BACKGROUND: The term of office of three members of the Pacheco Municipal Advisory Council expired November 30, 1993 . Only one of the three has asked to be reappointed. In addition, our Committee has been advised that one member of the Pacheco Municipal Advisory Council has not been attending meetings on a regular basis and that his seat should, therefore, be declared vacant. We have advertised for these vacancies : On December 13, 1993, our Committee interviewed six of the applicants . We are making the above recommendations as a result of the interviews we conducted. We are also asking that the Board of Supervisors acknowledge receipt of the by-laws of the Pacheco Municipal Advisory Council, although we are not asking that the Board of Supervisors actually approve them. In this way, the by-laws can be changed by the Pacheco MAC without having to return them to the Board of Supervisors each time for approval . RECEIVED DEC 171993 Wd.--------. Two of our PMAC members were remiss in their behavior, and as a result, the remaining 5 members voted to to place them on the in- active ,l,ist. . .This .occurred at our November 1.0th meeting.... , Dan Tennille, our.. Secretary, was in violation of Article VI,,. Sec- tion I, subsection (d) :in­that he did NOT "act in the.'best 'inter- est of PMAC and Pacheco between meetings." He was accused of and admitted to. circulating a petition for his neighbors to annex to the city of Pleasant Hill. During our October meeting Tennille agreed to resign because he had a conflict of interest. Fred Schaefer, our Treasurer, was in violation of Article IV, Section II, subsection (a) in that he had more than two consec- utive unexcused absences from scheduled...monthly meetings. After I rewrote the PMAC Constitution and it was approved by PMAC in July, 1993, I personally carried a copy to. Schaefer and I told him according to the Constitution he could be placed on the. inactive list if he continued to have unexcused absences. He told me it. was difficult for him to attend meetings because he was employed as a bartender in a town far North of Pacheco After Schaefer missed the August,. The alternate, Pello Walker, had a term for one year which has also expired. If Fred Schaefer's office were declared vacant, there would be a total of five vacancies. PMAC MEETING MINUT11S Wednesday, November 10, 1993 CONTRA COSTA COUNTY .,Y ,i ROLL CALL: RECEIVED i PRESENT: Wally Wiggs DEC Joe Schneider Ted Tobbv Joe Minick OFFICE OF COUNTY ADMINISTRATOR i ABSENT: Barbara Alenza The meeting was called to order by Chairman dally Wiggs at 7 :00 P.M. Roll Call of Officers was made . No Treasury Report. Three items were on the agenda for this meeting: 1 . A follow-up discussion on the annexation HB 2137 by some i residents of Pacheco. 2 . The oral resignation of Member Dan Tennille, and possible expulsion of Fred Schaefer for absenteeism. j 3. To finalize a letter to Sunne McPeak to stop the opening of a hiking trail along the canal above Ada and Temple Drives. There was nothing new on the progress of the petition being circu- lated in some areas of Pacheco to annex to Pleasant Hill . Fred Schaefer was advised about the seriousness of not .attendirg PMAC meetings and possible repercussions . Chairman Wiggs asked for a motion for expulsion. A motion was made and seconded to re- move Schaefer, and was unanimously upheld. Motion tQ send a letter to Sunne McPeak and the Board of Super- visors stating our unanimous opposition to the Hiking Trail along the canal . PMAC voted to ask Sunne McPeak to have Alternate Pello Walker fill out the remainder of Schaefer' s term. Tennille ' s term is up the end of November, so nothing will be done until then. PMAC agrees that the County should make provisions to remove the trash in the bins provided by the Town Council along Grayson Creek and Aspen Way. The majority of the trash is picked up by Pacheco residents . They feel it is only fair that the County remove it , as the County is saving time and money by having some- one else do their job. PMAC was asked to work on expanding the town limits. especially along Blum Road and Pacheco Blvd. Meeting adjourned at 7 :40 p.m. without a motion being made. CONSTITUTION AND BY LAWS of the PACHECO MUNICIPAL ADVISORY COUNCIL ARTICLE I. NAME SECTION I. The name of this organization shall be the "Pacheco Municipal Advisory Council" (Hereafter referred to as PMAC, and PMAC is one and the same as Contra Costa County PMAC) SECTION II. PMAC as used herein shall mean a body of appointed community representatives who shall have the individual and collective responsibility to act on behalf of the general interests of the residents of Pacheco. ARTICLE II. OBJECTIVES SECTION I. To further the interests and well being of the residents of Pacheco through active participation in the political processes of Contra Costa County. SECTION II. (A) To maintain liaison with the Contra Costa County Board of Supervisors and other public agencies to insure that all concerned agencies are at all times fully cognizant of the needs and desires of the residents of Pacheco. (B) To keep the residents of Pacheco informed of pending actions of the Contra Costa County Board of Supervisors, the Local Agency Formation Commission, The State Legislature and other public agencies which will have a direct bearing on the general welfare of the residents of Pacheco. (C) To improve the service rendered by the county and other public agencies by the establishment of common meeting grounds to discuss problems and exchange ideas. (D) To seek the active participation of all individual citizens and/or groups to work on projects of mutual benefit for the community of Pacheco. PAGE 1 ARTICLE III. COUNCIL MEMBER APPOINTMENTS SECTION I. The PMAC shall consist of seven (7) members and one (1) alternate who shall be residents of the Pacheco community, and who shall be appointed by the Board of Supervisors. The officers of PMAC shall be: Chair, Vice-Chair, Secretary, and Treasurer. SECTION II. The PMAC members shall serve two (2) year terms except that for the initial council, the Board shall, by lot, select three (3) members who shall serve two year terms and four (4) members who shall serve one (1) year terms. The alternate shall serve a one (1) year term. A member whose term has expired shall continue to serve until a successor has been appointed by the Board of Supervisors. SECTION III. Each member of PMAC, at the time of his/her appointment by the Board, shall be a resident of Pacheco and while serving shall be a resident of Pacheco. PMAC shall have no more than seven (7) members and one (1) alternate at one time. SECTION IV. Upon the death or resignation of a member of PMAC, the vacancy shall be filled for the balance of the unexpired term by the current alternate. A new alternate shall be appointed by the Board of Supervisors to fill the balance of the unexpired term upon receiving a recommendation from PMAC. The PMAC shall submit a recommendation or recommendations to the Board of Supervisors within 60 days of a vacancy in the alternate position. All officers shall be.responsible for the duties of their respective offices. Any officer or PMAC member may be re-appointed for additional terms. PAGE 2 ARTICLE IV. COMMITTEES SECTION I. The Chair shall be an ex-officio member of all committees. The Chair shall appoint all committees subject to council approval. SECTION II. All committee chairpersons shall give a report of activities at each regular Council meeting. Reports may be submitted verbally or in writing. ARTICLE V. MEETINGS SECTION 1. Meetings of the PMAC shall be held on the second Wednesday of each month or at the call of the Chair. In the prolonged absence of the Chair or in an emergency, a special meeting may be called by two of the remaining officers or a majority of the PMAC members. All meetings will be in strict compliance with the provisions of the Ralph M. Brown Act. All meeting are open to the public and public comments are welcomed. A quorum of the PMAC shall be required to take any official Council action. ARTICLE VI. COUNCIL FUNCTIONS AND RESPONSIBILITIES SECTION I. PMAC SHALL: (a) Be composed of the Chair, Vice-Chair, Secretary and Council members. (b) Carry out the management and official business of PMAC in accordance with the PMAC By-LAWS. (c) Hold regularly scheduled meeting as provided for in the Constitution and By-laws. (d) Act in the best interest of PMAC and Pacheco between meetings. (f) Make a recommendation to the Contra Costa County Board of Supervisors to fill PMAC vacancies between appointments. (g) Make decisions in all matters not covered by the By-Laws PAGE 3 ARTICLE VI. COUNCIL FUNCTIONS AND RESPONSIBILITIES - CONTINUED SECTION II. MEMBERS MAY BE DECLARED INACTIVE (a) Members of the Council who have two (2) consecutive unexcused absences from the scheduled monthly meetings or who have not fulfilled their duties for a three month period may be declared inactive by the PMAC. This inactive office may be declared vacant by the Board of Supervisors, and the office will be filled by the alternate. A new alternate shall be appointed as provided for in article III Section IV. SECTION III. QUORUM DEFINED: PMAC has seven (7) members. A quorum to transact business shall consist of four (4) members of the PMAC Council. SECTION IV. CONFLICT OF INTEREST: The members of PMAC shall comply fully with the Board of Supervisors' Special recommended policy on Conflict of Interest. SECTION V. THE DUTIES OF THE OFFICERS SHALL BE: A. THE CHAIR: (1) acts as Chairperson of PMAC (2) serves as ex-officio member of all PMAC committees (3) appoints committee chairpersons with council approval (4) is responsible for coordinating all liaison and actions with the Contra Costa Board of Supervisors: and (5) is responsible for providing liaison between PMAC and all other governmental agencies. B. THE VICE CHAIR (1) presides in the absence of the Chair. C. THE SECRETARY: (1) is responsible for the minutes of all regular and any special meetings of the PMAC: and (2) is responsible for the preparation of all correspondence and maintains all files of the PMAC. PAGE 4 SECTION V. CONTINUED: THE DUTIES OF THE OFFICERS SHALL BE: D. THE TREASURER: (1) is responsible for the financial records of PMAC (2) pays all bills after approval by PMAC (3) provides a monthly financial statement of PMAC's position. (4) submits the financial records and books for a complete audit to a qualified auditor as designated by PMAC for this purpose; and presents the results of such an audit in writing to PMAC not later than September 1 of each year; and (4) serves as a member of the budget committee. SECTION VI. PMAC CHECKS A. Checks written shall have three (3) authorized signatures and two (2) signatures required. The authorized signatures shall be the Treasure's and two other signatures authorized by PMAC. Said PMAC members may be bonded at PMAC's expense. ARTICLE VII. FUNDING Funding for the PMAC may be obtained by solicitations from corporations, small businesses, service organizations, foundations, and private citizens. Funds may also be raised by sponsoring social events in the Pacheco community. ARTICLE VIII AMENDMENTS The Constitution and By-Laws may be amended by a majority vote of the PMAC members provided all proposed amendments shall be provided to members of the PMAC not less than seven (7) days prior to the next regularly scheduled meeting..
