ORDINANCE NO. 94 - 16
(Mental Health Medical Director-Exempt and
Executive Assistant to the Hazardous Materials
Commission-Exempt)
The Contra Costa County Board of Supervisors ordains as follows (omitting the parenthetical
footnotes from the official text of the enacted or amended provisions of the County Ordinance
Code):
SECTION 1: Section 33-5.313 of the County Ordinance Code is amended to exclude the classes
of Mental Heatlh Medical Director-Exempt and Executive Assistant to the Hazardous Materials
Commission-Exempt from the merit system to read:
33-5.313. Health-medical. (a) The director of health services is excluded and is
appointed by the board.
(b) The county health officer (Health and Safety Code Section 454) is excluded
and is appointed by the board.
(c) The county physician (Health and Safety Code section 1441) is excluded and
is appointed by the board.
(d) The county [local] director of mental health services (Welfare and Institutions
Code section 5607, 9 Cal. Admin. Code sections 620, 621 [Dir. of Local Mental
Health Services] is excluded and is appointed by the board.
(e) The assistant to the director of health services-exempt is excluded and is
appointed by the director of health services.
(f) The assistant directors of health services are excluded and are appointed by
the director of health services.
(g) Physicians and dentists serving the county (except those in the classifications
of assistant health officer and chief of community health services) are excluded

and are appointed by the director of health services.
(h) The health services administrative officer is excluded and is appointed by the
director-of health services.
(i) The medical director is excluded and is appointed by the board upon the
recommendation of the director of health services and the county administrator.
(j) The marketing director/Contra Costa Health Plan is excluded and is appointed
by the director of health services.
(k) The health plan provider affairs manager-exempt is excluded and is appointed
by the director of health services.
(1) The county hospital executive director-exempt is,excluded and is appointed by
the director of health services.
(m) The health services personnel officer-exempt is excluded and is appointed by
the director of health services:
(n) The substance abuse program director-exempt is excluded and is appointed
by the director of health services.
(o) The director of medical staff affairs-exempt is excluded and is appointed by
the director of health services.
(p) The mental health medical director-exempt is excluded and is appointed by the
director of health services.
(q) The executive assistant to the hazardous materials commission-exempt is excluded
and is appointed by the director of health services.

SECTION U: EFFECTIVE DATE. This ordinance becomes effective 30 days after passage, and
within 15 days of passage shall be published once with the names of the supervisors voting for
and against it in the CONTRA COSTA TIMES , a newspaper published in this
County.

I want to clarify the Department's request to formalize the
function of Mental Health Medical Director. This role has been
fulfilled by Joseph Hartog, M.D. for several years, but he is
officially classified as an Exempt Medical 'Staff Physician. The
formalization of the physicians' union and its affiliation with
UAPD, necessitate moving Dr. Hartog out of the bargaining unit so
he can execute his administrative duties. Creating the class
requires a corresponding. amendment to the ordinance code which
exempts certain classes, including other physician executives like
Drs. Walker and Tremain, from the Merit System. There is no
financial impact or net increase in positions.
I apologize for the confusion caused by this request. A copy of
the original submission to the Administrator's office is attached
for your information.

You will recall that earlier this year the Board approved our request to create the special class of Director
of Medical Staff Affairs for Steven Tremain, MD, reflecting his administrative role in Hospital Administration.
That request was prompted by the formalization of the Physicians Union and its subsequent affiliation with
UAPD, with whom we have been bargaining since March. It has now become apparent that a parallel
situation exists with Joseph Hartog, MD, who functions as medical director for the Mental Health Division.
I have been unable to consult with Dr. Hartog regarding negotiation issues related to the psychiatrists. Also,
like Dr. Tremain, he has responsibility for determining salaries of new staff psychiatrists, approving merit
increases, signing timesheets and recommending disciplinary action.
To remedy this, we are requesting that the management class of Mental Health Medical Director be
established and that Dr. Hartog be reallocated into it, with no appreciable change in salary.
By copy of this memo I am asking the County Counsel's office to prepare an Amendment to Ordinance Code
#33-5.313 excluding this class from the Merit system, to be placed on the Board's agenda concurrent with
this transaction. I understand that the class will not be exempt until the second reading of the Amendment
but would like the reallocation to be effective first. Exempt status is appropriate for this position, consistent
with other physician and physician executive classes.
