. Consequences of Negative Action:
The project will not have sufficient land rights to allow construction in accordance with the

Real property in the northwest quarter of the northwest quarter of Section 35, Township 2 North,
Range 2 East, Mount Diablo Meridian, Contra Costa County, California, being portions of that parcel
of land described in the deed to Roy W. Pantie et ux recorded June 24, 1983 in Volume 11311 of
Official Records at page 662, described as follows:
PARCEL 8: (Fee Title)
Commencing in the intersection of Empire Avenue and Laurel Road at the iron pipe marking the
northwest comer of Section 35 (T2N, R2E); thence along the west line of Section 35, south 0°43'21"
west 206.30 feet; thence south 89024'47" east 22.50 feet to the Point of Beginning at the northwest
comer of said Pantie parcel (11311 O.R. 662); thence from the Point of Beginning, along the north
line of said Pantie parcel, south 89024'47" east 37.54 feet, to a point hereinafter referred to as Point
"H'; thence leaving said north line, south 19043'03"west 115.32 feet, to the west line of said Pantie
