GRANT DEED OF DEVELOPMENT RIGHTS
To meet condition number 3 and contingent upon the filing of Subdivision number
44 , we Seclusion Valley Development. Inc. , (owner) hereby grant to the County of
Contra Costa, governmental subdivision of the State of California, Grantee, and its
governmental successor or successors, the future "development rights" over an area to
be defined "Restricted Development Area Scenic Easement", as defined herein below over
a portion of that real property known as Area "B" of Record of Survey Lot Line
Adjustment filed in Book 80 of L.S.M. at Page 3 situated in the County of Contra Costa,
State of California, and more particularly described in Exhibit A.-
"Development rights" are defined to mean and refer to the right to approve or disapprove
of any proposed construction, development or improvement within the areas marked
"restricted development area". The "development rights" are and shall be a form of
negative easement which shall run with the said property and shall bind the current owner
and any future owners of all or any portion of said property. In the event of a disapproval
of proposed construction by the Grantee or its successor, said proposed construction
shall not be performed. Grantee or its successor may condition its approval of any
proposed construction upon prior or subsequent performance of such conditions as
Grantee may deem appropriate.
Any owner or owners of all or any portion of said property desiring to develop any
improvement requiring the approval of Grantee of its successor herein shall submit to
such entity a written proposal describing the nature, extent, and location of such
improvement. Grantee or its successor shall have sixty (60) days from receipt of such
proposal in which to grant its approval or disapproval. Failure by Grantee or its
successor to respond in said time period shall be equivalent to the approval of such
proposal. / 11

Real property in the County of Contra Costa, State of California, described as follows:
A portion of Area 'B" as shown on the Record of Survey, Lot Line Adjustment filed June
9, 1986 in Book 80 of L.S.M. at Page 3, in the office of the County Recorder of Contra
Costa County, more particularly described as follows:
Commencing at the most northerly comer of Parcel "A" as shown on the Parcel Map of
Subdivision MS 40-85, filed February 10, 1986 in Book 121 of Parcel Maps at Page 7 in the
office of the County Recorder of Contra Costa County, said point being on the
southernmost boundary line of the land of Fette, filed September 29, 1964 in Book 4712 of
Official Records at Page 222, in the office of the County Recorder of Contra Costa County,
State of California;thence from said point along the boundary line common to Area"B" (80
LSM 3) and Fette (4712 OR 222)North 58 57'30"East, 72.81 feet to the point of beginning;
thence continuing along said common boundary line North 58 57'30" East, 113.32 feet;
thence leaving the common boundary line of Area"B" (80 LSM 3) and Fette (4712 OR 222)
along the following courses: North 58 57'30" East, 126.68 feet; South 08 28'42" West, 182.58
feet; South 47 39'55" East, 121.70 feet; South 65 14'02" West, 162.39 feet; North 30 22134"
West, 239.72 feet to the Point of Beginning.
