MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: JANUARY 4, 1994 SUBJECT: LICENSE AGREEMENT FOR GRAZING ON EXCESS ROAD RIGHT OF WAY, FRANKLIN CANYON ROAD, MARTINEZ AREA Project No.: W.O. 4200 SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION I. Recommended Action: APPROVE License Agreement with Art Pacheco, Jr., and AUTHORIZE the Public Works Director to execute said License on behalf of the County. II. Financial Impact: $100 annual revenue to Road Fund. III. Reasons for Recommendations and Background: In 1962, the State of California relinquished to Contra Costa County road right of way which contains Franklin Canyon Road in the Martinez area. Sections of the right of way are up to 300 feet wide and are split by Franklin Creek, with the road on one side and excess property on the other. This revocable license agreement allows an abutting property owner to use a small portion of excess property which is not visible or accessible from Franklin Canyon Road for grazing, landscaping and gardening. IV. Consequences of Negative Action: The County will continue to bear the expense of performing weed abatement and rubbish cleanup on this unused section of road right of way.
