RECOMMENDATIONS:
1 . REAPPOINT as a member of the Board of Trustees of the Contra
Costa County Law Library for a one-year term ending December

3 . REQUEST the County Administrator to report to the Internal
Operations Committee by April 1, 1994 on the status of the
following issues brought to our attention by Mr. Del Simone
and Mr. Skaggs :
The resolution of the question as to whether the Law
Library is going to pay rent to the County for the use of
the space presently occupied by the Law Library.
♦ The resolution of the question as to whether the County
is going to credit to the Law Library interest - on the
funds held by the County for the Law Library.

BACKGROUND:
The Law Library is governed by a seven-member Board of Trustees.
The Board of Trustees includes three Superior Court Judges and two
Municipal Court Judges . The County has two appointments to the Law
Library Board of Trustees, one a member of the Bar representing the
Board of Supervisors and the other serving in lieu of the Chairman
of the Board of Supervisors . The two members representing the
Board of Supervisors and the Chairman are to be appointed at the
Board of Supervisors ' first meeting of the calendar year and serve
for a one year term.
When the County' s representatives were appointed last, we asked
that they appear before the Internal Operations Committee in
December to report to us on the activities of the Law Library and
to bring to our attention any problems they were aware of that
should be brought to the attention of the Board of Supervisors .
We met with Mr. Skaggs and Mr. Del Simone, as well as Law Librarian
Jean Steffensen, on December 13, 1993 . Mr. Skaggs and Mr. Del
Simone noted two problems which continue to plague relations
between the County staff and the Law Library. The first is whether
the Law Library can or should be required to pay rent on the space
which is being occupied by the Law Library. The position of the
trustees is that the law clearly permits the Trustees to agree to
pay rent on the space, if they feel they have sufficient resources
to allow them to prudently do so but that they cannot be required
to do so by the County.
The other issue is whether the interest earned on the funds held
for the Law Library by the County should be credited to the Law
Library or whether the interest reverts to the County General Fund.
The trustees maintain that the law is clear that the interest
should be credited to the Law Library.
We were advised that there is considerable . background on both of
these issues and that County staff should, in fairness, be
permitted to present their position on each issue. We are,
therefore, asking the County Administrator to present a report to
the 1994 Internal Operations Committee prior to April 1, 1994 on
both of these issues .
