This agreement is entered into by Contra Costa County and the DSA to summarize and ratify terms and conditions of employment while a comprehensive memorandum of understanding is being prepared. That document will be finalized by the parties as soon as possible and will then be submitted to the Board of Supervisors for approval. The following items shall be as described in the January 26, 1994 Tentative Agreement between the County and the DSA: Health and Dental coverages and subvention, 1st Choice Runout, Open Enrollment, Flexible Benefit Accounts for 1994 and 1995, Monthly Uniform Allowance, Wellness Incentive and Wages. Additional items are as indicated: 1. Management Complaint Procedure. Procedure to include additional Step 5 allowing DSA once-annual right to move an unresolved complaint to binding arbitration. 2. Unfair Labor Practice. Current Section 38 of DSA MOU will be included. 3. Shift Options. MOU will include language "nothing herein shall preclude the Sheriff from assigning members of this unit to the same shift pattern as a majority of employees they supervise." 4. MOU Numbering. The sections of the separate MOU for this unit shall be numbered congruently with like sections in the existing rank and file MOU. 5. Health Care. These provisions will be listed separately from the major section on Management Benefits. 6. Merit Board. Section 24.6 of the current rank and file MOU allowing access to the Merit Board on management complaints shall be included. 7. No Strike Clause. This section shall be included in the MOU. 8. Wellness Incentive. Language in the February 4, 1994 tentative agreement shall be included. If the foregoing conforms to your understanding, please indicate your approval and acceptance in the space provided below. J Tentative Agreement bD Contra Costa County and Deputy Sheriffs Association I. Modifications to 1991 - 1995 Memorandum of Understanding 1. Health Coverages: Effective February 1, 1994, the County will offer medical plans including contra costa Health Plan (CCHP) , Kaiser, QualMed, Delta Dental, and Safeguard Dental. 2 . Health Plan Subvention: Effective February 1, 1994, CCHP = 9811 County share; QualMed/Kaiser HMO' s = 79% County share. QualMed PPO = 7711 County share to October 31, 1994 . 3 . Dental Benefit Increase: Effective February 1, 1994, Delta Dental annual maximum benefit per member is increased from $1, 000 to $1,200. 4 . Kaiser Copays: Effective February 1, 1994, Kaiser office visit = $3 . 00; Kaiser drugs = $3 .00. 5. Future QualMed PPO Increases: Effective November 1, 1994, the County and the employees will equally share (500/500) the amount of any premium increases which have been guaranteed by QualMed to be a maximum of nine percent (90) . 6 . Runout: The County agrees to assume all runout costs associated with termination of the 1st Choice Health Plan and indemnify the 1st Choice trustees. 7. Open Enrollment: Open enrollment on a one-time basis shall be January, 1994, through February, 1994, and shall subsequently be in November of each year. Any 1st Choice members who have not designated a new plan as of February 1, 1994, will be automatically enrolled in .the QualMed HMO but may change their enrollment until March 1, 1994 . Between February 1, 1994 and July 31, 1994, QualMed members may change either from the PPO to the HMO and/or from the HMO to the .PPO once each. 8 . Flexible Benefit Account for 1994 : Effective as soon as possible but no later than ninety (90) days of this Agreement, the County will establish a Flexible Benefit Account for each DSA member in accordance with the provisions of the IRS Code Section 125 . The County will contribute seven hundred twenty ($720 . 00) dollars into each employee' s Flexible Benefit Account for 1994 . 2 9 . Flexible Benefit Account for 1995: The amount to be contributed for 1995 shall be the actual savings for 1994 as determined by comparing 10/93 1st Choice enrollment data to 10/94 QualMed enrollment data minus the projected savings of five hundred and nineteen thousand dollars ($519, 000) plus nine months worth of savings projected for 1995 based on 10/94 enrollment data minus seven and one half (7.5%) of such savings. 10 . Individual Enrollment Problems : The County will join with the DSA in negotiating resolution of any individual enrollment or coverage problems which may occur with the transfer of 1st Choice members to QualMed. 11. Retirees: Upon termination of 1st choice Health Plan benefits, retirees who have qualified as 1st choice Health Plan subscribers may enroll in any health plan offered by the County effective February 1, 1994 . Other retirees may change health plans no later than 2/28/94 . 12 . Monthly Uniform Allowance: Effective 7/1/94 , employees who are eligible for the uniform allowance will receive such allowance included in their monthly pay warrants. II . Additional Understanding On Wellness Incentive: The parties will continue to meet and confer regarding a one percent (1%) subvention increase for employees willing to sign a pledge to maintain a healthy lifestyle. Mutual agreement shall be required for implementation. III. Memorandum of Understanding for DSA Management Unit : 1. Provided that mutual agreement is reached on all outstanding MOU language proposals prior to the adoption/ratification of this Agreement, the County will provide a four and one-half (4 .59s) compaction adjustment to all members of this Unit effective July 1, 1994 . 2 . Effective October 1, 1994, the salaries of all members of this Unit will be increased by four percent (4%) , and, effective January 1, 1995, the salaries of all members of this Unit will be increased by four percent (4%) . 3 . Funding for these increases is provided in part by savings realized within the Sheriff' s Department due to organizational changes in the amount of approximately fifty-six thousand dollars ($56, 000) , and in part by seven and one-half percent (7 . 5%) of the actual savings from the change from 1st Choice to QualMed. 3 4 . The term of this MOU shall be February 1, 1994 through September 30, 1995 . 5 . The changes proposed in Watchstanding Conditions contained in the Memorandum to All Lieutenants from the Sheriff dated January 4, 1994 are agreed. 6 . All of the provisions described in I . and II . above will be applicable to this Unit. The parties agree to recommend adoption/ratification of this Agreement to the Contra Costa Board of Supervisors and the Deputy Sheriffs Association.
