Martinez, Executive Director DATE: January 18, 1994 SUBJECT: COMMUNITY ORIENTED POLICING DEMONSTRATION PROGRAM AGREEMENT FOR SERVICES SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION I. RECOMMENDED ACTION: APPROVE Agreement for Services between the Housing Authority of the County of Contra Costa and the City of Pittsburg for the Community Oriented Policing Demonstration Program for the period November 1, 1993 to October 31, 1994 at a contract price of $12.00 per hour per Reserve Officer for two full-time Reserve Officers, and AUTHORIZE execution by the Executive Director. II. FINANCIAL IMPACT: Funding for the payment of $12.00 per hour for two full-time Reserve Officers, during such time as they are physically present at and providing services to E1 Pueblo, has been provided for in the 1994 Comprehensive Grant Program budget. III. REASONS FOR RECOMMENDATION/BACKGROUND: a On January 12, 1993 the Board of Commissioners approved the implementation of a Community Oriented Policing Demonstration Program proposed by the Pittsburg Police Department. This highly successful program, which began on January 4, 1993 at El Pueblo, has now received supplemental funding from the City of Pittsburg which will extend the program through October 31, 1994. The .Reserve Officers will perform standard police services which will include foot patrols, allowing the officers to devote their full on-duty time to El Pueblo; response to emergency calls for service at El Pueblo; provide incident and contact reports to the Housing Manager at E1 Pueblo; and, testify at court and administrative hearings at the request of the Housing Authority. This program will continue to insure that the concerns of the El Pueblo community are heard and that their needs are met. IV. CONSEQUENCES OF NEGATIVE ACTION: Should the Board of Commissioners elect to not approve the Agreement for Services which would extend this program, the Housing Authority of the County of Contra Costa would be unable to effectively provide security services to the residents of El Pueblo, CA011005, Pittsburg. PARTIES: The Housing Authority of the County of Contra Costa, a public body, corporate and politic (hereinafter called "Authority") , and the City of Pittsburg, a municipal corporation (hereinafter called "City") , agree that the City shall provide Reserve Officers to the El Pueblo public housing development according to the terms of this Agreement. The development is located at 875 El Pueblo in Pittsburg ("El Pueblo") . This Agreement is adopted under the authority of Government Code section 55632 , and other applicable law. 2. TERM: This Agreement is effective November 1, 1993 for a one year term. Unless extended by written agreement of the parties, the Agreement shall terminate at midnight on October 31, 1994 . 3 . CITY OBLIGATIONS: The City shall assign two full time Reserve Police Officers (hereinafter called "Reserve Officers") , in addition to the two regular duty officers routinely assigned to El Pueblo. The City shall increase the number of Reserve Officers to four as soon as reasonably practicable in the City's judgment. The Reserve Officers shall be employees of and under the exclusive supervision and control of the Pittsburg Police Department. The initial schedule for Reserve Officers is shown in the attached schedule ("Exhibit A") . Exhibit A also reflects the proposed initial schedule for "Security Officers" which may be provided by the Authority at the Authority's sole discretion and expense. The Security Officers' duties and schedule shall be as directed by the Authority. The City assumes no responsibility for the acts or omissions of the Security Officers. The schedule for the Reserve Officers may be revised by the Chief of Police with the consent of the Authority, consistent with the purposes of this Agreement. 4 . SCOPE OF SERVICES: The Reserve Officers shall perform standard police services at El Pueblo within their constitutional and statutory authority, and consistent with Police Department General Order No. 71, attached as Exhibit "B" and incorporated here by reference. The services provided by the Reserve officers shall include, but are not necessarily limited to, the following: a. Provide foot patrols, and devote their full on- duty time and attention to E1 Pueblo; b. Respond to emergency calls for service at El Pueblo; C. Provide incident and contact reports to the Housing Manager upon request; and AGREEMENT FOR .SERVICES PAGE 1 OF 4 d. Testify at court and administrative hearings at the request of the Authority. 5. YOUTH DEVELOPMENT CENTER: The regular and Reserve Officers shall participate in the establishment of an on-site youth development center. The purpose of the center shall be to provide culturally diverse programs which will be intended to benefit youth at E1 Pueblo by building self-esteem; increasing inter-cultural awareness; increasing awareness of drug abuse; providing an academic tutorial program; and providing multi-faceted recreational programs integrated with existing on-site recreational programs. The parties recognize that the goals referenced in sections 5 and 6 are subjective and not susceptible of quantification or enforcement, and that no cause of action shall arise solely from either party's perception that these goals are not being achieved. 6. GOALS: The parties agree that among the goals of the program described in this Agreement are the following: a. Engage both residents and police in the mutual identification and resolution of crimes and disorder; b. Regular and Reserve Officers to become an integral part of the E1 Pueblo community; C. Exchange of accurate information between the regular and Reserve Officers and residents about crime, the community and the goals of policing; d. Create an increased sense that police officers are concerned about community needs, and build trust and harmony between residents and the Police Department; and e. Encourage a close working relationship between the regular and Reserve Officers and the El Pueblo Resident Council, neighborhood community based organizations, and Authority staff on progress toward these goals. 7 . REPORT BY CHIEF OF POLICE: The Chief of Police shall provide the Housing Authority with the following reports: a. A monthly program report which describes the activities conducted by the regular and Reserve Officers assigned to El Pueblo during the month; and b. A quarterly statistical report and analysis measuring increases or decreases in the number of reported incidents of crime in El Pueblo. AGREEMENT FOR SERVICES PAGE 2 OF 4 8. COMPENSATION: The Authority shall reimburse the City for the services of the Reserve Officers at a rate of $12 . 00 per hour per officer, during such time as the Reserve Officers are physically present at and providing services to E1 Pueblo. The parties understand that, in the case of a major emergency requiring temporary, concentrated police activity elsewhere, the Chief of Police may be required to call the Reserve Officers away from the E1 Pueblo site. The City shall not be entitled to compensation for a Reserve Officer during any period when the Reserve Officer is called away from the E1 Pueblo site for any purpose. 9 . BILLING AND PAYMENT: The City shall submit to the Authority a monthly] statement for payment, in a form and manner reasonably prescribed by the Authority. Authority shall pay each statement within thirty (30) days after submittal. 10. INDEPENDENT CONTRACTOR STATUS: This Agreement is entered into by two separate public entities, who shall constitute independent contractors for purposes of this Agreement. This Agreement is not intended and shall not be construed to create a relationship of agent, servant, employee, partnership, joint venture or association. 11. SUBCONTRACT AND ASSIGNMENT: The City shall not subcontract any of the services or assign any rights or obligations under this Agreement without the Authority's prior written consent. 12 . RECORDS: The City shall keep an accurate record of the time expended and services performed on behalf of the Authority and shall make such records available to the Authority for audit purposes. Nothing in this Agreement shall require City to disclose confidential peace officer personnel records. 13 . INDEMNIFICATION: The City shall defend, indemnify, save, protect and hold harmless the Authority and its officers and employees from any and all claims, costs and liability for any damage, injury or death, to persons or property, arising directly or indirectly from or connected with the services provided hereunder or claimed or alleged to be due to negligent or wrongful acts, errors or omissions of the City or the Police Department, their officers and employees, and will make good to and reimburse the Authority for any expenditures, including reasonable attorneys fees, which Authority may make by reason of such matters. The Authority shall defend, indemnify, save, protect and hold harmless the City and its officers and employees from any and all claims, costs and liability for any damage, injury or death, to persons or property, arising directly or indirectly from or connected with the actions of the Authority pursuant to this Agreement or claimed or alleged to be due to the negligent or wrongful acts, errors or omissions of the Authority, its officers or employees, and will make good to and reimburse the City for any AGREEMENT FOR SERVICES PAGE 3 OF 4 expenditures, including reasonable attorneys fees, which City may make by reason of such matters. 14 . INSURANCE: City and Authority are self-insured, and shall maintain such insurance during the term of this Agreement. 15. TERMINATION: This contract may be terminated by either party, for any reason or no reason, after giving thirty (30) days' written notice to the other party. 16. REPRESENTATION: The signatories below that they are authorized on behalf of their respective public entity to execute this Agreement and thus bind the entity.
