THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Resolution on January 4, 1994 by the following vote:
AYES: Supervisors Powers, Smith, Bishop, McPeak and Torlakson

ABSENT: None

SUBJECT: Completion of Improvements, Subdivision MS 14-91, Walnut Creek Area.
The Public Works Director has notified this Board that the improvements in
Subdivision MS 14-91 have been completed as provided in the Subdivision Agreement with
Achelis Construction Company heretofore approved by this Board in conjunction with the
filing of the Subdivision Map.
NOW THEREFORE BE IT RESOLVED that the improvements have been
COMPLETED as of January 4, 1994, thereby establishing the six-month terminal period for
the filing of liens in case of action under said Subdivision Agreement:

BE IT FURTHER RESOLVED that the $7350 cash security for labor and materials
(Auditor's Deposit Permit No. 211899, dated August 12, 1992) deposited by Achelis
Construction Company be RETAINED for the six-month lien guarantee period until July
4, 1994, at which time the Public Works Director is AUTHORIZED to refund the cash
security less the amount of any claims on file.
BE IT FURTHER RESOLVED that the beginning of the one year warranty period
is hereby established, and the $14,700 cash deposit (Auditor's Deposit Permit No. 211899,
dated August 12, 1992) made by Achelis Construction Company is hereby reduced to 15%
($2205.00) and RETAINED for one year. The Public Works director is AUTHORIZED
to refund the reminder 85% ($12,495.00) pursuant to the requirements of Section 94-4.406
of the Ordinance Code.
